Regulatory Statement
Food Chemicals Codex (FCC) & Generally Recognized As Safe (GRAS)

Products produced by Imerys’ diatomaceous earth and perlite facilities1 in North America meet the
requirements of the Food Chemicals Codex (FCC). The warranty is printed on each bag with the
words "Food Chemicals Codex grade", which warrants that the product meets federal and
internationally recognized standards of purity and manufacturing. Imerys’ policy describes how we
continue to improve our level of compliance to meet the Food Chemicals Codex requirements for
good manufacturing practices (GMP) and purity. The monograph properties and limits from the
current FCC edition for diatomaceous earth (DE) and perlite are reported in the table below:

The Food and Drug Administration considers the use of diatomaceous earth and perlite of suitable
purity to be G.R.A.S. (Generally Recognized As Safe) for certain applications. Suitable purity is
warranted by adherence to the relevant FCC monograph.

Imerys’ standard product inspection and testing procedures are used to release product for shipment.
Imerys represents and warrants that all products conform in all material respects to Imerys’ product
specifications in effect at the time of shipment. Imerys can not make any claim of fitness for a
particular use.

shipped from Imerys; to the extent the product supplied to a customer is combined with other products or processed or altered
in any way after shipment from Imerys, the above certification is limited by such alterations.

The certification provided herein is a continuing one as to the product provided to your company for the term of Imerys’ written
agreement with your company or, in the absence of such an agreement, for a period of one year from the date hereof,
renewable annually by Imerys upon your request.

This letter replaces and supersedes any certification or guarantee provided previously by Imerys to your company (or a
predecessor), provided however, that this letter is a supplement to the terms set forth in any written agreement between Imerys
and your company.
