The Collector, SPSR Nellore District submitted that, on filing of requisition by the

Superintending Engineer, APGENCO, Nelatur for acquisition / alienation of lands

measuring an extent of Acs.162.25 (i.e., patta lands of Acs.44.28 and Govt. lands of

Acs.117.97) coved by Sy.Nos.2,3, 5A, 5B, 11 & 12 etc of Nelatur village, Muthukur

mandal for construction of Integrated Town ship (Residential colony) for the employees

of Sri Damodaram Sanjeevaiah Thermal Power Station (2X800 MW) at Nelatur village

along with Non-Residential Buildings such as Project Hostel and Guest House etc.,

proposals were submitted to the Special Chief Secretary to Government, Energy

Department requesting to issue necessary orders to take up land acquisition process

according to the LA Act in this office reference 1 st cited. After submission of the

proposals in the reference 2 nd cited, the Superintending Engineer, APGENCO, Nelatur

has informed that during the enjoyment survey conducted as per field demarcation,

there are shortly charges arose in the extents of patta lands and that some of the Ryots

are not willing to part with their lands for acquisition, as most of their lands were

acquired previously for the Project, As such the Superintending Engineer has submitted

revised requisition in the letter SE/ CC-II, SDSTPS, APPDCL, F.No.2, D.No.119/12,

dt.31.01.2012 for acquisition of patta lands of Acs. 30.62 covered by Sy.Nos.5A, 11 & 12

etc.

The Collector, SPSR stated that the Superintending Engineer, APGENCO,

Nelatur informed that the commencing of production of SDSTPS (2x800 MW) has been

planned by March, 2013 that the construction work of the Power Plant is under progress

and hence the accommodation to the operation staff & Engineers has to be provided

and that as a many nember of Employees have been posted to APPDCL / APGENCO,

Nelatur, they have also to be accommodated by completion of the residential colony.

Therefore, it is very much essential to complete the construction of Township nearer to

the Power Station. The Proposals for alienation of Government lands in favour of

APPDCL are being submitted separately.

The Collector, SPSR informed due to urgeny, the Draft Notification under Sec.

4(1) of the L.A. Act has been approved at district level for an extent of Ac.30.62 and

taken action and published the notification in the daily News papers., vide this office

reference 3rd cited as was done previously. After publication of the Draft Notification

under Sec. 4(1) of the L.A. Act in the daily News papers for an extent of Ac.30.62, the

Govt. has informd in the reference 3rd cited to send D.N. and DD proposals to the

Government through the CCLA for approval.

In this connection the Collector stated that proposals were again submitted to the

Government (Energy Department), vide this office letter 5 th cited, requesting to issue

necessary orders to take up Land Acquisition process according to the L.A.Act of 1984

i.e., publication of DN & DD for the patta lands measuring an extent of Ac.30.62 at

District level.

The Government in their Memo 6 th cited have informed that there are different

types of proposals clubbed in the letter 5 th cited and that requested to send the

proposals separately through the Chief Commissioner, Land Administrative, Hyderabad

for taking further action in the matter.

In the circumstance stated supra, the Collector, SPSR requested to kindly be

issued necessary post facto approval orders for the action in having notified the Draft

Notification under Sec. 4(1) of L.A., Act, as was issued in Government Memo.

No.3787/PR-IV/2007 Energy Department, dt.06.06.2009 cited and also necessary

orders delegating the powers to the district Collector, SPSR Nellore District for taking

necessary further action for approval and publication of Draft Declaration under Sec.6 of

the LA Act.

In this connection it is to be stated except in the department like Irrigation, R &

B., where the land acquisition is in mass scale, the Collectors / Spl.Dy.Collectors are
acting as L.A.O. But in respect of all other departments, the Collectors are sending
D.N. and D.D to the Government through CCLA and the Government are approving
such notifications.
In this regard, the extract of Sec.3-A of L.A. Placed below may be seen
Sec.-A :
“ the expression “Local authority” includes a town planning authority ( by
Whatever name called) set up under any law for the time being in force

C. the expression “Collector” means the Collector of a district, and includes a

Deputy Commissioner and any officer specially appointed by the Government to
perform the functions of a Collector under this Act.
STATE Amendment ( Andhra Pradesh) In its application to State of Andhra , after
S.3, insert the following Section namely

3A- Delegation of functions: The State Government may, by notification in the

Andhra Pradesh Gazette, direct that any power conferred or any duty imposed on
them by this Act, shall in such circumstances and under such conditions; if any, as
may be specified in the notification, be exercised or discharged by the District
Collector. ( AP Act.22 of 1976, S.2 (w.e.f) 12.9.1972:
In view of the above, the request of the Collector, SPSR Nellore that for

delegation of power for DN & DD, to acquire the Patta lands measuring Ac.30.62 cents

in Sy.No.5A, 11 & 12 etc., of Nelatur village for Construction of Integrated Township

(Residential Colony) for the employees of Sri Damodaram Sanjeevaiah Themrmal

Power Station.

I am to invite attention to the reference cited wherein the Collector, SPSR

Nellore District has reqeusted for post facto approval orders for the action taken by him
in approval of Draft Notification U/s 4(1) of LA Act and published in daily newspaper for
acquisition of an extent of Ac.30.62 cents for construction of Integrated town ship for the
employees of Sri Damodaram Sanjeevaiah Thermal power station at Nelatur village and
also for delegation of powers for approval and publication of D.D U/s 6(1) of the L.A. Act.

In this connection it is informed that U/s 3-A of the L.A. Act the Government is
competent to delegate the powers to the Collector, SPSR Nellore District to initiate L.A.
proceedings.

Hence the proposal of the Collector, SPSR, Nellore District is sent here with for
issuing necessary orders in the matter.
