AFFIDAVIT FOR PROBABLE CAUSE spe FUL 345 THE STATE OF TEXAS COUNTY OF MIDLAND ‘The undersigned affiant, being a peace officer under the laws of Texas, and being duly sworn, on oath, makes the following statement and accusation: 1. Suspeeted Party: Nikolas Ty Moreno H/F DOB: 07-27-2003 Claremont Dr. Midland, Texas 2. Wis the belief of affiant, and he hereby charges and accuses, that said suspected party has committed the following offense: Murder; 1* Degree Felony; PC 16.06; occurred in the City of Midland in Midland County 3. Affianthas probable cause for said belief by reason of the following facts, towi ‘The affiant Rosie Rodriguez isa detective with City of Midland Police Department and is currently assigned to the Investigation Service Bureau, Afiant had been employed with the Midland Police Department for 24 years. (On July 31,2021, at around 1:21AM, I, Detective R. Rodriguez, was the on-call detective. Midland Communication requested for me to respond to Hollandale and Parkway. 1 was advised Sgt. J. ‘Owens requested I respond. 1 called and spoke with Sgt Owens and he advised that a homicide hed occurred. sponded to Hollandale and Parkway. I mel up with Sgt. Owens and Officer Covarrubio. | was advised a and Nikolas Moreno were being detained and possibly involved with the homicide. had called 911 to report his friend being shot. While officers spoke to las artived and showed MPD Officers where the person shot was located, MPD Officers ‘were laken to the area of Hollandale and Parkway. observed s white GMC pickup truck ‘The driver's side door was open. ‘On the passenger side, there was a young Hispanic male lying on his back. Officer Wilbanks stated he had tured him over 10 check for a pulse and discovered he was deceased. ‘The deceased male was later identified as appeared: 2 was shot om his side and three times in his tower back. Nikolas said \was tripping out on the acid while he was driving. Nickolas stated he turned onto Parkway from Lamesa Road. Nikolas said he stopped the vehicle and got out to urinate, While urinating, ‘was tipping and he got into the driver's seat and drove off. Nikolas advised was stealing his truck. Nikolas said he was hanging onto the driver's side dooras._sped towards Hollandale Nikolas stated he was holding onto the driver's side door and with his right hand he would get the steering wheel, punch and at one point he and were wrestling over a gun, Nikolas said pulled a gun. Nikolas stated they drove off into a ditch and wrecked. Nikolas claimed he had s gun on him and it fell onto the driver's floorboard. Nikolas stated he reached and grabbed his gun along with ‘gun, Nikolas said his gun went off one time and the ‘gun went off 2 to 3 times, stated he did not know where he shot. Nikolas claimed was in the driver's seat and he thought ‘would get the gun and kill him, Nikolas steted he left the scene with both guns and took it to his aunt's house. He agreed to talk to me about the incident. stated his brother went oa house on the west sidetobuy weed. saidhesaw post on Snap Chat doing acid. stated he went inside the house. _ said Nikolas, and he left the residence. "stated ‘was driving his truck was seating in the middle, and he was in the passenger seal. commented they were going to Al's Grocery Store. advised Nikolas stopped at Parkway. said they were all going to urinate stated was tripping on acid and talking about seeing demons. said they were all out of the truck when got in the river's seat and drove off. __ stated he got in the passenger seat and Nikolas was hanging from the driver's door. said he was scared so he shot Nikolas stated he reached between and the steering wheel in attempt to assist Nikolas to get in the driver's seat. said pulled out a gun and he took the gun away from ‘and shot him on the side and then shot three more times, informed that chad been shot three times in hisback. ! said’ was rying to get out of the vehicle through passenger door and he finished him off by shooting. stated he did not know where he had sho! said he shot because he was scared for his brother's life. He thought would kill them with his driving. "stated he took gun and did not know that Nikolas had a gun.
