Item No.2 This matter erroneously has been listed for admission when it
2nd July, 2018
had already been admitted on 10th January, 2018.

Respondent Nos.1, 3, 6 and 7 are represented by their

respective learned Counsel who pray for time to file their

responses. The last date fixed for this case was 10th January,

2018 and today it is 2nd July, 2018. It was expected of all the

respondents to have filed their objections by now but they have

failed to do so. We grant them final opportunity to do so within a

period of 10 days from now failing which appropriate coercive

orders shall follow.

The respondent No.2, Urban Department, Government of

Maharashtra, respondent No.4, the Deputy Salt Commissioner

and the respondent No.5, the Chief Conservator of Forests,have

failed to appear despite service. Ms. Mani Prakash, learned

Counsel for the applicant submits that as per postal tracking

report, all the respondents have been duly served with the

Notices. We are rather surprised that these respondents which

are government authorities have not cared to be present today. It

Item No.2 is expected that orders issued by Courts are complied with by all
2nd July, 2018
including the State Government. If none appears on behalf of

respondents on the next date, we shall be constrained to pass

orders that may not be palatable.

A copy of this order be transmitted to Chief Secretary,

Government of Maharashtra with a direction that the order be

complied with.

List on 11th July, 2018 before which responses shall be filed.

Affidavit filed on behalf of the respondent No.3, MPCB, be taken

on record. Since a copy of the affidavit has been served upon the

applicant and other respondents, they shall file their rejoinder, if

any, before the next date.
