3. Defendant does not admit the allegations contained in paragraph 5 and 6 of the
complaint as it lacks in form and substance to support any cause of action
against the defendant;
4. Defendant does not admit the allegation in paragraph 7 as it has no basis in law
and in facts.
1. The complaint states no cause of action. The rule requires that every action must
be prosecuted or defended in the name of the real party in interest. (Sec. 2, Rule
3 of 1997 Rules of Civil Procedure). Only parties to a contract may sue or be
sued upon that contract.
COUNTERCLAIM
By way of counterclaim, defendant alleges:
That by virtue of this unwarranted complaint initiated by the plaintiff, defendant was
forced to engage counsel in the sum of ten thousand pesos (Php10, 000.00).
PRAYER
WHEREFORE, it is respectfully prayed that the complaint be dismissed for lack of cause
of action and defendant be awarded the amount of ten thousand pesos (Php 10,000.00).
Other relief and remedy just and equitable under the premises are likewise prayed for.
VERIFICATION
