A housekeeping personnel of ABC Hotel was approached by her former HS classmate asking her
to help him bug a room in the hotel she is working for because he believes that his wife is staying
there with another man and he has personal knowledge where they were staying as he followed
them inconspicuously for several days, he wants to have proof of the illicit affair so he can used
it to file a case in court.
If the housekeeping personnel helps her former HS classmate for free because she too
experienced the same betrayal previously and she feels a strong affinity with her former
classmate because of it, would she be considered violating RA 4200 or the Anti-Wire Tapping
Act?
Would your answer be the same, if she agreed to help his former classmate for a fee?
Instead of a jilted husband, a government representative ask for the hotel personnel’s assistance
to wiretap a room in the hotel to intercept or record private conversations because the person
believes that the guests of the room is plotting a murder, would the personnel be liable under RA
4200?
Would your answer be the same, if the reason for the request is a belief that the guests’
conversations are for the purpose of committing rebellion?

If the Housekeeping personnel accept the request of her former classmate in bugging a room
even with or without a fee she is still considered violating the RA 4200 or the Anti- Wire
Tapping Act which means it is unlawful “for any person, not being authorized by all parties to
any private communication or spoken word, to tap any wire or cable.” Hence helping her former
classmate bugging a hotel room which is a private space between the guests is a big offense that
violates the Anti-Wire Tapping Law which may cause her own job and worse a lawsuit from the
parties involved. Moreover, it is also the same case in terms of when a government
representative asks for her cooperation to be involved in suspecting a rebellion or plotting a
murder without any legal paper to present such as a court warrant or court order to authorize
wiretapping a room is against the law
