AFFIDAVIT OF DESISTANCE

I, LYNETTE APOSTOL, of legal age, Filipino, and a resident of No. 176 Fabian
St., Niog II, Bacoor City, Cavite, after having been sworn to in accordance with the law,
do hereby depose and state the following:

1. I am the private complainant and the complaining witness in Crim. Case No. B-
2021-330 for qualified rape now pending before the Regional Trial Court Branch
89, Bacoor City, Cavite;

2. After careful thought and consideration, I have decided to no longer pursue this
case;

3. I am no longer interested in prosecuting the instant case nor testify against the
respondent, Dennis Enriquez Toledo;

4. I respectfully request the Honorable Judge of Regional Trial Court Branch 89,
Bacoor City, Cavite to DISMISS the instant case against the abovementioned
accused, Dennis Enriquez Toledo;

5. I am executing this affidavit in order to attest to the truthfulness of the foregoing

statements.
