JUDICIAL AFFIDAVIT
OF ARNOLD UY ARNOCO A.K.A “JAY”,

This Judicial Affidavit of ARNOLD UY ARNOCO A.K.A

“JAY”, is executed to serve his direct testimony in the instant case.

I,ARNOLD UY ARNOCO A.K.A “JAY”, of legal age, single

and living at Tambis Street, Sambag 2, Cebu City, the accused in
this case, state under oath as follows:
 PRELIMINARY STATEMENT

The person examining me is Atty. Adrian P. Mapalo with office

address at Mapalo Law Office, A&D Building Pahina Central, Cebu
City. The examination is being held at the same address. I am
answering his questions fully conscious that I do so under oath and
may face criminal liability for false testimony and perjury.

PURPOSE: This affidavit/testimony of the accused ARNOLD UY

ARNOCO A.K.A “JAY”, is being offered to prove that the
warrantless arrest of the accused by members of the PNP was
conducted at around 3:00 in the morning contrary to the time stated
in Item “D” of the PNP Incident Report which was at 12:30 in the
afternoon.That the PNP operatives did not follow the standard
protocol for a buy bus operation, since ARNOLD UY ARNOCO
A.K.A “JAY”, was not committing a crime during his warrantless
arrest.

Defendant will also prove that the custody of alleged evidence

allegedly confiscated was tampered with.

1. Q. Please state your name and other personal circumstances

for
the record.
A. I am Arnold Uy Arnoco, a Filipino, single and of legal age. I
live at Tambis Street, Sambag 2, Cebu City.

2. Q. Do you know why you are here?

A. Yes, because I am the accused abovementioned criminal case filed
against ARNOLD UY ARNOCO A.K.A “JAY” involving drugs.

3. Q. Do you know Mr. ARNOLD UY ARNOCO A.K.A “JAY”?

A. Yes, Attorney.

4. Q. Do you know him personally?

A. Yes, Attorney.

5. Q. Why do you know him personally ?

A. He is one of the residents of one of the houses leased by Doctor
Rey Pesquira located in Tambis Street, Sambag 2, Cebu City,
which I happen to be the caretaker of.

6. Q. Where were you during the time between 2-3 in the morning of
November 29,2022?
A. I was inside my room.

7. Q. Were you alone inside the quarters?

 A. No, I was with my friends.

8. Q. What were you and your friends doing inside your unit?
A. We were having a drinking session in my room.

9. Q.What time did you start your drinking session with your
friends?
A. At around 10:00 the night before November 29,2022.

10. Q. What time did you stop your drinking session?

A. At around 2-3 in the morning of November 29,2022.

11. Q. What caused you to stop your drinking session?

A. Jay texted me to meet his two friends outside because he was
busy entertaining his cousin Kurt whom he hasn't seen in a
very long time.

12. Q. Do you know Jay’s two friends whom he asked you to meet?
A. No attorney

13. Q. When approaching Jay’s friends, were you doing anything

suspicious?
A. No Attorney, I was normally walking towards Jay’s two
friends.

14. Q. What happened when you approached Jay’s two friends?

A. a person dressed up as a GRAB DRIVER suddenly came
running towards me, proceeded to go behind my back then
grabbed and twisted my arm.

15. Q. What was your reaction then?

A. In my defense, I pushed him to get away but he had a good
hold of my arm so I started punching him.

16. Q. Why did you react this way?

A. I thought to myself that I was being robbed. When I turned my
head to look at him, he wasn’t wearing a Grab Driver
Uniform.. That made me suspicious because I wasn't doing
anything wrong and it was around 3:00 in the morning.

17. Q. How long did this scuffle last?

A. At about three minutes

18. Q. What happened after that?

A. More people arrived at the scene.

19. Q. Who were these people?

 A. I believe they were police officers.

20. Q. What made you think they were police officers?

A. Because the person whom i was fighting with shouted
“SARGE!”

21. Q. Were they wearing police uniforms?

A. No Attorney.

22. Q. Did you see any of them wearing body cameras?

A. No Attorney.

23. Q. What about the guy whom you were fighting with, was he
wearing any body cameras?
A. No Attorney.

24. Q. What did they do when they arrived?

A.I couldn’t see because I was facing the opposite direction.
When I turned my head to look, somebody hit me with the butt of an
“armalite”. After that I lost consciousness for a couple of seconds.

25. Q. What happened when you regained consciousness?

A. They immediately approached me and put me in handcuffs.

26. Q. Did the alleged police officers do a body search on your

person?
A. Yes, they looked into my pockets and took my cell phone,
my wallet and my ID holder.

27. Q. Were they able to get any contraband from you?

A. No, attorney.

28. Q. After searching, what happens next?

A. After putting me in handcuffs, they proceeded to search the
house. It was around 5:30 in the morning when they finally caught
Jay.
