1.0 Introduction

This report presents statistics on demographic and socio-economic characteristics of


persons received in correctional institutions, total population, offences and type of
their disposal during the year 2012. These characteristics and offences may influence
policy or programme interventions that might provide solutions to reduce incidences
of crime in the country. Data on persons received is collected by Department of
Correctional Service from all correctional services institutions throughout the country
and forwarded to Bureau of Statistics for compiling, editing, tabulation and analysis.

There are eleven correctional services institutions in the country, one in each district
except in Maseru where there are two institutions namely, Central and Female
Correctional Institutions. While other correctional services institutions in the nine
districts receive both males and females, in Maseru, Central and Female Correctional
services Institutions admit only males and females respectively. There is also a
specialized institution called Juvenile Training Center (JTC) that keeps young
detainees (17 years and below). Its purpose is to rehabilitate these young detainees to
become law abiding, productive and socially accepted citizens of this country.

2.0 Population in Correctional Institutions

This section deals with the number of persons detained in correctional services
institutions by year and sex as shown in Table 2.1. Generally, the total population
was highest in 2008 with 2,609. The same is observed among the males in 2008
where there were 2,529 males admitted in correctional services institutions. The
female population was highest in 2012 with 88 persons. In 2011 the lowest
population of 2,313 persons was recorded as compared to other four years. Generally,
the total population in correctional institutions had declined by 1.4 percent from
2008 to 2011. Similarly, male population had declined by 1.8 percent. On the other
hand, total female population has increased by 10.0 percent for the same period.

Furthermore, the table indicates that Central Correctional Services Institution had
the largest population for the given period, reaching peak in 2012 with 905 detainees.
Although Mohale’s Hoek and Leribe Correctional Services Institutions followed, their
populations had declined by 11.7 and 26.4 percent respectively from 2008 to 2011
and to 2012 respectively. Between 2011 and 2012, total population in Thaba-Tseka
and Quthing Correctional Services Institutions increased by 35.3 and 34.5 percent
respectively whereas in Botha-Bothe Correctional Services Institution it declined by
18.8 percent.

3.0 Persons Received in Correctional Institutions

This section focuses on the percentage distribution of persons received in each


correctional institution as depicted in Figure 3.1. Central Correctional Services
Institution accounted for 30.6 percent of the total population received. Leribe and
Mafeteng Correctional Services Institutions followed with 14.1 and 11.5 percent
respectively.

3.1 Trend in Persons Received by Quarters

Quarterly trend analysis of persons received in correctional services institutions by


year was explored therefore; Table 3.1 shows the number and percentage distribution
of persons received by quarter and years from 2008 to 2012. The highest number of
persons received was observed in 2009 with 4,883 persons while the lowest number
was received in 2012 at 3,897 persons. Generally, the total number of persons
received in correctional services institutions has declined by 18.9 percent from 2008
to 2012. In 2008 and 2011, the largest percentage of persons was received in the
fourth quarter with 27.5 and 26.1 percent whereas in 2010 and 2012 the persons
received constituted 29.0 and 28.0 percent respectively, during the third quarter. The
total number of persons received in correctional services institutions declined by 7.3
percent from 2011 to 2012.

3.2 Persons Received and Offences


This section focuses on the type of offences committed by persons received in
correctional institutions. Number and percentage distribution of persons received by
type of offence in 2012 is shown in Table 3.2. The table indicates that the most
common offence was Murder with 27.2 percent. It was followed by Sexual Offence and
House Breaking with 16.6 and 8.8 percent respectively. Assault GBH was the fourth
highest type of offence with 7.4 percent.

Besides Other Offences which is the combination of all other offences which were not
included in the list, the types of offence that are not common are as follows: Arson,
Motor Vehicle Theft, Fraud, Abduction and Concealment of Childbirth with the
percentages less than one.

3.3 Persons Received, Place of Residence and Type of Offence

This section focuses on persons received, place of residence and the type of offence.
Offences are categorized into three broad types which are: Offence Against Person,
Offence Against Property and Other Offences. Offence Against Person category
includes offences such as Assault (Common and GBH), Threats, Poisoning, Suicide,
Murder, Attempted Murder, Culpable Homicide, Infanticide, Concealment of
Childbirth, Abortion, Abduction, Unlawful Detention, Sexual Offence, Indecency in
Children, Bestiality, Prostitution and Public Indecency. Offence Against Property
category includes among others Common Theft, Motor Vehicle Theft, Stock Theft,
Robbery, Armed Robbery, House Breaking, Criminal Trespass, Receiving Stolen
Property, Fraud, Extortion, Forgery, False Statement, Damage to Property and Arson.
The category of Other Offences comprises of all other offences which are not classified
in the aforementioned categories.

The percentage distribution of persons received in correctional services institutions


by place of residence and type of offence is presented in Table 3.3. A large percentage
of persons received (59.7 percent) were reported to have committed Offence Against
Person, followed by Offence Against Property and Other Offences with 30.1 and 10.2
percent respectively. Moreover, the table indicates that Offence Against Person
constituted the highest percentages in all the districts, as they range from 52.0 in
Mokhotlong to 68.7 percent in Qacha’s Nek. The second highest percentages were for
Offence Against Property. The majority of persons received in correctional services
institutions from outside the country, were imprisoned because of Offence Against
Property at 52.6 percent. This percentage was followed by the one for Other Offences
which constituted 31.6 percent.

3.4 Persons Received, Type of Offence and Educational Attainment

This section discusses persons received in correctional services institutions, their


educational attainment and type of offence. As a result, the percentage distribution of
persons received by type of offence and educational attainment is portrayed in Figure
3.2. Generally, the figure demonstrates that Offence Against Person was the most
common type irrespective of the level of education. In addition, the results show that
persons with No Education and Primary education had highest proportions under
this category with 67.1 and 63.2 percent respectively. Moreover, for all levels, Offence
Against Property followed with proportions ranging from 26.0 (No Education) to 34.7
(High School). On the other hand, the percentages for Other Offences were the least,
for instance persons with Tertiary Education constituted 25.0 percent while persons
with No Education had 6.9 percent.

3.5 Persons Received and Number of Previous Convictions

Information on number of times persons received have been convicted before was
recorded, therefore, Figure 3.3 depicts percentage distribution of persons received by
number of convictions prior to the year 2012. There are four categories in this regard
which are: Nil (never been convicted), Once (convicted once), Twice (convicted twice)
and More than Twice (convicted three times or more). Majority of persons (88.5
percent) received have never been convicted before the year 2012, while less than one
percent of persons received have been convicted more than twice.

3.6 Persons Received and Case Status

The status of the cases for the persons received in correctional services institutions
are as follows: discharged, remanded or sentenced. Persons discharged consist of
those who are acquitted or those whose cases have been withdrawn. Remanded
persons are those released on own recognizance, who had paid bail and those in
detention awaiting their trials. Sentenced persons can either serve their sentence in
correctional services institutions, pay fine or their sentence be suspended.

Table 3.4 presents the percentage distribution of persons received by status of the
case in 2012. The table indicates that majority of persons received were remanded
constituting 66.6 percent while 32.8 percent were sentenced and those who were
discharged constituted only 0.6 percent. The table further shows that 38.7 percent of
persons received had paid bail, whereas, 24.5 percent was awaiting their trials whilst
they are in detention. The table also illustrates that 28.5 percent of received persons
were serving their sentences in correctional institutions.

Analysis on the proportion of persons received who were discharged, remanded or


sentenced in each correctional services institution was done. Table 3.5 highlights the
percentage distribution of persons received by correctional services institution and
case status in 2012. In general, the table shows that majority of persons received in
correctional services institutions in the country were remanded (66.6 percent) and
32.8 percent were sentenced. In Botha-Bothe, the largest proportion of 80.9 percent
was on Remand. In addition, a large proportion of persons received in JTC and
Female Correctional Services Institution were sentenced with 51.6 and 58.7 percent

respectively. No persons were discharged in JTC, Botha-Bothe, Female and
Mokhotlong Correctional Services Institutions in 2012.

Persons in correctional services institutions who were discharged, remanded and


sentenced were further analyzed according to the type of offence. Therefore, Table 3.6
displays the percentage distribution of persons received by type of offence and case
status in 2012. Majority of persons received who were reported to have committed
Murder and Attempted Murder were on remand with 94.1 and 88.2 percent
respectively. A large proportion of persons who were reported to have committed
Internal Security and Concealment of Childbirth were sentenced with 81.0 and 81.8
percent respectively. The offences with zeros under “Discharged” mean that no person
was discharged for committing such offence.

4.0 Demographic and Socio-economic Characteristics of Persons
Received

This section presents the demographic and socio-economic characteristics of persons


received in correctional services institutions. These entail the variables such as sex,
age, place of residence, educational attainment and marital status.

4.1 Sex of Persons Received


This section focuses on sex distribution of the persons received in correctional
services institutions therefore; Table 4.1 presents the percentage distribution of
persons received in correctional services institutions and sex in 2012.The table shows
that the majority of persons received in correctional services institutions were males
(94.5 percent) while females accounted for only 5.5 percent. Except for Central and
Female Correctional Services Institutions which receive only males and females
respectively. The table further shows that in all correctional services institutions
which receive both sexes, there were high proportions (more than 90 percent) of
males. However, for the year 2012, in JTC and Mohale’s Hoek Correctional Services
Institutions there were no females received. Berea Correctional Services Institution
received 7.5 percent of females while proportions of females in other correctional
services institutions range from 0.8 to 6.0 percent.

4.2 Age of Persons Received

Classification of Persons received by correctional services institution and age group


was explored and it is presented in Table 4.2. Generally, more than half (51.5
percent) of persons received in correctional services institutions were in the age group

21 to 30 years. The similar pattern was observed in each correctional services
institution, apart from Female, Quthing, Mokhotlong and Thaba-Tseka Correctional
Institutions with less than 50.0 percent of persons received in this age group.
Majority of persons (67.7 percent) received in JTC were in the age group 15 to 20
years. The least proportion (0.4 percent) of persons received was less than 15 years
old and they were received in JTC, Female and Mafeteng Correctional Services
Institutions with 32.3, 2.2 and 0.2 percent respectively.

4.3 Place of Residence of Persons Received

Distribution of persons received in correctional services institutions and place of


residence was also explored as depicted in Figure 4.1. Persons received are either
from Lesotho or from abroad. Those who reside within the country are classified by
districts while those from abroad are grouped under the category Outside Lesotho.

According to Figure 4.1, approximately one quarter (25.3 percent) of persons received
in 2012 resided in Maseru. This was followed by Leribe and Mafeteng with 15.0 and
12.8 percent respectively. The least percentage (1.5 percent) of persons received was
residing Outside Lesotho.

4.4 Educational Attainment of Persons Received

Education reduces chances of incarceration. Information on highest level of education


attained is important in determining the relationship between the level of education
and the type of offence committed. Table 4.3 illustrates percentage distribution of
persons received by correctional services institution and educational attainment in
2012. Five categories of educational attainment were adopted and they are as follows:
No Education, Primary (Standard 1-7), Secondary (Form 1-3), High School (Form 4-5)
and Tertiary.

Notably, more than half (51.4 percent) of persons received reported to have attained
primary education, followed by persons with Secondary and No Education with 19.2
and 16.1 percent respectively. Among the correctional services institutions, Central
Correctional Services Institution received a large proportion (17.5 percent) of persons
with High School Education while Female Correctional Institution also received the
13.0 percent of persons with Tertiary Education.

4.5 Offence and Marital Status of Persons Received

This section focuses on the persons received in correctional services institutions, type
of offence and marital status as highlighted in Table 4.4. Marital status was
categorized only into two options: Single and Married categories. The table shows that
58.4 percent of persons received were single. The most common types of offences
among the single persons were Murder, Sexual Offence and House Breaking with
24.9, 19.7 and 11.3 percent respectively. The similar pattern was observed with
married persons however, the third most common type of offence was Assault GBH
with 6.5 percent.

5.0 Summary

Total population in correctional services institutions had been decreasing from 2008
to 2012. Total number of persons received had declined from 2008 to 2012. Among
the correctional services institutions, Central Correctional Institution received the
largest proportion of persons. The most common types of offence among the persons
received in correctional services were Murder, Sexual Offence and House Breaking.
More than half of persons received were reported to have committed Offence Against
Person irrespective of level of education. Majority of persons received reported to have
never been convicted before.

Two thirds of persons received were remanded. Majority of persons received were
discharged by bail. Majority of persons who were reported to have committed murder
and attempted murder were remanded. A large proportion of persons received were
males. Majority of persons received were in the age group 21 – 30 years. Majority of
persons received were residing in Maseru. More than half of persons received reported
to have attained primary education. The most common types of offence among the
single persons received were: Murder, Sexual Offence and House Breaking while
married persons Murder, Sexual offence and Assault GBH were more common.
