This is a guide on how to e-file your Chambering Petition (Borang 1,2 and Borang 3,4,5) for all states
in Malaysia (except Sabah & Sarawak). This guide is last updated on 16.06.2021 (18th Revision /
Update).

The latest updates are in regard to filing of (unaffirmed but signed) Affidavits and also how to
check Short Call Results online at the EFS system instead of going to Court, in light of MCO 3.0
(“FMCO”). Take note that only Klang Valley Pupils can check their Short Call Results Online at
the EFS system without going to RKKK Office / Short Call Hearings. 

A) Note that while the country is in FMCO – In regard to affirmation of affidavits (be it any Borangs
or Affidavits of Service, no Commissioner of Oath will be operating. As such in accordance to latest
information from RKKK (verbally) and Arahan Ketua Hakim Negara Bil. 8 Tahun 2021:

i) Pupils can e-file signed but unaffirmed affidavits, subject to them also attaching a Letter of Un‐
dertaking / Promise stating that they will e-file the affirmed affidavit(s) after the FMCO is lifted or
after Commissioner of Oaths are allowed to operate again. 

ii) As to how to draft the said Letter, a simple Letter would do, and as such I won’t be providing a
sample here. 

B) In regard to the updates to the Guide on how to check your Short Call Results Online at the EFS

Introduction

When I graduated from CLP, I posed a question to myself, as to what can I do to be practice-ready
and ultimately help my prospective firm to handle their matters later on with more efficiency when
I’m commencing pupillage. Back then I somehow realised that EFS (E-Filing System) is going to be an
important tool that I would need to familiarise myself for a lot of matters. It may seem like a menial
task to some, especially when you have clerks to do the e-filings for you, but be very assured that
proper e-filing skills is essential to every lawyers. I’m currently practicing as a Legal Associate, and
had never regretted taking up this compulsory skill.

I learnt the basics of the system (of which I shall pass my skills down to you now), from how to log‐
ging in, how to e-file, what is a MPKI token used for, finding tickets, uploading files and making pay‐
ments and so on.

Even to the most tech savvy people, let alone people who are unwary of the existence of an e-filing
system, would find using the EFS quite daunting the first time around. I was lucky to have Mr Justin
Ong (my master), Ms.Lim Yin Faye (technically also my master in the firm) and Kak Ema the clerk to
help me through the process.

The purpose of this Article is to guide you on how to file your Pupilage Forms or Borangs correctly
and get Short Called correctly. I promise you that if you have read the whole guide step by step, you
will get short called safely, like all the thousands of pupils before you who read this article as their
bible guide.

This guide will be extremely helpful to new chambering students and final year law students who
want to be ready even before their pupillage, as well as anyone who wants to know how to use the
eFiling system.You don’t have to read this guide in one go. You can always reread this guide after
you have completed each step.

And yes, law schools don’t teach us how to use the efiling system.

Now to why you are here, to e-file your papers correctly and hopefully get short called within 2
months without any major problems. There are a lot of pupils who fail to get this right in one go,
therefore this guide aims to help you to not be one of them.

Pupils chambering in bigger firms sometimes won’t even have to deal with the matter as they would
have special personnels/clerks to assist them in the matter. The process used to be simpler back then
before 1st January 2018. You would just go to court, and the RKKK (Rayuan Kuasa-Kuasa Khas) Divi‐
sion, which are the main division handling pupilage matters and admission of Advocates & Solicitors
to the High Court of Malaya, would guide you through the process.    Starting 1st January 2018, all
pupilage files are to be e-filed to the EFS.

(Notification from the KL Bar that states that all pupilage forms are to be-efiled starting 1st January

DISCLAIMER: I won’t be responsible for any MISTAKES or any problems that you face for the
filings of your pupilage forms. If there are any serious problems with your pupilage filings, you
should always consult the RKKK. Notwithstanding that, you can always contact me for help. Do not
fear, help is near.

As long as you do all the steps correctly, there shouldn’t be a problem to not getting your short call
postponed. You want to get that PSP- Perintah Seperti Dipohon (which means your Short Call is suc‐
cessful) with minimum hassle.

Update 08.06.2020: Due to MCO caused by Covid-19, there are many backlogs of short-calls being
processed or “queued”. There may be slight delays, but the overall process remains unchanged.

Few Basic Tips before we proceed to the guide:

RKKK (Rayuan Dan Kuasa-Kuasa Khas)

1. Please prepare and TRIPLE check all your documents before filing anything. The same goes to all
your Law Firm’s files, not just your pupilage files.
2. Please speak politely with the RKKK people whenever you have to call them. From my experience
and that of many other pupils, the RKKK are actually a nice and reliable bunch. RKKK Direct

Filling in your pupilage forms and other essential tools/guide

1. To fill in your forms, please download the guide on how to fill in your forms below. This guide is
available at KL Bar website, and the link can be found in Step 1 below. It gives you thorough guid‐
ance on how to fill in the forms, which I find extremely help. Throughout this tutorial, you will
need to refer to this very often.
2. I also include the link to the pupillage handbook by kl bar, which is useful as it explains to you the
important details for pupillage and also it shows you the draft of Affidavit of Service (hereafter re‐
ferred to as AOS) and also your fair order and draft order (which I shall explain what they are
later.
3. Clean set of pupilage forms (Borang 1-8). You can Google it and download from any source you
find, or alternatively download it from the link provided below in Step 1.

With these 2 mentalities and 3 documents in hand, you are ready to start!

Forms that are relevant for your short call are B1+B2, and B3+B4+B5. Notice how I group these 5
firms into 2? It’s because they should be filed as 2 separate sets at the eFiling systems, and require two
separate Afidavits of Service for each of the 2 sets.

NOW LETS BEGIN!

Step 0: Knowing what’s the basics of Malaysian E-Filing System.

Q: Weera, so how do I access the eFiling system and efile my papers?

A: We access the eFiling system by going to https://efs.kehakiman.gov.my/efsweb/

Ask for your firm’s login id and password. Usually in smaller firms there would be 1 or 2 designated
computer for eFiling (because they are equipped with MPKI token and software). We can always ac‐
cess the eFiling system from any device with an internet connection, meaning we can always check
for status of the files and extract documents from our smartphones.

But without the MPKI token (basically a USB drive which enables the MPKI system to be activated),
you WON’T be able to upload/efile your documents.

Important Update on the MPKI Token!!

As of 14.2.2020 onward, MPKI will be replaced with MyTrust ID Desktop agent, i.e. another new
signing solution for lawyers (roaming certificate). Fret not, your firm’s MPKI Token can still be used
until 14.7.2020, after which all signing solution on the documents to be filed on E-filing, will be via
roaming certificate. Your firm should be equipped by then.

(Login by keying in your firm’s username and password on the top right corner, at “Log Masuk”)

Please be careful in efiling your documents and remember to double check the documents that you
have uploaded. Few minor mistakes in you Borangs can be fixed by merely filing in an Afidavit Pem‐
betulan. However, more fatal mistakes such as efiling your Borangs under the wrong heading or pay‐
ing the incorrect amount would result in your Borang 1 & 2 to be rejected.

To cure this, you would sometimes be asked to refile your papers (there goes your RM192!), or some‐
times go through the hassle of filing in a Notice of Application + Affidavit in Support to fix your mis‐
takes. Therefore, please try your best to avoid these mistakes. DO NOT trust your efiling clerks, as
they sometimes tend to do mistakes. It is best that you do this yourself, preferably guided by
someone or with a second checking eye.

Please ensure for the Purposes of Filing your Borang 1, Affidavit, and Borang 2, that you pay a total
amount of RM192 and nothing less than that.

You can always call or text me in cases of uncertainties on how to go about efiling (but make sure you
read the whole guide first!).

Q: Weera, why couldn’t my file upload?

A: When this happens, it’s most likely because you didn’t activate the MPKI system after starting the
computer. All you have to do is go to your desktop and click the MPKI application (Its Orange in Col‐
our) and click YES when prompted. Voila!

reboot a computer! If not the file won’t be uploaded).

Remember, always activate the MPKI system once your start your eFiling computer.

Also, remember to scan your documents in PDF format, not exceeding 20MB for each file.

Now,

For the purposes of Borang 1&2 including the Affidavit (Second Page of your Borang 1), fill in your
forms as shown in the Tutorial Forms. Ensure every detail is correct and in order. Any amendments
would cost you alot time and cost (either through refiling or by filing in an Afidavit Pembetulan). Get
it affirmed with the Commissioner of Oath.

IMPORTANT: I was told that the filing date and affirmation date must be THE SAME. So please en‐
sure your filing date is the same as your affirmation date as stated in your borang 1, 2 and affidavit
verifying petition!

You can type in the forms using printer or hand.

Then, prepare the following supporting documents and make sure they are acknowledged true copy
(request for the Lawyers in your firm to do this for you) :

1) CLP/BPTC cert (If you are graduate from a Foreign University)

2) LLB cert

3) Front and Back of IC (preferably coloured)

4) Birth Certificate

5) Masters Profile (Key in your master’s name at the Malaysian Bar directory)

-Scan these files together with your Borang 1 into 1 file.You can also scan the certs in Borang 2.

-Then, scan the affidavit verifying petition (second page of Borang 1).

-Finally, scan your Borang 2.

Note that now there are 3 sets of separate scanned files? This is very important because there are 3
types of files that would have to be e-filed into the EFS.

When uploading the files, make sure you get the bill amount of RM192. ANYTHING less than this,
that means you are doing it WRONG and it would be troublesome to correct this. You would have to
spend RM192 again just to refile and/or takes up a lot of time.

Now, log in to the EFS system. Click Pemfailan Baru, and fill in your details. For KL and Selangor Pu‐
pils, all your forms will be filed under the RKKK of KL High Court. For Pupils of other states, your
B1B2 and Afidavit would first be Efiled under the RKKK of the KL High Court. Therefore at this junc‐
ture, the steps would be similar for everyone.

After keying in your details at Pemfailan Baru, you will directed to the document upload page.

Click “muat naik dokumen” . For B1, scroll down the “pilih jenis dokumen tab” till you find Borang
1 or the type of files you want to upload. Then upload your scannned documents, by clicking “pilih”
button below. Then click “tambah“. ALL documents uploaded must be in PDF Format.

Efile your PDF Documents under the correct Document Type

Remember when I talked about the eToken/MPKI token? This is where it comes into play. You will be
prompted to key in the password when uploading the file. Key in the password, then after that is
done, proceed to do the same for your Afidavit Verifying Petition, this time filing it under Afidavit.
(Update as of 14.02.2020: The Log In System now does not require signing in, but apart from that the
process is rather similar).

Finally, Borang 2 under Borang 2 option. Finally, ensure that you get the bill amount of RM 192, fol‐
lowing the breakdown below:

1. B1+Supporting Documents=RM160
2. Afidavit=RM16
3. B2=RM16

Total =RM192.00

(Important: Please make sure you get the total amount of RM192, if you do not, your application
will be rejected!)

Click “tambah ke dalam senarai“

Finally, click “simpan to peti fail“. Your files will then be kept in the peti fail, awaiting payment.
PLEASE note, that without making payments, any files that you uploaded won’t be deemed to be
efiled. These applies to every other files you uploaded and plan to efile in the EFS.

Now, make payment by going to peti fail, and clicking the money symbol. Procees to make payment
as if you’re buying stuff from Lazada / Shopee! (No I wasn’t sponsored by them either). Usually you
would have to pay first and then claim from the firm, that is if they agree to bear the cost of your pu‐
pilage costs of course. So make sure you have enough money in your bank account.

By now, after payment is made, you can check the status of your forms at the main page. Click on
your case, and take down your petition number. Eventually and within a day, your application status
will be “Diluluskan”, which means you have successfully filed your papers correctly! Do not panic if
your application states “Diluluskan Separa“, as that means that it is only the matter of time before it is
fully approved.

Keep tabs on the status of your documents. They are usually processed within 1 working day

If your application states “Ditolak“, there is something wrong with your application. Contact RKKK
immediately to ask what went wrong. Usually, the RKKK will call you to inform you about your
fuck-ups, and so will the Malaysian Bar or KL Bar. If there isn’t any calls and your Borangs are ap‐
proved, that means you have been closely following this article.

By now, you would have your petition number, as seen in the picture above, immediately after you
have efiled your Borangs.  Now you can proceed to fill in your Petition Number to all your physical
forms.

After all your papers have been approved, make 4 copies of it (with the petition number filled) (1
copy to Malaysian Bar, 1 to your State Bar and 1 to AGC Chambers at Putrajaya). The last copy is the
acknowledgement copy, where it is a basically the same copy of everything you serve, but now is
used to collect acknowledgement chops on the back page. You can also send 3 separate cover letter,
one for yourself and one for the recipient (always do this!), and get back the acknowledgement copy
of the cover letter which containts the chops.

Pro Tip: 

After your Borang 1 & 2 have been efiled and the status has changed to “Diluluskan”, you can imme‐
diately proceed to file your Borang 3 4 & 5 within the next few days after you B1B2 status have been
changed to “Diluluskan“ (refer to Step 3), without first filing the Affidavit of Service (hereafter re‐
ferred to as “AOS“) of Borang 1 & 2. You can serve the Borang 1 & 2 and Borang 3 4 & 5 one shot, and
thereafter make two separate AOS for Borang 1 & 2 and Borang 3 4 & 5 respectively.

(VERY IMPORTANT: Please note that the Intitulement and Section in Your Borang 1 & 2 and Bor‐
ang 3 4 & 5 AOS are different. There must be 2 separate AOS, 1 for Borang 1 & 2 and one for Bor‐
ang 3 4 & 5. DO NOT FILE ONLY ONE AOS for them! In Borang 3 4 5, your Master is the Applic‐
ant / Pemohon, as opposed to Borang 1 & 2 which you are the Petitioner / Pempetisyen. The sec‐
tions cited are also DIFFERENT. In Borang 1 & 2, the correct Section to be cited are s.10 s.15 while
in Borang 3 4 & 5, the correct Section to be cited are s.36 (2)(a) & (b). If you make this mistake, your
Short Call will be postponed, until the next 2 weeks and you will then need to refile the corrected
AOS again and wait for 2 weeks for the next Short Call. Please do not hesitate to ask me for my
sample AOS, rather than you making silly and costly mistakes like this.)

By the end of the day, you would have 2 or more Acknowledgement Chops, either at the cover letter
or the back of your acknowledgement copy. This is important as you would need to exhibit the ac‐
knowledgement copies / acknowledged cover letter with the chops in your AOS / Afidavit Penyam‐
paian, which is the next thing you need to prepare.

For Pupils outside of KL/Selangor, you would be serving your Papers through Pos Laju / A.R Re‐
gistered Post to the AGC or Malaysian Bar. Therefore, you can get your acknowledgement by exhibit‐
ing the Tracking Number or the A.R Registered Post Card that is returned to you, which will contain
the Acknowledgement Chops. 

Next, wait for about 1 working day. Ensure that your file/document’s status are listed as “DILU‐
LUSKAN“.

Serving the 32 copies of Borang 2 to RKKK ASAP (Extremely Important)

Once all 3 files are approved, proceed to make 32 copies (16 sets of Borang 2) and serve it to RKKK.
Once you or your dispatch personnel served the papers, remember to get an acknowledgment chop
on your acknowledgement copy.  The RKKK officers would then ask you or your dispatch personnel
to write your details in a Red Book for their record.

I can’t stress the importance to Pupils who have just started out to serve the 32 copies of Borang 2 to
the RKKK  AS SOON AS POSSIBLE, either through despatch, courier, or by yourself preferably
within 2-4 weeks after you have filed your Borang 1 & 2. If you do not do this, this will HAUNT YOU
FOREVER when the time comes for you to get your Sijil Penampalan for the purposes of filing your
Long Call Papers (Borang 6 7 8). If you serve your Borang 2 too late, the Penghantar Notis of the
Court would not have enough time to serve your Borang 2 on time and provide you the AOS. As a
result, you will be told to wait for around 1 week to 1 month or more, depending on the situation,
which will ultimately cause your filing of long call papers and your long call to be delayed. This is
due to the fact that your Sijil Penampalan is one of the exhibits that is needed to be exhibited under
Borang 6.

This document (Sijil Penampalan) is EXTREMELY important as it is one of the exhibits needed to be
filed under Borang 6. You cannot proceed to efile your Borang 6 if you don’t have this document /
could not produce the extracted copy of the Sijil Penampalan.

Therefore, remember to serve the 32 copies of Borang 2 as soon as possible. Remember to fill in the
Red Log Book when you are there to serve the 32 copies of Borang 2, or ask your despatch to do it
for you. If you are chambering outside of KL and had to use delivery / courier services, call RKKK
to ensure that they have received it safely and that the receipt of the 32 copies is confirmed.

Step 2: Service of B1&2 and/or B 3 4 & 5 and Drafting & Efiling of your Affidavit of Service (AOS) 
(Can also be done after completing Step 3 which is to efile your B 3 4 & 5 first)

In the course of your practice, you would come by a common cause paper called an Affidavit of Ser‐
vice / Afidavit Penyampaian. An AOS is basically an Affidavit (a sworn Statement by a deponent),
stating/swearing that you have served a particular document to a particular party at what place and
what time. The Deponent of the Affidavit is usually the sender of the documents, which may be you
or your despatch. If your despatch is the one who serves the documents, he is the Deponent of the
Affidavit, not you. In that case, he would be the one to see the Commissioner of Oath and Affirm the
Affidavit and its exhibits.

(Update as contributed by Lee Ching Yang): Selangor pupils need to submit their borang 1& 2 by them‐
selves to Selangor Bar, and then the Secretary will spend some 15min to explain all the troublesome procedures
to you, and the referee form will be given to you at that point of time.

2) If you send a despatch to serve your B1B2, your forms won’t accepted and they won’t acknowledge
service.

Drafting an AOS is extremely simple and easy. That being, an AOS is extremely important in your
course of law practice and for your case, for you to get Short Called. YOU MUST always remember
to Efile your AOS, if not it would be good as nothing. You do not need to serve an AOS.

Once you have served the documents to the 3 bodies, draft your Affidavit of Service. A sample of this
can be found in the Pupilage Handbook in Lampiran J, which I included in the link here

you really mess up your drafting of AOS and as a result and your short call gets delayed because of it,
you can contact me personally to get my draft.

Remember to name your Sijil Perakuan Ekshibit (or noobs will call it, cover page of exhibits)  of your
AOS correctly, AND CITE THE SECTIONS CORRECTLY AS STATED IN THE SAMPLE. I can’t
stress this enough, but the most common reason why Pupil’s short call get delayed is because they
did not cite the sections used in the AOS correctly.  (For b1 and b2, the section is Section 10 & 15 of
the LPA) (Whereas for b345, the section is Section 36 of the LPA).

(Alternatively, you can efile B345 first, so that you can serve B12345 in one shot.)

Then, proceed to efile your AOS of B1. The efiling of AOS is RM16. Same method as mentioned be‐
fore. But this time around, instead of clicking “Pemfailan Baru“, you click “Pemfailan Kes Sedia Ada“.

This would allow you to add/efile documents to a particular case/petition. This goes the same for all
your court files. Key in your case number, and then tick “pempetisyen” as you are adding the docu‐
ment as a petitioner. There is no need to key in the respondent / or third party in this case.

would either choose to efile on behalf of the Defendant/Plaintif or Petitioner/Respondent. DO NOT
upload documents as the wrong party!

Finally, repeat the steps before. Scroll down to Afidavit Penyampaian, and upload your document. Key
In your MPKI password, click “simpan ke peti fail”, and go to peti fail to make payment.

Step 3: Borang 3, 4, 5 (B345) (FOR KL & SELANGOR PUPILS)

Your Borang 3,4,5 is usually filed within 2-14 days after filing of b12. Like B1B2, B345 have to be efiled
together in one shot, not separately.

Your Borang 3 is special, as it is the only form out of B12345, that can be extracted. Extraction means
that you will need to download a sealed copy of a document. After your B3 is sealed, you will get to
know your short call date.

Now, before efiling, repeat the steps before. Fill in your Borang 3,4, and 5 according to the tutorial
forms. Then, proceed to efile them under kes sedia. Remember to scroll down to Borang 3 to upload
your Borang 3, and scroll down to Borang 4 to upload your Borang 4 and scroll down to Borang 5 to
upload Borang 5. Remember to efile all 3 files (B345).

For Pupils other than the State of KL and Selangor (PG,JOHOR,PERAK etc),  you would have to
Efile your B345 under pemfailan baru, and pay the amount of around RM192 again (sorry folks!). Re‐
member that your Borang 3 is DIFFERENT. You would use a Saman Pemula instead of a Saman
Dalam Kamar. Please get the relevant forms from your State Bar or seniors. You can refer to the pic be‐
low on how to fill in few of the details (The parts which are censored are self explanatory).

For Penang Pupils. The same principle format would apply for other
states. Leave the Saman Pemula blank. Kindly fill in the censored
parts accordingly. All of the other relevant parts will be provided by
the court after extraction.

Taking Penang as an example, scroll down to the case code of 17C- Permohonan Semasa Latihan
(Peneriman Jangka Pendek/Short Call) You would then receive another Petition Number (example
at PG is 17C-XXXXXXXX) This time, you would efile your b345 and the upcoming Draft and Fair Or‐
der under the High Court of your state (eg. if you are from Ipoh, you would efile it under Ipoh High
Court), instead of to the RKKK where you first filed your b1b2.

The basic steps for then non KL/Selangor Pupils would be: Pemfailan Baru – Kompleks Mahkamah
Tinggi (Your State) – Sivil – Saman Pemula – Dokumen : Saman Pemula – KOd Kes 17C Permohonan

Another difference in process for non KL/Selangor Pupils is that, you need a mover (your master or
a fully qualified associate to move your call). This means that once you have your short call date,
you will then have to make arrangements with your master or associate to move your call (loosely
speaking, to support your application). On your short call date, you shall appear with your mover at
the High Court (Check EFS for the location and exact court as well as Judge you are appearing be‐
fore!) and make few clarifications to the High Court Judge. As intimidating as it may be, it is actually
a pretty simple process. Your mover should know how to take it over for you. Please make sure your
mover is available on that short call date. If you are a KL/Selangor Pupil, kindly ignore this para‐
graphs as KL/Selangor Pupil no longer need any mover for short calls.

Then, for every pupils, remember to extract your Borang 3 when it is ready for extraction. There will
usually be a notification under Peti Fail for you to extract your extractable documents. Alternatively,
you can extract it by clicking on the orange icon as shown below.

Finally, like before, serve a copy of your extracted B3, and B4B5 to the 3 bodies. Then draft and efile
your AOS for B345. Remember, when drafting the AOS for b345, the sections to be cited in your AOS
of B345 is section 36 of the LPA. Follow closely to the sample provided in the Pupilage Handbook.
The cost would also be RM16 to file AOS for b345 (in fact it is AOS of any files would coust RM16).

If you have messed up your AOS filing and caused your Short Call to be postponed (which is an ex‐
tremely common mistake), do contact me for my draft.

Step 4: Preparing for your short call – Getting your Letter of No Objections from Malaysian Bar &
State Bar

Right after serving extracting your B3, and serving your b12345 to all 3 bodies, you should ensure
that both your AOS (for b1b2 and b345) is efiled ideally 2 weeks before your short call date.

Pro Tip:

If you have filed everything one day (before 5 pm) before your short call date and still got your res‐
ults as being rejected (for failure to FILE documents only, not for doing mistakes), you can call up
RKKK that morning to inform them that you have done actually completed the steps and they will
change your approve / give PSP for your short call!

After serving your B3 to Malaysian Bar and State Bar, you would have to remember to request for
your Letter of No Objection. Malaysian Bar typically takes 1 week to prepare your LNO, while KL Bar
will email you the LNO within 3 days of you serving them your b3 through email. By right, you
should efile your LNOs (From Malaysian Bar and State Bar) within 7 days before your short call, but
again this doesn’t seem to be a problem when the Pupil’s Short Call date is too close with the sup‐
posed date of issuance of the LNO. Nevertheless, do remember to inform the Malaysian Bar or State
Bar officer regarding your date of short call so that they can prepare your LNO on time.

So far, I’ve never seen anyone whom their petitions got objected to. Fingers crossed that you won’t be
an exception.

Once you received the LNOs (whichever comes first, just efile that LNO first. They don’t have to be
filed at the same time), efile your LNOs under Surat Peguam. It is free to efile your LNO. Just make
sure to just click on the money icon as if you are going to make payment, though you won’t need to
pay anything.

Now…the waiting games begin.

Selangor Pupils: Note that the Selangor Bar has passed a resolution requiring Selangor pupils to
undergo a 3 day course before they obtain their LNO. Program will start on July. To get Letter of
No Objection (‘LNO’) from the Selangor State Bar, you need to attend a three day course comprising
of 1 day civil litigation, 1 day criminal liti gation and 1 day of conveyancing practice. The course can
be attended even after you get your LNO.

Step 5: Checking your Short Call Results during the Short Call Date

On the short call date, go to the office of RKKK of the court you filed your papers to, and check the
notice board. You can also join our Whatsapp or Telegram Group to check on the results. By joining
our Whatsapp / Telegram Group, you can see the results of the short call which are usually shared by
our fellow brothers / sisters.

Update on 16.06.2021: Due to implementation of MCO, Pupils can check their Short Call results on‐
line at the EFS page (on or after your Short Call Date of course). The steps to do so are as follows:

Note: This method of checking your Short Call Results online is only available within 3 week of your
Short Call Date. After that, this method will no longer work and you will need to go to RKKK office
physically to check your Short Call Results. 

If your name is listed as “PSP“, congrats! You are short called, if not, and if your name is listed as
“Postponed“, you would have to correct/refile anything that is required, and wait for the next short
call date. Some problems like the absence of LNOs can be fixed on the same day and PSP will then be
granted on the spot, by bringing the LNOs and passing it to the RKKK on that day.

If your Short Call is postponed for whatever reason, the next Short Call date is usually next 2 weeks
(14 days) from your previous Short Call Date, typically on Wednesdays. After you have rectified all
problems, (for example, refiled the correct AOS etc), Pupils just need to wait for the next Short Call
date and monitor the results again. 

For Pupils outside of Klang Valley (e.g. Kelantan, Penang, Johor, Kedah, Perlis, Terengganu, Pahang,
Negeri Sembilan, Perak, Melaka), you would have to attend the High Court Short Call Hearing with
your master and/or other lawyers at your firm, to be short-called at the Hearing (either via Physical
Hearing or Zoom Hearing). Technically speaking, it is not mandatory for the Pupil to attend the Hear‐
ing (Master / Appearing Lawyer must give reason as to such absence), but it is strongly recommen‐
ded for the Pupil to attend the Short Call Hearing at the High Court. 

Step 6: Preparing the Short Call Draft Order, and then the Fair Order

After you have been short called, prepare your draft order and efile your draft order under “Draf Peri‐
ntah“. The sample can be found in the Pupilage Handbook. Draft Order is basically an “prototype”
order that you draft, which the judge will then “mark” and correct that “prototype” order. This is

free. Remember to extract your draft order (which is now been “marked”).

Finally, after extracting your Draft Order, apply those changes as “marked” by the judge in your Fair
Order (basically you amend your Draft Order as marked by the Judge). Efile your fair order under
“Perintah (Dalam Kamar)“. The cost is RM80. Then, extract your sealed fair order after about 1 working
day and serve it on the 3 bodies. You can proceed to draft an AOS for the service of your Short Call
Fair Order and efile the AOS, but this is optional and is not mandatory at all.

There is no time limit to file your Draft Order, but I recommend you to do it ASAP so as to allow you
to obtain the sealed Short Call Order soonest, and use it just in case anyone challenges your locus to
appear in Court. 

Click the Orange Paper symbol to extract/download a Sealed Copy of Your Fair Order. Remember to
serve it to the 3 bodies.

Congratulations, now your papers are in order and you would have the limited locus to appear in the
designated courts for CMs and Hearing. You also now owe me a drink.

IMPORTANT:

Please serve your sealed Short Call Order within 14 days after it is extracted. Failure to do so
without proper justification may result in delay to sit for your ethics exam later on, and ultimately
delay your long call

Step 6: Your Locus / Powers after getting short called

Read your Fair Order properly. The contents of your Fair Order is contained in the LPA 1976 itself.

In short:

Within 3 months from the date of your Short Call Order, you can appear in Chambers of all tiers of
Court and before the Registrars of the High Court, but not before the High Court Judge, to attend
case management, entering JID, bail applications and also to enter Consent Judgment.

After 3 months, you can appear before the Magistrates in Chambers and in Open Court, as well be‐
fore the Sessions Court Judge in Chambers and Open Court for Chamber Matters. You can also ap‐
pear before the High Court Judge and the Registrars of the High Court.

Can you appear in Open Court of the Sessions and High Court now? YES, as long as the matter is a
in Chamber’s Matter (Interlocutory Hearings, CM and anything other than a Trial or Matters to be
heard in Open Court).

New Ruling: Contract Of or For Service between Master and Pupil


 
Pursuant to section 57(a) of the Legal Profession Act 1976, the Bar Council has adopted Ruling 10.09,
as proposed by its Legal Profession Committee.
 
Ruling 10.09: Contract of or for service
 
A master shall not, under any circumstance, enter into any contract of or for service, with his/her pupil.
 
“It has come to the attention of the Bar Council that there are masters who enter into contractual
agreements with their pupils in chambers (“pupils”) to govern the master-pupil relationship.
 
The Bar Council’s position is that it is conduct unbecoming of a master to enter into a contract with
his or her pupil.  The master-pupil relationship is a statutory obligation, and there is no employer-

Question 1: How do I withdraw my Chambering Petition?

Answer: The process is quite simple. You would only have to draft a Notis Menarik Balik Petisyen, as
can be seen in the picture down below. E-file the Notice, and serve it to the 3 bodies while getting
their acknowledgement stamps. Then, give the Notice to your Master.

Question 2: I’m an O’Level Student and never sat for any Bahasa Malaysia examination before. Do
I need to take SPM BM again?

Answer: Under the Legal Profession Act, before anyone get admitted as an Advocate & Solicitor, they
are required to sit for a Bahasa Malaysia Qualifying Examination.

However, most people in Malaysia would have gotten at least a Credit for their Bahasa Malaysia SPM
examination, and therefore are entitled to apply for a BM exemption certificate from LPQB
at  https://elpqb.agc.gov.my/CLP/bm/user/home.php
(https://elpqb.agc.gov.my/CLP/bm/user/home.php)

With this cert (for a measly fee of RM100), you are exempted from sitting for the Bahasa Malaysia
Qualifying Examination.

Therefore, Pupils whom did not take BM examinations before, might as well just sit for the Bahasa
Malaysia Qualifying Examination which is generally easier than sitting for SPM BM (which you
would have to study for Komponen Sastera and wait till the end of the year which is extremely re‐
dundant for the purposes of Admission).

Question 3: I’m Chambering at Penang/Kelantan/Johor/Perak. How do I get back my acknowledge‐


ment copy with the Malaysian Bar and AGC stamps on it?

Answer: There are few ways to handle this. The few I know are:

a) Scan the docs and request help from your KL/Selangor friends to help you serve the   docs and get
acknowledgement straight away. Ask your friend to then courier back the docs and/or scan them
back to you.

b) Send your borangs and its acknowledgement copy through A.R Registered Post. Once AGC and
Malaysian Bar receives it, they will stamp the Yellow Card which you used to send the documents
through A.R Registered Post. You can then exhibit those stamped Yellow Cards which contains the
Malaysian Bar and AGC stamps (which in this case comes separately).

c) Courier your borangs. Attach an empty envelope addressed to yourself with stamps on it. Make it
clear in your cover letter that you want them to use that envelope to courier you back the acknow‐
ledgement copies with their stamps on it.

Question 4: How do I get my LNO from Malaysian Bar if I’m chambering in


Penang/Johor/Kelantan?

Answer: The Malaysian Bar will email you the soft copy of your LNO. Please call them to liaise.

Question 5: How long do I have to serve my extracted Fair Order to the 3 bodies?

Answer: According to your Malaysian Bar LNO, you are required to serve your extracted Fair Order
to the 3 bodies within 14 days after extraction. The implication of not doing so in unclear.

Question 6: Do I still have to go to court/RKKK to serve my LNO(s) after efiling them? (HOT
QUESTION)

Answer: No, unless it is requested. When you efile documents, that will constitute service of that par‐
ticular document(s).

Question 7: Since B1 is a continuing document (with the affidavit), should I scan it together with
my B1 as an extra step? I understand that affidavit are to be filed separetely and with separate cost.

Answer: I do not recommend doing so, as to avoid confusion. That is fine, back when efiling system is
not used for Pupilage Forms. Please just follow my guide above.

Hi bro, I don’t think that would be a problem. The easiest way is to refile(which will cost money).
You might have to efile an afidavit to correct the mistake, however it’s very unlikely given the
mistake you’ve done.

Hi, I would like to ask 2 questions.

1) Pupils are required to collect 8 CPD points wheareas the Ethics Cert is considered as 4 points. So
after we attend the seminar and collected the cert for CPD points, what are we supposed to do with
it? Do we need to file it together with our papers or to notify the state bar or bar council;

2) For exhibits filed together with Borang 6 i.e the IC, Birth Cert, Sijil Penampalan etc, must it be
CTC?

For Question1, no need to file together

For Question 2, so long as you get your 8cpd, before you can file long call, malaysia bar will send
a letter informing that you have comply with all the requirements.

No need to CTC.

There is sijil pengesahan dokumen that you suppose to file together with borang 6.

And you’re suppose to deposit your original documents with court to verify the authenticity of
the documents.

Hi there. Im doing my chambering in Johor and apparently I made a mistake on Borang 1 because I
did not state my qualification correctly. that is why i want to withdraw my application because i
want to refile.

but for my previous forms, i only managed to serve to AG and MALAYSIA BAR. so if i want to with‐
draw, do i need to notify and send withdrawal form & letter to Johor Bar Commitee as well?

Hi there, just serve your withdrawal papers to AG and Malaysian Bar since you have served your

Hi Hasni, you just have to file in an Afidavit Pembetulan, which states that you forgot to sign the
Borang 1 and intended to sign it. Efile the Afidavit Pembetulan and serve on the 3 bodies.

Hi there, make sure it’s Rm192. If you don’t get this amount, you application Will be rejected. It’s
rm 160 for b1, rm16 for afidavit, and rm 16 for b2.

Your friends application who paid RM176 will be rejected btw.

It has been that way bro since time in memorial. I can assure you that if you only pay rm192,
there will be problems. The logic behind getting rm192 as the amount is there are 3 separate
documents being filed.

In addition, Prior to this year, some people filed B1 together with affidavit. And it was allowed

Depends on when you file it. You can only file b678 after your pupillage ends. Typically, you
would have to file b678 to the KL RKKK, before applying for transfer to Kuantan court.

To answer your question, extract the document (Notis Bicara and Sijil Pengesahan Dokumen), it
would take earliest from 2 days to latest 2 weeks.

The faster you deposit your original documents (for the purposes of sealing of Sijil Pengesahan
Dokumen) , the faster it would be.

Pupillage e-Guide states to serve it on the Bar Council only. But your post states to serve it on all 3.

HI there Lee. There is no hard and fast rule stating that you have to serve your Fair Order to the 3
bodies.

That being said, Its always good that you do so, especially when pupils would even file an AOS
after they did it (this is not compulsory of course, as I highlighted in the article).

As for KL bar, you can just email the soft copy of the Fair Order, which wouldn’t hurt (KL Bar
only accepts Physical Copy anyway).

As for AGC, if you do not want to serve the Fair Order now, you can always serve it when you
serve your b678 (this is mandatory) , when the time comes for you to deal with you long call
papers.

where a mover is needed.

HI, I’m transferring my pupillage from Kuantan to KL therefore I will need to file again my borang
3,4,5. For borang 3,4,5, I noticed that for pupil in KL they will need to file it under pemfailan sedia
ada, but since i’m transferring to a new firm, does that mean i need to do it under ‘pemfailan baru’
instead of ‘pemfailan sedia ada’? As under the new firm’s efiling account there will be no record of
my previous filing.

Hi there Farid. Have you file the Notice of Change of Master? If not, make sure you do this first.

In regards to the eFiling, go under pemfailan sedia ada.

It does not matter whether your firm’s eFiling account won’t have your record of previous filing
from your old firm’s eFiling record.

Everything you uploaded, will be sent to the RKKK efs system, which is the only thing that
matters.

So yes, just file Notice of Change of Master, sample of which can be found in the BrainyLaw blog
too, and then file your Borang 345 under pemfailan sedia ada, by keying in your Petition Number
that would start with WA-xxxxxxxxxx/2018.

Depends. If you are filing b1b2, it’s under Pemfailan Baru. For Penang, your b345 also had to be
filed under pemfailan baru. All the affidavits for the borang like AOS and LNO, should be filed
under pemfailan sedia ada. LNO, file under you saman Pemula cod

Hi Mel, you don’t have to collect your physical copy from the Malaysian Bar if they have emailed
it to you. That being said, you can always collect it when you stop by the Malaysian Bar.

You only have to efile the LNO to the EFS, and there is no need for you to serve the LNO to
RKKK. By eFiling your LNO, it is deemed that you have serve it to RKKK.

Dear Syazwani, you should call RKKK and ask them immediately om whether you could efile
your supporting documents separately, maybe through the option under “Surat daripada
Peguam”.

If this is not allowed by the RKKK, unfortunately you would have to withdraw and refile your pe‐
tition, which is going to incur extra costs.

to the address on 1st para, i didnt put my Selangor address but other state address on my IC. Can i
