2. This pertains to the above reference, please be informed that on or about 1:30 in the
afternoon of October 10, 2022, certain ALEXIS HISONA, 24 years old, female, single,
and a resident of Purok 13 Happy Valley, Upi Maguindanao personally came to this
office and reported JOHN ANSING for allegedly stab and killed the victim identified as
DAVE OSING.

3. That about 1:30 in the afternoon, Mr. Dave Osing while under the influence of
intoxicating liquor, went to the said suspect’s house with a knife at Purok 13 Happy
Valley, Maguindanao which resulted to a heated argument between them. The victim
suddenly attempted to stab the suspect but missed then apparently JOHN ANSING
happened to snatch the knife from Mr. Dave Osing and stabbed him instead twice which
resulted to the death of the above victim. This suspect fled the area on boarded the
motorcycle XRM towards Nuro Upi, Maguindanao.

4. Investigator on case is PO1 Christian Ulobalang with contact number 09756436928.

On October 10, 2022, about 2:00 pm, Alexis Hisona, female, 24 years old, single

reported that about 1:30 in the afternoon on the same place and date. Dave Osing, 25 years old,
male, single and a resident of Purok 13 Hapy Valley was stabbed and killed by John Ansing

Maguindanao. The case was referred to investigation section for further investigation.

2. This pertains to the above reference, please be informed that on or about 1:30 in the

3. The MPS elements proceeded to the area to confirm the said report and to conduct a hot
pursuit operation against the said suspect, upon arrival at Purok 13 Happy Valley, Upi,
Maguindanao together with the complainant, the authorities successfully apprehended the
suspect in its own house. And the suspect was apprised by the apprehending officers of his
constitutional rights under Miranda Doctrine and subsequently, and brought the suspect to
office for investigation and proper disposition.

I, ABRALLAH ABDULLAH, of legal age, female, married and a resident of Purok 13

Happy Valley Upi, Maguindanao, after having been duly sworn to oath in accordance with law,
do hereby depose and say:

That I am the same person executing this affidavit;

That on October 10, 2022 at about 1:30 in the Afternoon, my brother, Dave Osing went
out of our premises.

That about 2:35 in the afternoon on the same date, ALEXIS HISONA arrived at our
residence, and reported that my brother was stabbed and killed by JOHN ANSING at Purok 13
Happy Valley Upi, Maguindanao. The suspect immediately fled away from the crime scene on
boarded his motorcycle XRM.

That upon knowledge of the incident, we were shocked and immediately went to the Upi
MPS.

That I am executing this affidavit to file criminal case against the above mentioned
suspect for the case of HOMICIDE.

I, PO1 CHRISTINA ARISTON, with legal age, female, PNP member and
presently assigned to Upi Municipal Police Station, Upi, Maguindanao, respectively after having
been duly sworn to an oath in accordance with law, do hereby depose and say:

That I was the same and identical person who executed the affidavit:

That on or about 2:00 pm of October 10, 2022, while I am on duty to our office,
ALEXIS HISONA came to the office of MPS, and requesting a police assistance to arrest the
certain suspect JOHN ANSING, who killed DAVE OSING at the place of Purok 13 Happy
Valley, Upi, Maguindanao about 1:30 pm of October 10, 2022.

I immediately proceed to the area and confirmed the said report and conduct the
hot pursuit apprehension against the suspect at Happy Valley, Upi, Maguindanao together with
the complainant, I successfully apprehended the suspect.

That I apprised him of his constitutional rights under the Miranda Doctrine and
brought the suspect to our office for filing a case of homicide and proper disposition.

That I am executing this affidavit freely and voluntarily to arrest that truthfulness
of the foregoing declaration to support the complainant ABRALLAH ABDULLAH (sister of
the victim) against the suspect for the crime of homicide.

I, ALEXIS HISONA, with legal age, female, and a resident of Purok 13 Happy
Valley, Upi, Maguindanao, after been duly sworn to oath in accordance with law, do hereby and
depose and say:

That I am the same person executing this affidavit;

That on or about October 10, 2022 at about 1:30 in the afternoon, I went out to
buy from a store away from our house and I saw the victim DAVE OSING with a knife walking
in front of the premises of JOHN ANSING who is identified as a suspect. After about 20
minutes I came back home and passed through the house of the said suspect and saw him fled
the area on boarded the motorcycle XRM towards at Nuro,Upi, Maguindanao. After he fled
away, I noticed someone lying in the floor near his balcony, lifeless with lots of blood around his
body and I identified him as the victim since I saw him minutes ago outside the premises . After
seeing it, I went to the police to report the crime and inform his family.

That I identified the suspect because I always see him at our Barangay, aside from
that MR.DAVE OSING was said to have misunderstanding with the said suspect.

That I am executing this affidavit to attest the truthfulness of the foregoing facts
and to support the criminal complaint filed by ABRALLAH ABDULLAH against the above
suspect for the crime of HOMICIDE.

FACTS OF THE CASE:

Initial investigation revealed that the said suspect, stabbed and killed the victim DAVE
OSING at PUROK 13 HAPPY VALLEY, UPI MAGUINDANAO. The said suspect fled away

On appeal is the August 2023 decision 2 of the Court of Appeals special twenty-third
division in CA-GR. CR-HC NO. 00887-MIN. which affirmed the decision 3 dated October 10,
2022 of the Regional Trial Court (RTC) of Province of Cotabato City, Branch 13, in Criminal
case No. 2022-7200.
FACTS
In an information file with the RTC, Accused-appellant John Ansing (Boy) was charged
with the crime of Homicide, the accusatory portion of which reads:

That on or about 1:30 in the afternoon of October 10, 2022 at Purok 13 Happy Valley,
Municipality of the Upi, Province of Maguindanao, Philippines and within the jurisdiction of the
Honorable Court the above named accused did then and there unwillingly, unlawfully and
feloniously and without intent, stabbed and killed the victim Mr. Dave Osing, was immediately
died by the use of knife owned by the victim itself.
