Hague Conference on Private International Law (HCCH)


Is an intergovernmental organization in the field of international private law, which administers several
international conventions, protocols and soft law instruments. The Hague conference was first organized
by Tobias Asser in 1893 in The Hague. In 1911, Asser received the Nobel Peace Prize for his work in the
field of international private law, and in particular for his achievements with respect to the HCCH. After
World War II, the Hague Conference was founded as an international organization.
HCCH's First Diplomatic Session was held in 1893. Its aim was, and remains, to "work for the
progressive unification of the rule of international private law", including by creating, and assisting in the
implementation of, multilateral conventions promoting the harmonization of the rules and principles of
private international law (or legal conflicts).

They produced a number of multilateral treaties, the Hague Convention, which brings together the rule of
private international law in the areas of Marriage (1902), Divorce (1902), Guardianship (1902), Civil
Procedure (1905), Effect of Marriage (1905), and Deprivation of Civil Rights ( 1905)

After World War I, diplomatic sessions were held again and produced a Protocol to recognize the
competence of the International Permanent Court to interpret the Hague Convention on Private
International Law.
After World War II there was an attempt to make the HCCH an intergovernmental organization and at the
seventh diplomatic session the Agreement on the creation of the HCCH, "The Hague Statute Conference
on Private International Law", and the HCCH acted through a number of regulatory bodies, which were
established under the Statute.
The General Affairs and Policy Council is composed of all Members. It is in charge of HCCH operations
and its meetings are currently held annually. Through the HCCH secretariat, the Permanent Bureau, the
General Affairs and Policy Council ensures this operation, including by establishing the HCCH work
program.
The Diplomatic Council of Representatives, consisting of all Member States, is the highest financial and
budget authority of the Conference and exercises oversight of the financial administration of the
Conference.
Other bodies include the Committee for the Standing Government of the Netherlands (instituted by a
decision of 20 February 1897 with a view to promoting the codification of private international law), the
Special Commission, and the Diplomatic Session.
As for now, the members of HCCH consist of 84 countries. Since 1955, the HCCH has developed 38
international conventions and protocols that establish rules on jurisdiction, applicable law, recognition
and enforcement of foreign decisions, and on legal and judicial cooperation. The HCCH Convention
covers subjects in the areas of family law and child protection, international civil procedure and legal
cooperation
