LAST WILL AND TESTAMENT

 
 
KNOW ALL MEN BY THESE PRESENTS:
 
I, xxx, Filipino citizen, of legal age, widow to xxx born on the 2 nd of
February, 1980, a resident of xxx, Sta. Mesa, City of Manila, being of sound
and disposing mind and memory, and not acting under undue influence or
intimidation from anyone, do hereby declare and proclaim this instrument to
be my Last Will and Testament, in English, the language which I am well
conversant. And I hereby declare that:

1. I desire that should I die, it is my wish to be buried according to the

rites of the Roman Catholic Church and interred at any Catholic
cemetery in the country;

2. To my minor child, xxx I give and bequeath all my known properties

and net proceeds of lumpsum death, pension, insurance and other
claims inherited from my late husband xxx, from the Swiss
Government, Saudi ARAMCO and General Organization for Social
Insurance (GOSI) etc. subject to administration until she reaches
age of majority;

3. To my dear friend xxx, I give and bequeath an amount of Php

150,000.00 to be taken out from the net lumpsum claims;

4. To my dear friend xxx, I entrust the physical care and custody of

my minor child Angel Valera Dewitz. An appropriate allowance on
top of their living expenses shall be fixed by the court upon the
sound recommendation of the estate’s designated Administrator;

5. I hereby designate ATTY. xxx, my personal lawyer as the executor

and administrator of this Last Will and Testament, and in her
incapacity, I name and designate ATTY. xxx as her substitute;

6. I hereby direct that the executor and administrator of this Last Will
and Testament or his substitute need not present any bond;

7. I hereby direct the executor and administrator to perform the

following actions;

a. Locate and secure both of my probate and non-probate assets

including those located in Zamboanga;
b. Obtain comparative zonal, appraised, and market values and
appraisals of all my properties;

c. Preparation and filing of all documents required by the probate

court in a timely manner;

d. Collect pensions, insurance death and lumpsum claims

inherited from my deceased husband Marcel Georg Dewitz from
the Swiss Government, Aramco and GOSI etc.;

e. Roll over and make appropriate elections and investments of not

more than 50% net lumpsum claims received while alive and
during the administration of the estate of the decedent;

f. Deliver half of the net proceeds of whatever investments

undertaken to my daughter xxx on her 18nth birthday and the
remaining half on her 25th birthday;

g. Coordinate the payment of the decedent's outstanding

obligations upon death and those due while the estate is being
settled;

h. Upon the settlement of all the claims against the estate including
taxes and money claims, I hereby instruct the Administrator to
establish a time deposit and trust fund account for my daughter
xxx; half of which can be claimed on her 18nth birthday, and the
rest of it on her 25th birthday;

i. Facilitate the filing of Petition for Guardianship of my minor

daughter xxx, whereby I designate my good friend xxx as my
daughter’s guardian who shall have the care and custody of her
person while I designate Atty. xxxthe management of my
daughter Angel Valera Dewitz’s properties and assets consistent
with Sec. 17 of A.M. No. 03-02-05-SC;

j. Ensure that my daughter receives a reasonable monthly living

allowance from my estate; if possible the entire monthly benefit
from the Swiss Government shall be reserved to her;

k. Coordinate in a timely manner with the court release of extra

funds in case my daughter’s reasonable expenses exceed the
monthly living allowance. Reasonable expenses may include but
not limited to; school fees, health and hospitalization, reasonable
R and R, transportation etc.
 l. Ensure that xxx shall receive a reasonable portion of monthly
living allowance to be taken out from the monthly benefit from
the Swiss Government;

m. Check on my daughter’s well-being on a monthly basis until she

finishes college;

n. Keep track of the estate bank accounts;

o. Determine the estate and other types of taxes due on estate real
and liquid assets, and identifying the sources of the payments
necessary with the approval of the probate court;

p. Request court permission for various actions required by the

Rules of Court promulgated by the Supreme Court of the
Philippines pertaining to the Settlement of Estates of Deceased
Persons;

q. Retitling the decedent's real estate into the names of my

daughter xxx if it is not being sold;

r. Coordinate with the court the distribution of the remainder of

the decedent's assets to the heirs declared by the court after the
payment of bills and taxes;

I hereby revoke, set aside and annul any and all of my other will or
testamentary dispositions that I have made, executed, signed or published
preceding this Last Will and Testament.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 3 rd

day of September, 2021, in Quezon City, Philippines.

ATTESTATION CLAUSE
 
We, the undersigned attesting witnesses, do hereby affirm that the
forgoing is the last Will and Testament of xxx and we certify that the testator
executed this document while of sound mind and memory. That the testator
signed this document in our presence, at the bottom of the last page and on
the left-hand margin of each and every page, and we, in turn, at the
testator's behest have witnessed and signed the same in every page thereof,
on the left margin, in the presence of the testator and of the notary public,
this 3rd day of September, 2021 at Quezon City, Philippines.

margin of each and every page thereof by the testator and his witnesses, and
sealed with my notarial seal.
