The National Wages and Productivity


Commission (NWPC) and the Regional
Tripartite Wages and Productivity Boards
(RTWPBs) were created on July 1, 1989
with the enactment by the Philippine
Congress of Republic Act 6727, also known
as the “Wage Rationalization Act.”

Significance of the Law

•The law is a landmark piece of labor an


d social legislation that recognizes for t
he first time domestic workers as simila
r to those in the formal sector.
•It strengthens respect, protection and
promotion of the rights and welfare of
domestic workers or kasambahay.

Definition of Kasambahay

Refers to any person


engaged in domestic work,
whether on a live-in or live-
out arrangement, working
within an employment
relationship.

Employable Age for Kasambahay
Employable age:
 Fifteen (15) years old and above
Conditions for employment of children 15 years old but
below 18 years of age:
1. Not allowed to work for more than 8hrs/day, &
beyond 40hrs/week
2. Not allowed to work between 10 pm & 6 am
3. Not allowed to do hazardous work
4. Not be denied access to education and training

Hiring of Kasambahay

 Direct Hiring
 Private employment agencies (PEA)

Pre-employment requirements
 Medical or health certificate issued by a local
government health officer
 Barangay and police clearance
 NBI clearance
 Authenticated birth certificate, voter’s
identification card, baptismal record, or passport
showing the kasambahay’s age.

NOTE: The cost shall be paid by the prospective


employer or PEA

Employment contract

 Must be written and in language


understood by employer and
kasambahay
 If Kasambahay is below 18 yrs. old,
contract shall be signed by parent or
guardian
 Upon request, Punong Barangay shall
read and explain contents of contract

Mandatory benefits
• Monthly minimum wage
• Daily rest period of 8 hours
• Weekly rest period
• 5 days annual SIL with pay (after 1 year of service)
• 13th month pay (after 1 month of service)
• SSS, PhilHealth and Pag-IBIG benefits (after 1 month of
service)

Rights of Kasambahay
• Freedom from employer’s interference in wage disposal;
• Standard of treatment;
• Board, lodging, and medical attendance;
• Right to privacy;
• Access to outside communication;
• Access to education and training;
• Right to be provided a copy of the employment contract;
• Right to Certificate of Employment;
• Right to form, join, or assist labor organization;
• Right to terminate employment based on just cause; and
• Right to exercise religious beliefs and cultural practices.

Payment of Wages

• In cash, at least once a month

• No payment by promissory note, voucher, coupon,


token, ticket, chit or anything other than cash
• Provide Kasambahay with PAYSLIP every pay day
containing the amount paid and all deductions
made, if any

Functions/Duties of Wage Board:

After one (1) year from the effectivity of this Act,


and periodically thereafter, the Regional
Tripartite and Productivity Wage Boards
(RTPWBs) shall review, and if proper, determine
and adjust the minimum wage rates of domestic
workers.
