GOMEZ, representing the heirs of the late SIMPROSO GOMEZ, Filipinos, of legal ages and residents of Ganayon, Lianga, Surigao del Sur for and in consideration of the sum of ONE HUNDRED FIFTY THOUSAND PESOS (P150,000.00) Philippine Currency, to me in hand paid by NELYN Y. CHANG, Filipino, of legal age, married and a resident of Lianga, Surigao del Sur do hereby convey, by way of REAL ESTATE MORTGAGE, unto the said Nelyn Y. Chang assigns, that real estates described as follows: (1)
“A parcel of land, situated at Ganayon, Lianga, Surigao
del Sur, containing a total area of .5271 has., described under Tax Declaration No. 08-10-0007-00079 and bounded on the N: 12 (1824); on the E: 17 (1820); on the S: 18 (1817); and on the W: 15 (1818), in the name of Simproso Gomez” (2)
“A parcel of land, known as Lot No. 1820, Cad-980,
situated at Ganayon, Lianga, Surigao del Sur, containing a total area of .8560 has., described under Tax Declaration No. 08-10-0007-00082, in the name of Daisy Gomez”

“A parcel of land, known as Lot No. 1818, Cad-980,
situated at Ganayon, Lianga, Surigao del Sur, containing a total area of .1175 has., described under Tax Declaration No. 08-10-0007-00078, in the name of Pedro Martizano”

“A parcel of land, known as Lot No. 1921, Cad-980,
situated at Ganayon, Lianga, Surigao del Sur, containing a total area of .7214 has., described under Tax Declaration No. 08-10-0007-00106, in the name of Pedro Martizano”
Of which Lot Nos. 1818 and 1921 were acquired by Ruben
Gomez from the heirs of Pedro Martizano by way of Extra- Judicial Partition and Deed of Absolute Sale per Doc. No. 259, Page No. 41, Book No. 36, Series of 2000 by Notary Public Aniceto S. Sanchez ;
PROVIDED HOWEVER, that if we, the mortgagors shall pay
or cause to be paid Nelyn Y. Chang her heirs or assigns, the said sum of One Hundred Fifty Thousand Pesos (P150,000.00) Phil. Currency, then this MORTGAGE shall be discharged and of no effect, OTHERWISE, it shall remain in full force and of no effect and shall be enforceable in the manner provided by law. It should be understood further that the above-stated payment should include share of 450 kilos of copra every three (3) months as interest hereof, otherwise the vendee-a- retro has the right to harvest the coconuts in the said land,.
