AGREEMENT TO DEMOLISH/REMOVE AND RECONSTRUCT

IMPROVEMENT (ADRI)

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT, made and executed by and between:

The Republic of the Philippines, represented by DANILO U. TABILAS, District


Engineer, DPWH- Cagayan Third District Engineering Office, Tuguegarao City,
Cagayan, duly authorized by the Secretary of the Department of Public Works
and Highways, hereinafter called the FIRST PARTY

-and-

AGUSTIN J. CASTICIMO, of legal age, married and a resident of Poblacion


Amulung, Cagayan, hereinafter called the SECOND PARTY;
WITNESSES:

WITNESSETH:

WHEREAS, the FIRST PARTY will be implementing the Construction of By-


pass and Diversion Roads-Construction of Gravel Road-Amulung By-pass Road,
Cagayan, which will partially affect the description of the improvements of the
SECOND PARTY;

WHEREAS, the SECOND PARTY is the true, lawful, and absolute owner in
fee simple of the herein described improvements as evidenced by Tax Declaration
No. _______________, Affidavit of Ownership and Barangay Certification, photocopies
of which are hereto attached as Annexes “1”, “2” and “3”, respectively;

WHEREAS, the estimated cost of the improvements that will be affected by

WHEREAS, the SECOND PARTY hereby consents and binds himself to


demolish and remove the above-listed improvements within the road right-of-

way/construction limits of the above-mentioned project;

WHEREAS, the SECOND PARTY agrees that the basis for the determination
of just compensation for the crops acquired shall be governed by the provisions of
Republic Act 10752 and its implementing rules and regulations;

Whereas the First Party shall pay the replacement cost/current market
values of the above-listed improvements amounting to TWELVE THOUSAND, NINE
HUNDRED TWENTY-FIVE PESOS (Php 12,925.00) to the Second Party in
accordance with the following schedule:

1. First payment to be made upon execution of this Agreement equivalent to

seventy percent (70%) of the said Total Amount as herein provided.


2. Second and Full payment to be made after all paid improvements have
been totally demolished and removed within the road right-of-
way/construction limits of the above-mentioned project equivalent to
thirty (30%) of the Total Amount herein provided.

NOW THEREFORE, for and in consideration of foregoing premises, the Parties
hereby agree on the following:
1. That the SECOND PARTY shall completely demolish and remove said
improvements listed above within _____ days from receipt of the first
payment mentioned above.
2. If the Second Party chooses to retain the salvaged materials of the
improvements, no salvage value shall be deducted from the final
payment.
3. Failure of the SECOND PARTY to demolish and removed the above-
mentioned improvements within fifteen (15) days from the date of Final
Demand to Demolish shall cause the FIRST PARTY to demolish and
remove the above-mentioned improvements at the expense of the
SECOND PARTY.

ACKNOWLEDGMENT
BEFORE ME, a Notary Public for and in the Province of Cagayan, personally
appeared District Engineer DANILO U. TABILAS with PRC License No. 0025862 and
AGUSTIN J. CASTICIMO with Tax Identification No. 450-713-849 issued by the
Bureau of Internal Revenue, known to me and to me known to be the same persons
who executed the foregoing Agreement for Demolition and Removals of Improvement
and acknowledged to me that the same is their free and voluntary act and deed.

This Agreement consist of three (3) pages, including this page on which this
acknowledgement is written, duly signed by the FIRST PARTY duly authorized
representative and the SECOND PARTY and their witnesses on the spaces provided for
their signatures on each and every page thereof.
