Property Tax by Panvel Municipal Corporation

Dear Property Owners of Kharghar Node,

1. The Kharghar Housing Federation has studied the Property Tax notices and bills
raised by Panvel Corporation, with the assistance from lawyers, tax experts and
retired Govt officers.

2. In the opinion of Expert team, the procedure followed by Corporation for

assessment of property is not as per Municipal Corporation laws. There is no
provision in Municipal act to charge retrospective tax.

3. In view of the above the matter can be legally challenged in the High Court. In the
meantime, we are also requesting all concerned authorities and elected
representatives to reconsider the proposal to levy tax and render justice.

4. The Federation has interacted with most of the Chairmen/Secretaries of Kharghar

societies, through zoom meeting and physical meetings to discuss Property Tax
notices and Bills.

5. It was proposed by all Chairmen/Secretaries to challenge the Property Tax notices

in the court and approved that the Kharghar Housing Federation to represent the
Societies and Property owners to file court case and to take other steps to protect
their interest.

6. As per Govt gazette CIDCO is the Planning & Development Authority for Kharghar
Node.

7. All services except Garbage collection since past one year, are being provided by
CIDCO.
8. As on date Kharghar node societies are paying Service Charges to CIDCO for the
services being provided to Kharghar node.

9. CIDCO has not yet developed Kharghar node as per it's Development Plan (DP)

10. People of Kharghar want the Node to be developed as per DP then transferred to
Panvel Corporation and Property Tax by Panvel Corporation to be levied
thereafter.

11. Discount offer is an incentive to induce the Society and property owners to pay
which will dilute the court case. You may not get tax refund if court directs
Corporation to follow Rules properly for Procedure for assessment, not to levy
Double Taxation & not to take taxes Retrospectively.

12. We are of the view that our case is strong on merits as No services have been
provided by Panvel Corporation for last 5 years. We have already paid to CIDCO
for the services till date. There is no provision for Retrospective tax. The
Procedures followed for Tax assessment are not at all as per law.

13. In view of above we on behalf of Kharghar societies appeal to you all Not to Pay
Property Tax till we get court decision on this.

14. The last date to pay property tax without penalties is 31st March 2022 as
promulgated by Corporation.
