ONLINE, BUT IT TURNS OUT TO BE DEFECTIVE.


MEANING OF
CONSUMER
A consumer is the final user of a purchased
product or service.

Consumers can be either an individual or


group of people who purchase or use goods
and services solely for personal use, and not
for manufacturing or resale. They are the
end-users in the sales distribution chain.
CONSUMERS PROTECTION ACT,
1986
The Consumer Protection Act, 1986 was
enacted to protect the interests of the
consumers.

These Redressal agencies have the jurisdiction


to adjudicate the complaints received from
consumers against any defect in the goods
purchased or deficiencies in the services availed
or any other trade practice.

To make provision for the establishment of


consumer councils and their authorities disputes
and for matter connected therewith
The agenda of a consumer forum is to
provide relief to both parties and
discourage long litigation.

In a process called ‘Informal


Adjudication', forum officials mediate
between the two parties and urge
compromise.

The Act applies to all goods and services


unless specifically exempted by the
union Government and covers all sectors
whether private, public or cooperative

WHY THE DISPUTES AFTER ALL?

Our case is that; suppose we are a


consumer, we bought a laptop of
HP from a big branded
E-commerce company i.e.;
Shopzone, instead of getting HP
laptop we got a local laptop with
only the logo of HP where it's
features and software are local.
Like we see and understand the 6 rights above, consumer has full right to return the laptop, but the
problem is that the company is not ready to accept that there is something wrong with the laptop. In
case of E-commerce, goods are sold on the basis of their description, while in case of physical market
buyers can try the product before they buy it. Sales of Goods Act, 1930, provide buyer with ample
opportunity to check the product before taking delivery, if buyers are not given sufficient chance to
examine the goods, buyer always has rights to reject the goods

WHAT CAN BE DONE AS A
SOLUTION

1.As after discovering one can lodge a


complaint in the Shopzone website /
through its email ID.

They will respond to it and will look after


the problem
2.If no proper outcome occurs or If no
response given.

Can lodge a complaint against the seller for


unfair trade practices under section 2 of
Consumer Protection Act.

Then the matter can be handed to the


consumer court and they would have to
appear in person to justify their position.

The consumer can ask for full refund or


more as compensation depending upon the
situation and matter of concern.

Finally of the seller is found guilty will have


to pay the compensation.
CONCLUSION
It has been concluded that security consumer exist whether customer are online or offline.
Product quality means to incorporate features that have a capacity to meet consumer needs
(wants) and gives customer satisfaction by improving products (goods) and making them free
from any deficiencies or defects.
Consumers are allowed to protect products and services that are hazardous to their lives and
property from marketing cost fixes.
The right to obtain information on the quantity, consistency, purity, strength, and quality of
products and services is the rights of the customer.
Customer satisfaction does have a positive effect on an organization profitability satisfied
customers form the foundation of any successful business.

So, all above was the reason for being disposed and returning the laptop, but we know about the
consumer right. That is why we do not need to panic that much.
