A RESOLUTION ADOPTING THE NATIONAL PRIVACY COMMISSION ADVISORY NO.

2020-04,
DATED NOVERBER 16, 2020, “PRESCRIBING GUIDELINES ON THE USE OF CLOSED-CIRCUIT
TELEVISION (CCTV) SYSTEMS”

WHEREAS, to ensure the lawful processing of personal data in the use of closed-circuit
television (CCTV) systems, the Philippine National Privacy Commission (NPC) released on
November 2020, Advisory No. 2020-04 which prescribes guidelines on the use of Closed-Circuit
Television (CCTV) Systems;

WHEREAS, the Advisory guides personal information controllers (PICs) and personal
information processors (PIPs) in the processing of personal data via CCTV systems used in
public or semi-public places, as well as in responding to requests by the data subject or by third
parties for disclosure of CCTV footage;

WHEREAS, the same advisory applies to CCTV systems with either video or audio
capabilities or those which only records videos, however, lawful surveillance conducted by law
enforcement agencies and other government agencies, are not covered by this Advisory;

WHEREAS, it confirms that the use CCTV systems, including the capture, use, retention,
disclosure, and destruction of video and/or audio footage, is required to comply with the Data
Privacy Act, its Implementing Rules and Regulations, and the relevant issuances of the National
Privacy Commission which the said data processing is subject to the general principles of
legitimacy of purpose, proportionality and transparency;

WHEREAS, in sum, actions to be considered that clients are advised to strictly comply
with the foregoing Advisory to prevent any data privacy and security issues arising from the use
of CCTV systems, as well as to retain the trust of its clients and employees. Clients which
currently have or are intending to use CCTV systems are advise to implement the security
measures listed in the Advisory for CCTV operations, including the conduct of a Privacy Impact
Assessment (PIA), which considers the principles of lawful data processing in their CCTV
operations. Conspicuous CCTV notices, as required as well as an access request policy which
states the forms, requirements, and procedures for data subject/third party requests for
access/copy of footage, should all be in place for any and all CCTV operations of the company;

WHEREAS, this piece of legislation would serve as implementing guidelines on both


private and public owned CCTV systems, pending the enactment of the proposed ordinance
requiring the installation of CCTV system in certain business establishment including
government institutions and facilities in this municipality;

NOW THEREFORE, on motion of Honorable Salvador B. Jordan, duly seconded, the


Sangguniang Bayan of Sta. Magdalena, Sorsogon, in session assembled;
RESOLVES, as it is hereby RESOLVED to adopt the National Privacy Commission Advisory
No. 2020-04, dated November 16, 2020, prescribing Guidelines on the Use of Closed-Circuit
Television (CCTV) Systems, attached as Annex “A” and made an integral part hereof.

RESOLVED FURTHER, that copies of this resolution be furnished to the Office of the
Municipal Mayor, Municipal Police Station, Office of the Municipal Disaster Risk Reduction and
Management, Public Safety Office and other concerned offices for their information and
immediate dissemination.
