EXTRAJUDICIAL SETTLEMENT AMONG

HEIRS WITH GENERAL POWER OF ATTORNEY

KNOW ALL MEN BY THESE PRESENTS:

This Extrajudicial Settlement with Special Power of

Attorney, made and executed by and among:

EDGARDO AGIANG and WILLIAM AGIANG, Filipinos, all of

legal age and residents of Cabangahan, Cantilan, Surigao del
Sur ;

WITNESSETH

That the abovementioned parties, are the sole and

legitimate heirs of the late SEBASTIAN AGIANG, who died in
testate, without any will,

That the said deceased, at the time of his death, left

several real properties, more particularly described as
follows to wit:

“A parcel of land, known as Lot No. 8488-P, Cad-354-D, situated at

Cabangahan, Cantilan, Surigao del Sur, containing a total area of 2.5000
has., described under Tax Declaration No. 08-04-0003-00010, in the
name of Sebastian Agiang (deceased)”

That no personal property/ies is/are involved in this

extrajudicial settlement;

That to the best of our knowledge and information of the

parties hereto, the said deceased left no debts ;

That the above-described property has not been

registered under the provisions of the Land Registration Act
nor under the Spanish Mortgage Law and the parties herein
have agreed to register this instrument in accordance with
the provision of Section 194 of the Revised Administrative
Code as amended by Act No. 3344 ;

That a true copy of this document had been published

once a week for three (3) consecutive weeks in a newspaper of
general circulation ;

That the parties hereto being of legal age and with full
civil capacity to contract, hereby by these presents agree to
divide and adjudicate, as they hereby divide and adjudicate,
among themselves, the above-described real estates in equal
shares, especially on the fruits, products and proceeds of
the properties planted with coco trees ;

That in consideration hereof we, EDGARDO AGIANG and

WILLIAM AGIANG, do hereby appoint, name and constitute,
FEDERICO A. BAT-AO, of legal age, Filipino, married to Gemma
Bat-ao and a resident of Lianga, Surigao del Sur, to be our
true and lawful attorney-in-fact, for our name, place and
stead ;

To ask, demand, sue for, recover, collect any and all

sums of money, debts, dues, accounts, legacies, bequests,
interest, dividends, and other thing of value of whatever
nature or kind as may now be or may hereafter become due,
owing, payable or belonging to me, and to the have, sue, and
to take any and all lawful ways and means for the recovery
thereof by suits, attachment, compromise or otherwise on the
above-mentioned real estate ;

To make, sign, execute, and deliver contracts,

documents, agreement, and other writing of whatever nature or
kind, with any and all third persons, concerns, or entities,
upon terms and conditions acceptable to my said attorney ;

To administer, manage and direct the above-described

property ;

GRANTING unto our said attorney-in-fact full power and

authority requisite, necessary or proper in or about the
premises, as fully as we might or could lawfully do if
personally present, and hereby ratifying and confirming all
that said attorney-in-fact shall do or cause to be done by
virtue hereof.

IN WITNESS WHEREOF, we have hereunto set our hands this

ACKNOWLEDGMENT

BEFORE ME, this ________________ at San Francisco, Agusan

del Sur, personally appeared the above-named persons
represented to me to be the same persons who executed the
foregoing instrument, and they acknowledged to me that
the same are their free acts and deeds.

This instrument consisting of three (3) pages including

this page has been signed by the parties and their witnesses
at the left margin of each and every page hereof.
