SUBJECT : INVESTIGATION REPORT Re: Arrest of Resto Gene Dela Torre aka
“Odjing/ Isrogel” during implementation of Search Warrant at
Barangay Cabobo, Lamitan City, Basilan

I. AUTHORITY

1. Memo from this Office dated May 9, 2020 Accomplishment report on


the above subject.

3. To determine the surrounding circumstances leading to the arrest of


the said subject person.
4. To provide factual evidences that will strengthen prosecution against
the subject arrested person.

III. FACTS OF THE CASE

5. Investigation revealed that on May 9, 2020, PMSg Sikkim A Sereñas


together with his witness/es applied for Search Warrant before the sala of Hon. Judge
LEO JAY T. PRINCIPE Presiding Judge, RTC Branch 1 against RESTO GENE DELA
TORRE aka “Odjing/ Isrogel for Violation of RA 8294 as amended by RA 10591
Unlawful acquisition and possession of firearm and ammunition.

6. On May 9, 2020, Hon Judge LEO JAY T. PRINCIPE, Presiding Judge


issued Search Warrant No. 03-2020 against RESTO GENE DELA TORRE aka

“Odjing/ Isrogel” for Violation of RA 8294 as amended by RA 10591 Unlawful
acquisition and possession of firearm and ammunition.

7. At about 4:15PM of May 9, 2020, the undersigned (Chief of Office)


conducted final briefing regarding the implementation of the above-cited writ, wherein,
PEMS Siddick M Sapatil designated as Team Leader, PMSg Abdulnaser B Alam was
designated as Arresting Officer, while Pat Fahad M Samud as Investigator on Case.

8. On the same date at about 4:15PM, combined elements of this Unit,


Provincial Intelligence Unit, 3rd Platoon 1st PMFC and intelligence operative of Lamitan
CPS implemented Search Warrant No. 03-2020 at the residence of the above suspect
at Barangay Cabobo, Lamitan City, Basilan which resulted in the arrest of RESTO
GENE DELA TORRE aka “Odjing/ Isrogel” and the confiscation/seizure of One (1) 38
Caliber Revolver with defaced Serial No. with four (4) live ammunitions, One (1)
Fragmentation Grenade, Two (2) heat sealed transparent sachet containing white
crystalline substance believed to be Shabu, One (1) lower wood stock of Carbine Rifle,
One (1) Bandolier (Ammunition Pouch) to wit:

9. During the implementation of said writ, the undersigned, PMSg


Abdulnaser B Alam together with other operatives introduced themselves as Police
Officers and read the contents of the said writ in the presence of the suspect, Punong
Barangay and BPATs member.

10. Likewise, during the arrest, suspect was informed of the cause of his
arrest and was apprised of his Constitutional Rights such as the right to remain silent, to
have a competent and independent counsel preferably of his own choice.

11. The search was conducted in an orderly manner in the presence of the
suspects and witnessed by Barangay Chairman Andy T. Langkahan and Mrs. Eva Joy
Dela Torre.

12. The actual physical inventory, markings and taking of photographs of


seized evidence were conducted at the residence of the subject arrested person and
witnessed by the suspect himself in the presence of Barangay Chairman Andy T.
Langkahan of Brgy., Cabobo, Lamitan City, Basilan and Mrs. Eva Joy Dela Torre (wife
of the suspect).

13. That PSSg Nur-Aldin I Abdulla (Seizing Officer) affixed his initial and
signature as markings on the seized drugs.

14. That representative of media and from the City Prosecutors office are
not feasibly present in the area because of the distant of the place as well as the current
health crisis that limits unnecessary movements of people.

15. That after the implementation of the SW operating PNP personnel


brought the arrested suspect to Basilan PPO for intelligence and proper disposition.

16. The arrested person was later brought to Provincial Crime Laboratory
Office for medical/physical and laboratory screening test while the confiscated pieces of
evidence were turned-over by PSSg Nur-Aldin I Abdulla (Seizing Officer) to the duty
personnel of Provincial Crime Laboratory Office at about 8:46PM of May 9, 2020 for
chemical analysis;

17. That the confiscated one (1) unit Fragmentation Grenade was turned-
over by the undersigned to the Basilan EOD/K9 and received by PCAPT VERNON
JOHN G LLOVIDO at about ________ of May __, 2020 for identification and
determination of explosive content;

18. That the PNP-CLO9 Chemistry Report No. ________ examined by


______________________and approved by _________________ dated May ____,
2020 gave positive results for the test of dangerous drugs with a total weight of
_______.

IV. INVESTIGATION/FINDINGS

19. After a careful perusal of the facts of the case that leads to the arrest
of RESTO GENE DELA TORRE aka “Odjing/ Isrogel” the Search Warrant that was
implemented by the combined PNP personnel follows the legal procedures and that it
was implemented in an orderly and peaceful manner.

20. That the confiscated pieces of evidence by the seizing officer follows
the legal procedures and that it conforms with the PNP standard operational
procedures.

21. Likewise, the undersigned were able to uncover his nefarious activities
in the area, such as illegal drug trade and cattle-rustling in collusion with known lawless
elements in the outskirt of Lamitan City, Basilan and neighbouring municipalities.
Nonetheless, the would-be complainants of the said crime incidents particularly cattle-
rustling are afraid and apprehensive to come out and lodged complaints against the
said arrested person because of fear of reprisal.

22. It can be also gleaned that the suspect recent recruitment as member
of the CAFGU gave him the cloak and immunity to conspicuously display firearms and
because of this – the said arrested person continue to conduct his wicked deeds with
outmost impunity. A separate inquiry as to how the said arrested person was able to get
a clean credentials and clearances are worthy of investigation.

V. CONCLUSION

23. Wherefore, a criminal case for violation of Sec 11 of Art II, RA 9165
CDDA, RA 10591 Unlawful acquisition and possession of firearm and ammunition and
RA 9516 illegal possession of explosive should be filed against the above named
suspect.

VI. RECOMMENDATION/DISPOSITION

24. Respectfully recommends the finding of the above Investigator-on-


Case and that a case for violation of Sec 11 of Art II, RA 9165 CDDA, RA 10591
Unlawful acquisition and possession of firearm and ammunition and RA 9516 illegal
possession of explosive shall be filed against the identified suspects.
