Against this order the Patwari filed a civil writ petition No.
15204 of 2020 in the Hon’b1e Punjab and Haryana High
Court. This writ has been stayed in the Hon’b1e court till 28-
1-2021. Following the orders of the Court the aforesaid
transfer orders of Mr. Bakshish Singh Patwari. Dated 11-9-
2020 are canceled.

Petitioner-Bakshish Singh, stated to be aged 54 years, has


filed the present petition inter alia with a prayer for issuance of a writ
in the nature of certiorari quashing the impugned order dated
11.09.2020 (Annexure P-2), passed by respondent No. 3 whereby, the
petitioner has been transferred from Khojewal to Tugalwal in the
Revenue Estate of Batala, District Gurdaspur.
Learned counsel submits that a perusal of circular dated
12.09.2020, would show that by making reference to the earlier letter
dated 12.09.2020, would show that by making reference to earlier
letter dated 17.7.2020, it was mentioned that after 31.08.2020, no
transfers to be ordered due to COVID situation. Learned counsel
submits that the violation of the above guidelines, impugned order
(Annexure P-2) has been passed.
Notice of motion be issued for 28.01.2021.
Till the next date of hearing, transfer order of the petitioner
shall remain stayed.

Reply by the way of short affidavit of, Mohammad Ishfaq,IAS Deputy


declare as under:-

1. fhat the above said writ petition is pending in

this Hon’ ble Court and fixed for today.

2. That fact of the case is that the petitioner has been

working as Patwari at Village Khojewal which falls in

the revenue estate of Batala since 2019. During the


posting, the petitioner was transferred vide Order

No. 70/77 dated 11/9/2020 from Khojewal to

Tugalwal Tehsil and Distt. Gurdaspur on

administration grounds. Thereafter the said transfer

order dated 11.09.2020 has been cancelled by the

answering respondent vide office Memo No.

3237-/SK-44 dated 25/1/2021. frue translation of the

cancellation of transfer order is attached as

Annexure R-1. It is respectfully submitted that the

said transfer order had now been cancelled.

3. That in light of the aforesaid fact, no cause of action

remained arisen in the present petition to the

petitioner. It is therefore prayed that the present writ

petition may kindly be dismissed as being in

fructuous.
