Factors Affecting the Development of Juvenile Delinquency

The family is the first and most important social unit to


affect children; it is the first social world the child
encounters. Families help in the development of stable and
Family emotionally secure individuals and enhance the cognitive
and language development of children by providing a variety
of intellectually rich and stimulating experiences. Parents
and older family members also serve as role models,
transmitting educational values and providing environment
in which children can safely develop a sense of
independence.
The peer group is a group of youths of similar age levels and
interest that often can empower young people in their sense

They search for acceptance, status, identify and meaning
through interaction with others.
Peer group activities reflect behaviors that are symbolic of
adulthood and are viewed as signs that the person is no
longer a child, behaviors often having to do with drugs,
sexuality and freedom.
The school, unlike the family, is a public instrument for
training young people. It is, therefore, more directly

resources and policies.
Poor academic performance has been directly linked to
delinquent behavior. There is general consensus that

student who are chronic underachievers in school are also


the most likely to be delinquent.

It is where the child is exposed to after his first highly


formative years. It may be a place where crime is a day-to-

ultimately manifested in the character and personality of a
child as he or she becomes an adult.
Mass media embraces all kinds of communications where a
child is exposed to. It covers up everything that a child hears
Mass Media and sees that leaves behind in his or her imagination. It
could be anything a child saw on television, heard over the
radio, read from a book or magazine, or even saw in a movie
house. Many researchers have concluded that young people
who watch violence tend to behave more aggressively or
violently, particularly when provoked.

Direction: Explain the problem provided below based on your own
understanding

How do your barangay officials, as representative of the government and the


community , help in Juvenile Delinquency prevention in your place

In our barangay, barangay officials are very responsible. They did not tolerate
those children who drink beverages at such young age. Some reported it to their
parents to give the proper discipline. Barangay officials always set up a
basketball game atleast twice a year before the pandemic to switch the attention
of the children to participate in extracurricular activities and not in evil activities.
Everyone are equally served and no one is rejected whenever at whatever
assistance we need in barangay. As far as I know there is no case that involved in
juvenile delinquency in our area. I realized how great my barangay is right now .
Poor family home life, measured by marital adjustment and harmony within the
home, also affects the rate of delinquent behavior among children more than
whether or not the family is intact. Happiness or marriage, good marital

relationships and strong family cohesiveness in homes are the key whether or
not the children become delinquent.

On this particular module, Factors Affecting the Development of Juvenile


Delinquency, I have learned so much about it. One of the most critical aspects of
socialization is the development of moral values in children. Moral education, or the
training of the individual to be inclined toward the good, involves a number of
things, including the rules on the do’s and don’ts and the development of good
habits. For example, rejected kids who have attention and hyperactivity problems
are more likely to suffer later conduct problems. Peer rejection may help increase
and sustain anti-social behaviors because outcast kids become suspicious of other
people’s motives, see them as hostile, and become more likely to respond in an anti-
social manner. The problem of juvenile delinquency is attributed to factors such as
family, peers, environment, school and mass media that affect the socialization of
children. Socialization is the process through which children learn the ways of a
particular society or social group so that they can function within it.

Direction: Explain your answer based on your own understanding the


question provided below.

1. When does a youth offender be criminally liable in the crime he/she


committed and discuss the procedure how a youth offender prosecuted ?(10
points )

A ‘Youthful Offender” is one who is over nine years but under twenty-one
years of age of at the time of the commission of the offense.

A child nine years of age and under at the time of the offense shall be exempt
from criminal liability and shall be committed to the care of his or her father
or mother, or nearest relative or family friend in the discretion of the court
and subject to its supervision. The same shall be done for a child over nine
years and under fifteen years of age at the time of the commission of the
offense, unless he acted with discernment.

The first encounter a youth has with the juvenile justice system is usually his
or her arrest by a law enforcement official. Other ways that youth enter the
system include "referrals" by parents and schools, delinquency victims, and
probation officers. A decision is usually made after arrest as to whether a
youth should be detained and charged, released, or transferred into another
youth welfare program. The officer handling the case makes this decision
based on information obtained from the victims of the crime committed by the
juvenile, the juvenile himself, the juvenile's parents, and any past records the
youth has with the juvenile justice system. Federal regulations require that
juveniles being held in adult penitentiaries (while officials attempt to contact
parents or make transfer arrangements) be kept out of "sight and sound" of
adult inmates, and be removed from the adult facility within six hours.

When a juvenile court case reaches the juvenile probation department, an


intake officer will decide whether to dismiss it, handle it informally, or hear it
formally. To make this decision the officer reviews the facts surrounding the
case to decide if there is enough information to try the youth. If the court has
received adequate evidence to hear the case, a decision will be made as to
whether the juvenile case should be heard formally or informally. If the
information available is inadequate, the case will be dropped.

While a youth awaits trial he or she may be held in a "secure detention


facility." A judge will determine if the juvenile should be detained before and
through the course of the trial, and define the intent of the detainment, in a
"detention hearing," usually held within 24 hours of the arrest. A youth will
typically be detained if he poses a threat to himself or public safety.

2. Can a parent be criminally liable or penalized if they abandoned their child ?


( 5 points )

Yes, a parent guardian has a legal obligation to provide that child with necessities
such as food shelter and clothing. Failing to provide for these necessities can lead to
desertion or abandonment charges. The crime of child desertion or child
abandonment occurs when a legally adult leaves a child with the intention to
abandon him or her. The parent or guardian must intend to server the custodial ties
over the child, and must often do so without regard for the child’s health and safety.
Accidentally forgetting or leaving a child does not rise to the level of child
abandonment or desertion, though prosecutors might be able to charge an adult in
that situations with a different crime, such as reckless endangerment of a child.

3. A police officer while on duty caught a minor committing theft in his presence
and arrested. If you were a police officer how do you handle the situation if
the offender is a minor? Explain your answer. ( 10 points )

Police investigation into criminal matters should be similar whether the suspect is
an adult or a juvenile. Juveniles, therefore, should receive at least the same
safeguards available to adults in the criminal justice system. Police Officers who
detain young offenders must keep them secure while in custody and for a period of
no more than six hours.

The Child is one of the most important assets of the nation. Every effort should
be exerted to promote his welfare and enhance his opportunities for a useful and
happy life. When a juvenile court case reaches the juvenile probation

Direction : Explain and elaborate the given questions below .

1.In your own idea , how does child abuse affect the personal development of the
child ? ( 10 points )

On my opinion, child abuse would have a big effect to the personal


development of the child. The abused child might adapt the personality of the
person who abused her/him and will do the same to other child in the future.
It would also cause a trauma to a child who experienced the abused cruelty at
a young age. He/She might have negative personality as he grow older. Some
might loss self-confidence and want always want to be alone.

2.Explain the purpose of RA 7610 .( 5 points )

This Act provides for stronger deterrence and special protection against child
abuse, exploitation and discrimination. It is divided into 13 Articles and 36
sections. Article II establishes a program on child abuse, discrimination and
exploitation. Article III, IV, V and VI prohibit trafficking in children, the use of
children for obscene publications and indecent shows, child prostitution,
sexual abuse, and other acts of neglect, cruelty, abuse and exploitation that are
prejudicial to the child's development. Article VII provides sanctions for
establishments or enterprises associated with the above, including their
closure for at least one year. Article VIII regulates the employment of children
under the age of 15. Articles IX and X protect children of indigenous cultural
communities, and children in situations of armed conflict. Articles XI and XII
provide remedial procedures and penalties.

3.Give one big possible key towards elimination of child abuse . Support your

Try to understand your children. Learn how kids behave and what they can
and can’t do at different ages. Have realistic expectations and be responsible if
children fall short. Get control of yourself before disciplining a child. Set clear
rules so the child knows what to expect. Avoid physical punishment.

On this particular module, RA 7610 (Special Protection of Children against


Child Abuse, Exploitation and Discrimination, I have learned so much about it. It is
the policy of the State to provide special protection to children from all forms of
abuse, neglect, cruelty, exploitation and discrimination, and other conditions,
prejudicial to their development; provide sanctions for their commission and carry
out a program for prevention and deterrence of and crisis intervention in situations
of child abuse, exploitation and discrimination. The aforesaid child shall subject to
visitation and supervision by a representative of the Department of Social Welfare
and Development or any duly-licensed agency or such other officer as the court may
designate subject to such conditions as it may prescribe. The aforesaid child whose
sentence is suspended can appeal from the order of the court in the same manner as
appeals in criminal cases.

depression and affect her work environement.

Direction : Answer and explain the question provided below .

1. What is protection order under VAWC act? (10 points )

A protection order is an order issued under this act for the purpose of
preventing further acts of violence against a woman or her child specified in
Section 5 of this Act and granting other necessary relief. The relief granted
under a protection order serve the purpose of safeguarding the victim from
further harm, minimizing any disruption in the victim’s daily life, and
facilitating the opportunity and ability of the victim to independently regain
control over her life. The provisions of the protection order shall be enforced
by law enforcements agencies. The protection order (BPO), temporary
protection order (TPO) and permanent protection order (PPO).

2. What is the so called “ Battered Woman Syndrome “ under VAWC act?( 10


points )

Battered Woman Syndrome is refers to an scientifically defined pattern of


psychological and behavioral symptoms found in women living in battering
relationships as a result of cumulative abuse. A victim who is suffering from
battered woman syndrome shall not be disqualified from having custody of
her children. In no case shall custody of minor children be given to the
perpetrator of a woman who is suffering from Battered woman syndrome.

On this particular module, RA 9262 – (Anti-violence Against Women and Their


Children), I have learned so much about it. It refers to any act or a series of acts
committed by any person against a woman who is his wife, former wife, or against a
woman with whom the person has or had a sexual or dating relationship, or with
whom he has a common child, or against her child whether legitimate or
illegitimate, within or without the family abode, which result in or is likely to result
in physical, sexual, psychological harm or suffering, or economic abuse including
threats of such acts, battery, assault, coercion, harassment or arbitrary deprivation
of liberty. If the respondents appear without counsel on the date of the hearing on
the PPO, the court shall appoint a lawyer for the respondent and immediately
proceed with the hearing. In cases the respondent fails to appear despite proper
notice, the court shall allow ex parte presentation of the evidence by the applicant
and render judgment on the basis of the evidence presented. The woman victim of
violence shall be entitled to the custody and support of her child/children. Children
below seven (7) years old older but with mental or physical disabilities shall
automatically be given to the mother, with right to support, unless the court finds
compelling reasons to order otherwise.
