Suspensive condition
I will give you 1M if you pass ObliCon.
Until the semester is still on going, there is no obligation
yet to give 1M. There is expectation. There are rights of
the creditor before fulfillment of suspensive condition.
Example of reciprocal obligation – contract of
sale/lease. The fruits and interests are deemed to have
been mutually compensated.
In unilateral obligations – the fruits are to be kept by
the debtor.
Mahalagang iparegister ang right, kasi if merong buyer
in good faith, the latter’s right will be given.
Potestative (debtor) + suspensive condition = Void
because fulfillment of the condition depends upon the
mercy of the debtor.
Why valid if creditor? Because naturally, he is interest in
the fulfillment of such.

Positive Obligation
A obligates himself to give B 1M if A will marry before
he reaches the age of 30. – Valid because it is not solely
dependent on the sole will of the debtor because it also
depends on a third person.
If nagpakasal si A exactly on the 30th birthday. -
Obligation is extinguished.
Before reaching the age of 30, A dies. – Obligation is
extinguished.
A obliged himself to give B 1M pesos if he gets married
at the age of 25. On 21st birthday of A, pumasok sya sa
seminary. Is this extinguished? No. It is still possible.
Pwede naman sya lumabas eh.
A will give B 1M pesos if A will not get married before
the age of 25.
Pumasok si A ng seminary. – It is still possible that he
marries before the age of 25.

A dies at the age of 23? Obligation is effective and

binding because A’s marriage is rendered impossible.
