Reservation for Anglo Indians

In News:

The government recently introduced a bill which will do away with the requirement of nominating Anglo-Indians to the
Lok Sabha and state Assemblies from now on.
The bill seeks to amend the Constitution with the intention to not to extend the provision that is in place for the past 70
years.

Constitutional Provision:

Article 334 provides for reserving the seats for SCs and STs and nomination of Anglo-Indians to Lok Sabha and state
Assemblies, which shall cease to be in effect on the 25 January 2020, if not extended further.

104th Constitutional Amendment Act:

Enforced on 25 January 2020 and amended Article 334 to extend the reservation of seats for SCs and STs in the Lok
Sabha and states assemblies from Seventy years to Eighty years. Removed the reserved seats for the Anglo-Indian
community in the Lok Sabha and state assemblies.

Anglo Indians in India:

Article 366(2) of the Indian constitution defines the term Anglo Indian as “a person whose father or any of whose
other male progenitors in the male line is or was of European descent but who is a native of India.”
Article 331: Under this provision the President of India is authorised to nominate 2 members of the Anglo-Indian
community if no member of this community is elected among the 543 members for the Lok Sabha.
In the same way the governor of the state is authorised to nominate 1 Anglo Indian in the lower house of the State
Legislature (when under represented).
Anglo-Indian community is the only community in India that had its own representatives nominated to the Lok Sabha
(lower house) in the Parliament of India.
10th schedule of the Constitution: Any Anglo-Indian member can take the membership of any party within 6
months of the nomination.
