Works
Defects Notification Period 1.1.3.7 Two (2) years (commencing the day after the date Taking Over Certificate
is issued). The Employer request to extend the validity of Defects
Notification Period and it’s complied with the Contractor, the Contractor
shall extend 2 years of the Defects Notification Period, but not longer
than 4 years from the date Taking Over Certificate is issued.
Communication and transmission 1.3 The applicable method is by remitting electronic (soft scanned copy) data
systems attached to an e-mail correspondence, and such signed document shall be
taken as an official correspondence. However all correspondence /e-mails
transmitting documents or drawings or engineering data shall be
accompanied by a covering document transmittal sheet (identifying the
document and its Rev number) and given reference number for traceability
and record.
Governing Law 1.4 The laws of the People’s Republic of Bangladesh

Amount of Performance Security 4.2 The amount of Performance of Security is fifteen percent (15%) of
accepted Contract Amount specified hereof. The Contractor provides the
Advance Payment Security and/or through Performance Security issued
by the first class of bank.
Delay damages for the Whole of 8.7 & Zero point one percent “0.1%” of Contract Price on a per-day basis.
the Works 14.15 (b)
The ceiling amount of the Liquidated Damage “hereinafter called to the
“LD”” is twenty percent (20%) of the Contract Price.
This LD related to each Key Dates of Time for Completion as identified
and specified in the project schedule specified in the Contract
Documents.
The applicable Key Dates shall be agreed with the both parties before
Contract signing.
Advance Payment 14.2 Ten percent (10%) of Accepted Contract Amount is payable for Advance
payment as fast installment upon receipt of the Advance Payment Bond.

The following Milestone payment will be made within 90 days, by T/T

remittance or Bank Cheque upon receipt of the Contractor’s invoice with
necessary evidence, which certified by the Employer.
Retention Money 14.3(c) 20% (twenty percent) shall be retained from each Interim Payment
Certificate as Retention Money.

RELEASE OF RETENTION: shall be paid within sixty (60) calendar days, to

Contractor upon issuance by the Employer of Taking Over Certificate.

Contractor shall secure Retention Bond upon issuance of Taking Over
Certificate from a Bonding Company approved by the Employer which
should be valid until the expiry of the Contract Defects Liability Period.

Currency of payment 14.15 Bangladesh Taka.
Submission of evidence of 18.1 (a) & The Contractor shall submit Certificates of Insurance and copies of his
insurance policies (b) relevant policies within thirty (30) days after the Commencement Date.
Insuring Party 17.3 & The insuring Party shall be the Employer and the Contractor for All Risk
18.2 Insurance covering by the Employer with the following conditions;

Deductions of less than JPY 50,000,000 shall be to the account of the

Contractor in the execution Work without Testing stipulated as below.
From the liability running of Testing, the deduction of less than JPY
50,000,000 shall be to the account of the Contractor.

The Employer will provide the copy of his insurance policy after it is in
place.
Insuring Party 18.3 The insuring Party shall NOT be the personal accident supplied by the
Contractor.
