I Hemant of mechanical section of GVP college of engineering autonomous is here on the occasion of
the "world consumer's day" to excite you with today's theme that is "the consumers protection laws,
facts and factors"
Well, I know the topic seems a little boring but trust me these words can be your tomorrow's savior and
is one of the modes to strengthen the society and its people.
But before I began, I would like you all to give a thought for a second, who is a consumer?
It is we, the only citizens of this country who's buying/purchasing from the smallest of the chocolate to
the most expensive car.
It is the people of this nation who are contributing for the countries' only development via maintaining
the global financial margin, it is the key to show the other countries and nations our only mode of unity
and power.
Hence whenever we purchase something we are also contributing to our county's growth too, but we
people are fooled by our own sellers thereby these laws or in other words are some protocols that
comprises of a wide spectrum of
legislations with specific dimensions and parameters, from the Constitution to the general and specific
consumer-centric laws. The enactments, in addition to the Constitutional provisions stated above,
dealing with consumer protection include: The Prevention of Food Adulteration Act, 1954; Essential
Commodities Act, 1955; Prevention of Black-marketing Act and many more etc. but firstly let's discuss
about the constitutional mandate and at there I will also share the following articles that a consumer
must know in a way to survive in this accursed society.
Well firstly the Constitution of India does not contain any explicit provision on the
subject of the consumers, but there are many provisions that have direct
bearing on the consumer interests, most of these though pertain to the
Directive Principles of State Policy. As a part of fundamental freedoms, thereby our first most article that
we must learn is the article 19, which briefs that Constitution guarantees under sub-clause (g) of article
19(1) that mostly talks about is “the freedom of profession, trade or business”, thereby ensuring that
the State cannot prevent a citizen from carrying on a business, except by a law imposing a reasonable
restriction in the interest of the general public. However, under article 19(2),
no such right can be enforced where the business is dangerous or immoral. Hence in order to impose
restrictions on the manufacture, import, sale or
distribution of any product on the ground of public health, every business product should
be placed on its scientific testing by experts.
Hence these are the following laws that every consumer of this nation must know is:
The first one is The Right to Be Informed:
As a consumer, you have every right to always receive an accurate information. Consumers can make
wise decisions only if they have the information they need. Businesses are required to provide certain
details about their products. For example, drug companies must list the complete contents of every
medicine. Clothing manufacturers must list the fibers used in materials. Packaged foods must show all
ingredients, with the main one listed first. Companies provide this information through product labeling.
The next one is The Right to Choose
Because the India has a market economy, its consumers can choose from a wide variety of goods and
services. Businesses compete with each other to sell their products to consumers. They offer new
products, lower prices, higher quality, or improved services to get you to choose their products.
Competition provides choices. A lack of it hurts us as a consumer.
Then comes The Right to Safety
As a purchaser You have every right to use a product that is safe and harmless. Product liability is the
legal responsibility that manufacturers have to consider while designing a safe product. For example,
tools and appliances must include safety devices for your protection. Federal laws ensure that clothing,
food, toys, and other items will not harm consumers. The Indian consumer Product Safety Commission
enforces product-safety standards

with this let's talk about the most important factors for a consumer to always remember when he/she
purchases a product, the first one is the consumer's warranty:
Whenever you buy merchandise, it comes with a warranty. This is a guarantee that it will serve the
purpose it was purchased for—in other words; it will function.
Well to my fact most of the people might not know simply but there are two basic types of warranty
“express and implied”. An express warranty is a promise from the seller, either written, oral, or
expressed in an ad, promising that the item will perform its function for a specified period. Whether the
item purchased is new or used, an express warranty is a guarantee that the item will work. However, not
all items come with an express warranty.
The law automatically provides the second type of warranty, the implied warranty. Implied warranties
are a part of all retail sales of new and used consumer goods. The retailer of an item implies that the
item will work properly and be of average grade and quality, as long as it is used for the purpose it was
sold.
The second most important factor that a consumer must and should follow is Keeping an Eye on Scams.

Closely review every item on your monthly bills. If there is a transaction you don't recognize, question
the creditor in writing. If you think a charge is fraudulent, also notify your card company “in writing “no
later than 60 days after the charge appears. Customers should use a separate email account for their
online shopping. This method helps avoid spam. Also, never respond to emails asking you to "confirm"
recent transactions after you shop because they can be phishing scams.
The other factor is the Dealing with Warranty Breach
Yes, you heard that right. If a warranty is breached, get the item replaced or repaired by the seller. If
that doesn't work, try resolving the dispute through mediation. If that fails, you have the right to sue the
manufacturer or seller.
Service contracts cannot be canceled after you've signed them, but according to the FTC that is the
Federal Trade Commission, there is a cooling-off period in which, under certain circumstances, you
might be able to void a contract. Contact the Federal Trade Commission at FTC.gov for information on
the right way to approach your particular situation right away.

To file a complaint about a seller or manufacturer, you can contact the Federal Trade Commission,
Consumer Product Safety Commission, or call up your local prosecutor and ask for the consumer fraud
division. If you were defrauded by a telephone solicitor or fell into a TV advertisers trap, the Federal
Communications Commission is the place to turn for help.
with this i conclude today's topic by awakening people's mindset towards every consumer out there
should that they must not be feared for the faulty acclaims that they might be getting but should rather
always research for an optimal solution and thereby must look on the right side of any problematic
situation.
