COMPLAINT AFFIDAVIT

I, LT. COL. ADELINO G. SOLDE, Filipino, of legal age,

married and a resident of Rotonda, Brgy. 4, San Francisco,
Agusan del Sur, after having been duly sworn to in accordance
with law, do hereby state the following;

Q-Why are you filing this affidavit?

A- To file a criminal complaint for robbery with force
upon things against FELICISIMA ALBIENDA, EDGARDO
ALBIENDA, JONATHAN ALBIENDA, ELPEDIO “GARY” SALAS and
BOY BUDUAN;

Q- What happened?
A- That sometime on July 22, 2004, I was informed by my
driver and caretaker DANTE GEPANA, that the premises
of my residence and business ALBIENDA-SOLDE OPTICAL
CLINIC in Rotonda, Brgy. 4, San Francisco, Agusan del
Sur was destroyed, ransacked, burglarized by the
above-mentioned individuals;

Q- What did you do?

A- Immediately, I advised my caretaker to monitor and
don’t vacate the premises in view of the valuable
things inside. And since at that time, I was on duty
in Headquarters, ARESCOM, PA, Camp Regio De Dios,
Tanza, Cavite, I applied for 30 days leave to verify
the incident;

Q- What happened next?

A- From time to time, my caretaker were informing me
that the Albienda’s were no longer allowing me to
enter the premises, to open the house or the business
therein;

Q-Do you have witnesses to support or evidence to prove

the crime?
A-Yes, I have witnesses and documents to support my
cause, please see Annexes hereto attached.

Q- Do you have anything more to say?

A- Yes, on August 3, 2004, right after arrival in San
Francisco, Agusan del Sur, I entered the incident at
police blotter at Local Police Station, and requested
their assistance to verify the premises of my house,
and there, I personally saw that our belongings,
furniture’s and office equipments were accumulate and
deposited in a corner, furthermore, we also found out
that in the clinic, there were newly installed
cabinet and a refrigerator not belonging to us, and
all the optical items displayed were gone. At the
same time, the office of Dr. Joy Plaza was forcibly
open.
 B- Most importantly, my secret cabinet located at the
stairway was already ransacked and some items were
lost, to wit:

- one .45 caliber pistol (colt)valued at

P25,000.00
- a 220 grams of melted gold placed at
demilitarized mortal shell valued at more or
less P132,000.00
- 214 rounds of .45 caliber ammunitions valued at
P2140.00
- 2 Magazine of .45 caliber valued at P2400.00
Q-How much is the total value of the property damaged or
gone?
A-More or less P500,000.00

Q- Are you willing to sign this affidavit voluntarily?

A- Yes sir.
