SUBJECT : TOTAL BAN ON SMOKING POLICY

DATE : May 3, 2021

The Division of Human Resources wish to inform all Ark Group of Companies Employee that the Total Ban
on Smoking will now include all tobacco and non-tobacco cigarette products, as well as the use of
electronic nicotine and non-nicotine delivery systems or what we commonly call e-cigarettes, vapes, vape
pens, and among others. The total ban shall be strictly enforced in all buildings, Facilities and parked
vehicles within Akrcons and Electrical Serivces, Inc’s property, including its sister company vehicle units.

We reiterate that the Total Ban on Smoking covers visitors and employees alike. Appropriate disciplinary
action, in accordance with existing guidelines and due process as stipulated in the Employee Code of
Conduct, will be meted out to violators of this policy. All visitors, suppliers, contractors, and couriers inside
the Arkcons compound are likewise expected to abide by this rule.

Everyone is encouraged to inform their fellow employee and visitors of this expanded coverage of the
total ban on smoking.

Aims of the Policy

The policy seeks to:

Guarantee a healthy working environment and protect the current and future health of all employees,
staff and visitors.

Comply with the provisions of R.A. 9211 which prohibits smoking in public places including
establishments and offices.

Definition

The No Smoking Policy covers all types of burnt and smoked products including cigarettes, tobacco and
non-tobacco E-cigarette products.

Disciplinary Action

Employees who disregard the policy may be subject to disciplinary action in accordance with the
Company’s Policy.

1st Offense – Two (2) Working-day Suspension

2nd Offense- Five (5) Working-day Suspension
3rd Offense- Fifteen (15) Working-day Suspension

Visitors who disregard this policy will be fined. Repeated violations may cause the erring visitor to be
banned from the office premises.

Implementation

This policy shall be effective May 1, 2021.

Monitoring and Review

Compliance with the no smoking policy will be monitored by the Department Supervisors through the
Company Safety Officers and Security Personnel. It will be reviewed every year at the discretion of the
Human Resource Division.
