FACT OF THE CASE:

That on or about 6:45 in the morning of August 16, 2022, this station received a report
from the victim, Cloe y Aripal, that she was sexually abused at Building 7 922 Field Residence
San Dionisio Paranaque City. Immediately elements of this station composed of Pat. Keven
Lajavrac and proceeded at the abovementioned place to conduct investigation.

Investigation conducted revealed that at around 2:00 P.M of August 16, 2022, at the
house on the said place, Cloe y Aripal (DOB on July 20 2000) Single, 4 th Year College student,
a resident of Brgy., San Dionisio Paranaque City, was sexually abused with carnal knowledge.
And a certain Pau y Kaminero, (DOB Feb 15 1997), Single, Construction Worker, residence of
1235 Sampaguita Compound, San Dionisio, Paranaque City.

At around 1:45 PM, the victim's parents went out to buy some groceries at SM Sucat
and left their daughter, Cloe y Aripal (Victim), alone inside her bedroom. The Parents also
informed Pau y Kaminero that they would go out to buy some food at the grocery and be back
right away. The victim claims that 15 minutes after her parents left the house, Pau y Kaminero
(suspect) entered her room holding a kitchen knife and threatened the victim not to do
anything or else he would stab her to death. The victim's clothes were forcefully removed, and
he engaged in sexual contact with her against her will. She attempted to defend herself after
such an incident but could not stand up to Pau y Kaminero's strength.

Afterward only a few minutes later, after the victim's parents returned from the grocery,
Pau y Kaminero bid his goodbye and went home. The parents noticed suspicion and
immediately asked their daughter if something had happened while they were gone. Without
having second thoughts, Cloe y Aripal confessed everything to her parents.Complaint was
advised to submit herself to medical examination.

SWORN STATEMENT OF CLOE y ARIPAL, currently residing at B7 922 Field Residences,
San Dionisio, Paranaque City TAKEN BY PSSg. John y Adarlo here at San Dionisio,
Paranaque City Police Station. THIS August 16, 2022, AT ABOUT 6:45 P.M. IN THE
EVENING, IN THE PRESENCE OF Lady Aripal and Mujib Aripal (Parents) THROUGH
QUESTIONS and ANSWERS.

QUESTION AND ANSWERS

1. QUESTION: CLOE y ARIPAL, do you swear to tell the whole truth and nothing but
the whole truth in this investigation?

ANSWER: YES.

2. QUESTION: Are you willing to your free and voluntary statement?

ANSWER: YES.

3. QUESTION: Will you please state your name and other personal circumstances?

ANSWER: I am CLOE y ARIPAL, Female, Filipino, 22 years old (DOB: July 20, 2000),
Single, 4th Year College Student and currently living at B7 922 Field Residences, San
Dionisio, Paranaque City.

4. QUESTION: Will you please tell me why you are here in our office and in giving
this statement?

ANSWER: To report Pao y Kaminero Male, Filipino, 25 years old, Born on Feb 15,
1997, Single, Construction Worker, residing at 1235 Sampaguita Compound, San
Dionisio, Paranaque City.

5. QUESTION: What are the reasons and why you’re complaining about the person
you’ve mentioned?

ANSWER: It’s because Pao y Kaminero raped me.

6. QUESTION: Are you related to each other or do you know him?

ANSWER: No Sir, I don’t know him and don’t have any kind of relationship with him. He
is just working at our house.

7. QUESTION: When and where the incident took place, if you can remember?

ANSWER: It happened around 2:00 P.M. in the afternoon August 16, 2022 at B7 922
Field Residences, San Dionisio, Paranaque City.

8. QUESTION: How many times Pao y Kaminero raped you?

ANSWER: Just once, Sir.

9. QUESTION: Will you please narrate in this investigation what truly happened the
incident took place?

ANSWER: At around 1:45 P.M, my parents went out to buy food at the grocery in SM
Sucat. Pau and I were left in the house. Pao y Kaminero is working in our house fixing
our cabinets. I was in my room scrolling through my cellphone 15 minutes after my
parents went out when suddenly he came in with a kitchen knife and told me not to
shout or else he will stab me to death. He forcibly removed my clothes and started
raping me, I did everything I could to push him away and stop him from what he was
doing, but I couldn’t handle him with all his strength pinned on me.

11. QUESTION: What happened next if there’s anything?

ANSWER: After the incident, my parents returned, and Pao y Kaminero returned to fix
our cabinet. I was in my room crying and still in shock. The suspect went home after
finishing his work. And my parents felt suspicious inside our home and immediately
asked me if something had happened while they were gone, and I told them about the
incident. We went here to the station right away to report everything.

12. QUESTION: After you are examined by the doctors what did they found out?

ANSWER: The doctors give the result of my genital and medical examination and the
doctors found out that there is a semen inside my vagina, and they compared it to Pao y

Kaminero by using DNA test (we brought the spoon that was used by Pao y Kaminero)
and was tested positive.

13. QUESTION: Can you give me a copy of your result of genital and medical
examination?

ANSWER: This is the result of my genital and medical examination, Sir. (The affiant
showing to the investigator a copy of the result of her genital and medical examination).

16. QUESTION: In the meantime, I have no more questions to ask, do you have
anything to add, or retract from your statement?

ANSWER: None so far, Sir.

17. QUESTION: Did somebody coerced, threaten, or give you any reward or promises
in giving this statement of yours?

ANSWER: No, Sir. This is my will to seek justice for what he inflicted against me.

AFFIDAVIT OF ARREST

We, Pat. Patrick y Santos and Plt. Nylecoj y Dais of legal age, a bonifide members of the
Philippine National Police, and presently assigned at San Dionisio, Paranaque City Police
Station after having been duly sworn to in accordance with law, do hereby depose and state:
1. That on August 16, 2022 at about 6:45 in the morning, while we are performing our
duty and responsibility as a patrollers and conducting police presence along Dr. A
Santos Ave. Barangay San Dionisio, Paranaque City, our office received an information
from Cloe y Aripal victim of rape incident.

2. That acting on the said information, I Pat. Patrick y Santos together with my team
leader Plt. Nylecoj y Dais immediately went to the suspect’s house and arrested Pao y
Kaminero Male, Filipino, 25 years old, Born on Feb 15, 1997, Single, Construction
Worker, residing at 1235 Sampaguita Compound, San Dionisio, Paranaque City.

3. That we Pat. Patrick y Santos and Plt. Nylecoj y Dais identified ourselves to the
suspect as police officers and members of Ups 5 Police Sub Station, and that my team
leader was informing the reason of his arrest and of his constitutional rights and all of
those right were explained to him in a language that he understood.

4. That he submitted himself to us peacefully; and that we, immediately brought him to
our office for medical examination, investigation and proper disposition; and

5. That I executed this affidavit/statement to attest to the veracity of the aforementioned

facts and support the filing of appropriate charge/s in court against the arrested
suspect.
