Q1.
A.
The media both highlight the problems among the country, and
craft appropriate recommendations to combat these problems,
serving as a source of help for the judiciary, executive, and
legislature. Social media refers to the means that of interactions
among folks in which they produce, share, and/or exchange
information and ideas in virtual communities and networks. The
office of Communications and promoting manages the most
Facebook, Twitter, Instagram, Linked In, and YouTube accounts.
Communication and interaction are the constitutive components of
lifestyle. The same case in social media as a result of social media is
a sub-branch of media and an important tool of communication and
interaction. However, the social dilemma is clear: Social media
platforms are often used for evil as well as good.
In my opinion, Governments should inevitably get more
engaged in oversight. However, we believe that platforms ought to
become a lot of aggressive at self-regulation now. As a result of as
we all know and observing that the thought of self-control has
flopped at all, we've got so many reported cases of cyberbullying.
According to cybercrime authorities. The internet has conjointly
allowed people to cover behind masks of obscurity. This “faceless
evil” of the internet could be a growing threat for teens, specifically,
once it comes to cyberbullying. Social media may enjoy protections
below the rules of government independent of their users’ right to
free speech.
Government should regulate the social network so that the people
stay safe and nobody misuses the network for harassment. If the
social network will be run by the govt. it'll be run in a better way
and in a safe way.
The following duties should be enforced by the social network in
terms of their use:
Online Contests & Promotions: check out the Terms of
Service (TOS) or alternative similar tips posted by the platform
that you are using. These are the principles to follow.
Facebook has some very specific guidance.
Photographs: Social media and also the law often collide when
it involves pictures that are being shared online. Try to realize
the source and seek permission before you use it.
B.
Yes, social networks have created new crimes. In today's situation,
we hear new crimes every day due to social networks. The reason
for this type of crime is the use of social networks. As the
population grows, so does society. All children now use social
media. Due to the increased or, we can say, excessive use of social
networks, the younger generation is abusing social networks. The
abuse of social networks occurs in new crimes or new locations of
old crimes.
Social networks are accused of representing a risk for many users,
especially for young people. Social media has become accustomed
to promote "new" crimes, such as revenge pornography, prompting
to be called for harsher punishments. Additionally, criminals' ability
to use social media platforms to track potential victims (and their
property) has been highlighted in recent robberies. In addition, "old"
crimes such as stalking and threats, as well as fraud and identity
theft were carried out in new ways through social media. Social
media is also changing the nature of behavior after a crime. The so-
called performance crime - criminals who brag about crimes online
to their friends and followers - is becoming more and more
common. Lastly, "undercover detectives" eager to identify suspects
often voice their opinions on social media. This is the greatest
distraction for law enforcement officers in and in the worst case,
innocent people are wrongly accused. For those who work in the
criminal justice system, trials on social media have become
increasingly worrisome. Activities on Facebook and Twitter can
threaten the right to prosecution and a fair trial by sharing photos
of the defendant before indictment, creating hate groups, or sharing
your opinions online with jurors. Social media can also be used as a
tool to blame victims. occurred after the Kardashian robbery. In the
immediate aftermath of the incident, some Facebook and Twitter
users thought that got "what he deserves" and "maybe he'll cover
his now". Social media can be used more as a weapon, and friends
and family of crime victims will suffer secondary injuries.
Q2.
i.
It seems reasonable to think that the judge will contact the lawyer
and vice versa. After all, judges are also human beings. They are
classmates of law school lawyers, used to be practicing lawyers, and
associate with lawyers.
Why should social media platforms be so different from real life?
Before the advent of social media, lawyers and judges were friends
and interacted on social occasions. The fact that judges and lawyers
are connected on social media does not mean that their relationship
is more than a casual relationship. On the other hand, the fact that
judges and lawyers are not in contact on social media does not
mean that they are not close personal friends.
Laws on social media are evolving rapidly and jurisdictions have
reached different conclusions, some of which are out of date. You
should always check the current legal status in your jurisdiction,
but the following is an overview of the law regarding "make friends"
judges on social media.
Legal Standing;
The Florida Supreme Court recently answered the question in the
negative in Law Offices of Herssein & Herssein, P.A. v. United
Servs. Auto. Ass’n, Case No. SC17-1848, 2018 Fla. LEXIS 2209
(Fla. Nov. 15, 2018), when it held that “an allegation that a trial
judge is a Facebook ‘friend’ with an attorney appearing before the
judge, standing alone, is not a legally sufficient basis for
disqualification.” The decision brings Florida in line with the
majority view in other states that “have adopted an attitude of, ‘it’s
fine for judges to be on social media, but proceed with
caution.’”However, the opinion’s implications are multifaceted for
Florida judges and the lawyers who appear before them.
My personal opinion;
One of the most important things about humans is that they are
social animals that expect to connect with other people. This means
that even judges are human and need to have enough contacts in
society, regardless of whether the people they meet on social media
are their superiors or subordinates. This is where a line must be
drawn between social life and personal life. People can distinguish
between their duties and friendships. A person's responsibilities
should not prevent a person from enjoying their privileges, and
things are decided based on evidence rather than personal
relationships in court.
ii.
Judges are human and are allowed to have friends.
