Zamindari Abolition and Land


Reform Act,1950 :-

1) ABOLITION OF ZMINDARI SYSTEM AND VESTING THE ESTATE ;

The intermediary system called as the zamindari system was abolished and from the
1st July all the lands were divested from the zamindars and were vested in the state
and this date is called as the date of vesting.

2) THE ACT IS NOT CONFISCATORY IN NATURE

Through this Act the lands were taken away from the zamindars but certain
zamindars were also paid the compensation.

3) REHABILITATION GRANT

The zamindars who were paying the land revenue upto rs. 10,ooo were also eligible for
the rehabilitation grant.

4) THE CULTIVATOR RIGHTS

Rights of cultivator were maintained , this act had involved a principle that a person
who cultivates the land should be the owner of the land, as he is cultivating the land
through his own hardwork.

5) SIMPLIFIED LAND TENURE SYSTEM –

Before this act there were many types of land tenure system but this Act simplified land
tenure system by simplifying them into three catagories

 Bhumidhar
 Sirdar
 Asami.

6) PROHIBITION OF LETTING

The Act prohibits the letting and subletting which means no Bhumidhar would allowed
to give his land on lease but there are certain exceptions.

7) Prevention of uneconomic holdings and accumulation of land ;

The Act aims that no person should amass huge land and infact no person should be left
with uneconomic holdings. in simple sense uneconomic holdings means some situation
upon which the cultivation is not profitable.

8) Uniform law of succession

The unique feature of this Act is that it provides for separate set of rules of succession
which is applicable to all land holders irrespective of their own religion, the person laws
are not applicable on the agricultural land under this act.

9) Establishment of village republics

There were two basic republics before this act one was the gram sabha and the second
was gaon panchayat and they were umder the UP Panchayt raj act. But by this Act two
more republics were added ;

 The Gaon Samaj


 LMC (land management committee or BPS that is bhumi prbandhan samiti.

Now with almost 70 years of independence some concepts has become useless and now
there was a time to repeal those laws. An attempt has been made and the new code that
is UP Land Revenue Code 2006 was enacted

This code was enacted by codifying around 39 Acts out of which 32 were applicable in
the state of UP and 7 were applicable in the state of Uttarakhand.
