Deed of Separation and Divorce

This deed is entered into as of ________, 20__, in ___________, India, between Sh.____,
S/o_____, R/o ______________ (the "First Party') including his successors, executors and
administrators; and Smt.____, W/o_____, R/o_________ (the "Second Party"). Each,
separately, a "Party" and collectively "Parties"

WHEREAS, the Parties are husband and wife and living as such since their marriage.

WHEREAS, due to material differences between the Parties they consented to separate from
each other and to enter into the agreement contained hereinafter.

WHEREAS, the Parties have mutual children as follows: 1. ___________, 2. ____________,


and 3. __________ (the "Children").

Now therefore the Parties mutually agree as follows:

1. The Second Party may live separately from the First Party in all relations not restrained
from command/influence of First Party and without his dominance.

2. The Second Party shall have sole custody of the Children during their minority. The First
Party may visit the Children at all convenient and reasonable times.

3. The First Party shall pay the Second Party an allowance of Rs.____ for a period of
_______ years. The above amount will be reduced by Rs. ______ each time one of the
Children becomes _______ years old or (god forbid) dies or begins to earn his own
livelihood. The allowance will br paid on the ___ day of each calendar month.

4. The First Party will not pay any allowance should the Second Party materially breach this
agreement, get married, or live under the same roof with another man.

5. The Second Party shall sustain and educate the children out of the allowance and shall
keep the First Party harmless from and against all claims and demands concerning the
sustenance or education of the children.

6. Neither Party shall disturb the other nor intervene or file a claim for restitution of
matrimonial rights against the other.

7. The Second Party is entitled to remove her personal possessions, including clothing and
jewelry, from the First Party's house.

8. After the date of this agreement, the Second Party shall pay and discharge all debts and
liabilities incurred by her. The Second Party undertakes to keep the First Party harmless of
any claim or demand and compensate him in the event he will be required to pay any debt
or liability.

9. This deed shall be cancelled per death of either Party.
