Executive Order No. 292 Book 1 Chapter 10 (Official Oaths) Section 40 states that all Public
Officers and Employees of the government including every member of the armed forces shall
defend the Constitution, bear true faith and allegiance to it and to obey the LAWS, LEGAL
ORDERS and DECREES PROMULGATED by the constituted authorities. As per
Administrative Order No. 239 signed by then President Gloria Macapagal-Arroyo on the 15 th of
September, 2008 section 1 states that “All government agencies and offices are prohibited from
using government vehicles for purposes other than official business.” Moreover, R.A. 6713
states that all Public Official and Employees shall always uphold public interest over personal
interest.
For instance, in Erna’s case, she directly accused Director Sison of breaking the law and using a
government vehicle for personal matters without conclusive evidence to her accusations. She
based her accusations on her belief that a lot of Public Officials and Employees commit acts in
defiance of our duty to serve public interest over personal interest. Granting that the vehicle she
saw in the parking lot of SM Megamall was a government issued vehicle issued to Director
Sison, she doesn’t have any substantial evidence to back her claim. Director Sison may have
brought the person whom she has conducted official transaction to have lunch giving them the
chance to further discuss matters involving the said transaction, or she could have gone to buy
something urgent for their office as Directors and Department Heads have that authority.
