PROCEDURE
For the reasons stated in the accompanying affidavit, it is humbly prayed
that this Honourable Court may be pleased to serve notice on the
caveator-petitioner, in case the respondents file any application in any
proceeding against the caveator-petitioner and against the judgment of
the learned Single Judge of this Honourable Court in W. P. 999/501 of
2020.

AFFIDAVIT FILED BY THE CAVEATOR UNDERSECTION 148A OF THE


CODE OF CIVIL PROCEDURE
I, Suma, aged 25 years, daughter of Sudhakaran, residing at "Sumangali",
Janatha Road, Ernakulam, do hereby solemnly affirm and state as follows:-
1. I am the Petitioner in W. P. 999/501 of 2020 of the Honourable High
Court of Kerala, Ernakulam and the Caveator herein. I know the facts
of the case.

2. The Writ Petition was to issue a writ of mandamus against the


respondents to appoint me as the Sales Tax Officer.

3. The learned Single Judge of this Honourable Court, after considering


the Petition, counter affidavit, the entire facts and law and after
hearing the learned counsels the parties found that the petitioner is
legally entitled to get the appointment and directed the respondents
to appoint me to the post as early as possible.

4. It is reliably understood that the respondents are about to file an


appeal before the Division Bench of this Honourable Court and to
apply for a stay of the Judgment of the learned Single Judge in W. P
999/501 of 2020.

5. If an appeal or an application for an interim stay is filed, I submit


that I have a right to appear before this Honourable Court on the
hearing of such appeal or application.

6. I assure that I shall serve the necessary notices of this caveat by


registered post acknowledgment due on the respondents.

7. It is therefore humbly prayed that this Honourable Court may be


pleased to order service of notice to me in case the respondents file
any appeal, application or proceeding against me in the matter.

All the facts stated above are true to the best of my knowledge,
information and belief.
