I Mwanafuraha Msuya, a Labour Officer dully appointed under section 43 of the


Labour Institutions Act, Cap. 300 R.E. 2019 exercising powers conferred upon me by
the provisions of section 45 of the Act; do hereby order you to comply with the
following:

1. To prepare and issue employment contract to all of your employees by


considering the dates of joining the company and save them copies of the
same as per section 14 and 15(1) of the employment and labour relations Act,
[Cap. 366 R.E 2019] and Rule 11 of the Government Notice No.47, The
Employment and Labour Relations (General) Regulations, 2017.

2. To register ten (10) employees to the National Social Security Scheme (NSSF)
and submit the contributions of 10% from their gross salaries for each
employee and 10% from yours, as required by NSSF Act of 2018 The same
list as attached.

3. To pay the employee double the employee’s basic wage for each hour worked
on the public holiday and weekly rest day as provided for under section 24(4)
and 25 of the Employment and Labour Relations Act, Cap. 366 R.E. 2019
respectively.

4. To provide written statement of particulars of payment (Salary Slip) to every


employee each month after completion of payment of remuneration as
provided under section 27(2) of the Employment and Labour Relations Act
Cap. 366 R.E. 2019.
5. To display employees’ rights in a conspicuous place as per provision of section
16 of the Act Cap. 366 R.E. 2019.

6. To prepare and implement a plan to promote equal opportunity and eliminate


discrimination in the workplace as per provision of section 7(1) and (2) of the
Employment and Labour Relations Act Cap. 366 R.E. 2019 together with
Rules 28,29, 30 ,31, 32, 33, 34,35.36 and 37 of the Government Notice No.42,
The Employment and Labour Relations (General) Regulations, 2017.

7. To prepare and implement a work place policy on HIV and AIDS accompanied
by guidelines concerning implementation of that policy as per provision of
section 7(1) and (2) of the Employment and Labour Relations Act Cap. 366
R.E. 2019 together with Rules 20 of the Government Notice No.42, The
Employment
and Labour Relations (General) Regulations, 2017.

8. To pay unpaid renumeration (arrears) to ten (10) employees as prescribed on


the attachment sheet marked as “Annexure A” forming part of this order and as
required by section 27(1) of the Employment and Labour Relations Act Cap.
366 R.E. 2019.

Further, you are directed to ensure that measures to rectify the anomalies, be
taken within thirty (30) days from the date you are in receipt of this order.
