Newborn Care Specialist Employment Contract

This agreement between Katie Morin (NCS) and (“Client/Clients”) is entered


in to this day, , 2021.

1. JOB DATE
The start date will be between and 2021 (A 5 day total span) The job will
continue for a total of weeks. . The last day of service will be on/around , 2021. It is
noted that this time frame is given as a convenience to the Client. The Newborn Care Specialist will not
be accepting any other work during the contracted time and thus not receiving any compensation for
that time she is contracted with you for the 5 day span should you not require her services. Should the
actual start date be after the later start date the Client will pay the Newborn Care Specialist salary at 50
% of her full salary, for any waiting time after the 5th day. Should the baby (babies) be born early, the
Newborn Care Specialist will make every effort to be available, pending another contract which may still
be in force. We suggest you take your due date and add 2 days for a vaginal delivery and 4 days for a C-
Section delivery and make that your start time. If you are having twins 36-38 weeks and triplets 32-36
weeks.

2. RETAINER
a. To guarantee the services of the Newborn Care Specialist, the Client agrees to submit a retainer equal
to 2 full weeks of pay at the time of booking. Please make the check payable to Katie Morin. The retainer
will be applied directly to the back end of the contract.
b. Once the retainer has been deposited and the signed contract has been received by the Newborn
Care Specialist, her services will be officially engaged and the time contracted is committed.

3. CANCELATIONS
a. If the Newborn Care Specialist does not report to the home of the Client on the agreed – upon start
date without any explanation, 100% of the retainer will be refunded and no additional monies will be
owed to the Newborn Care Specialist.
b. If the Newborn Care Specialist leaves the position due to disrespectful treatment by the Client or
noncompliance by the Client to the agreed upon terms, there will be no refunds issued and the
remainder of the contract amount will be due immediately.
c. If the Newborn Care Specialist leaves the position without cause, once the contract has started, the
Client is under no obligation to pay out the remainder of the contract although no refund of provided
services will be issued.
d. If the Client simply changes their mind, for any reason prior to the scheduled start of the contract, the
Newborn Care Specialist will retain 100% of the retainer. If it is less than 14 days prior to the start of the
contract, the balance of the contract amount is due in full.
e This contract may be terminated immediately if the Newborn Care Specialist engages in illegal,
neglectful or abusive conduct.
f. The Newborn Care Specialist has the right to terminate this contract at any time, with no consequence
to her, for reasons of neglect or child endangerment by the parents, issues not made clear by the Client
regarding child care, living or sleeping arrangements for the Newborn Care Specialist falsified, failure of
Client to compensate the Newborn Care Specialist for hours worked, any issues that have been falsified
regarding this contract or this job, or if the Newborn Care Specialist feels uncomfortable for any reason.
g. If a loss of pregnancy or cancellation of adoption, a full refund of the deposit will be due to the Client.
h. Should baby come home later than the contracted expected date and Newborn Care Specialist is
unable to care for baby, as another contract is then active, Newborn Care Specialist will make every
effort to find a qualified Newborn Care Specialist to take her place. The deposit will not be refundable,
as the Newborn Care Specialist reserved this time and held it open for Client, not accepting another
contract during the Client's contracted time.
I. The Newborn Care Specialist, will secure a backup person to substitute in the event that she is not able
to fulfill the contract due to an accident, illness or emergency. If The Newborn Care Specialist is unable
to provide her services as specified in this agreement, the Client may choose to have a backup Newborn
Care Specialist sent to her or to extend services of Katie Morin to a later date.
j. This contract may be terminated with 14 day notice if the Newborn Care Specialist is not following the
Clients instruction on caring for the infant. This is predicated on the condition that the client is asking
the Newborn Care Specialist to do reasonable care and it has been discussed with the Newborn Care
Specialist and the Newborn Care Specialist does not comply. The Client will use the APA (American
Pediatrics’ Association) as reference for their instruction.
k. The Newborn Care Specialist is in the Client’s home to educate and assist the parents. Should the
parents require the Newborn Care Specialist to do something the Newborn Care Specialist finds ill-
advised or dangerous, the Newborn Care Specialist has the obligation to report the action to the Child
Welfare Protection Department in the Client’s state. The Newborn Care Specialist will make every effort
to educate the Client on the issue before taking the aforementioned action. Should the Newborn Care
Specialist be released from this contract because of her action to protect the child she will receive
payment in full for the entire contract.
l. Should your newborn come home from the hospital with a feeding tube, monitor, oxygen and/or any
other medical equipment that is designed to help an infant survive, the Newborn Care Specialist has the
right to charge an additional hourly amount or to terminate this contract with a full refund of the
deposit. This is to be at the Newborn Care Specialist’s discretion. If the hospital/Pediatrician determines
that an RN is needed for the position the Newborn Care Specialist’s will refund the deposit less one
week’s pay.

4. NEWBORN CARE SPECIALIST RESPONSIBILITIES:


The primary responsibility is taking care of your child and things that pertain to the child such as:
a. Bathing
b. Feeding
c. Dressing
d. Changing Diapers
e. Cleaning bottles & prepare new bottles if applicable
f. Laundry (only with a 24/7 job)
g. Maintain nightly log sheets that will track feeding times, ounces, diaper changes, etc.
h. Informing and teaching the parents where applicable
I. Training and creating a workable schedule where applicable.

5. MANDATORY AND HOURLY CONSIDERATIONS:


This agreement is for newborn care services beginning on , 2020 and end approximately
,2021.

6. COMPENSATION
a. It is agreed that the hourly rate is $ per hour or $ per day for 24 hour care. This contract is for

b. If the Client is expecting the Newborn Care Specialist to do awake care during the night*, the hourly
rate will be $65 Client's initial ______ (*see General Issues # c )
c. Hours may be added to this contract but hours may not be deleted without financial compensation to
the Newborn Care Specialist. This contract is dated; the Newborn Care Specialist will be paid for any
days worked or not worked that are agreed upon in this contract. The Newborn Care Specialist will not
make up those hours or “exchange” those hours. Any hours worked outside of this contract will be time
and a half.
d. Payment shall be paid every week on Friday. Payments may be made by direct deposit or personal
check. Client is responsible for any fees associated with a bounced check and payments going forward
will need to be made in cashiers check or cash.
e. Any late payments will result in services being suspended until payments due is paid in full. Newborn
Care Specialist will not make up for any missed days as a result of suspended services for late payments.
d. Newborn Care Specialist will not charge for days missed if the reason the days are missed is her fault
(sick, emergency, etc).

7. SLEEP TRAINING OPTIONS:


Please sign one and cross out the other. These options are negotiable after the birth of the baby/babies.
a. I _________________________________(Client's name) understand Katie Morin is here to sleep train
my baby. I also understand that sleep training is an issue that will have to be addressed by both the
Newborn Care Specialist and me. Without my cooperation, it will not be possible for the Newborn Care
Specialist to sleep train my baby. Therefore when the Newborn Care Specialist gives me the “guidelines”
to follow, I will do my best to follow those guidelines with the understanding that by the end of 12
weeks our baby should be sleeping 8-12 hours each night without waking. The guidelines are listed on a
separate paper that I will receive the first day of or before the Newborn Care Specialist begins her active
duty. If I wish to have my newborn sleep trained and do not follow the guidelines set up by the Newborn
Care Specialist I will not hold the Newborn Care Specialist liable for the baby’s inability to sleep more
than 3 hours at a time. ____(initial) This is only applicable if the Newborn Care Specialist is working at
least 5 nights a week.
b. I _______________________________(Client's name) do not wish to have my newborn sleep trained
by Katie Morin and wish to have her only job to be the care and feeding of my newborn with no
intention of teaching her how to sleep through the night. This being my intention I understand that
when the Newborn Care Specialist leaves this position, I will be getting up with the baby every 3 - 4 hour
until the baby outgrows the habit. ______(initial)

8. COMMUNICATION
Good communication is essential. Discussions regarding the baby’s routine, or other matters will be
brought to the attention of the Client as soon as they occur. Likewise, if the Client has any problems with
the aforementioned issues, the Client should bring them to the attention of the Newborn Care Specialist
as soon as they occur. If the Client should want to discuss an issue the Newborn Care Specialist does
request that both Clients be present, if possible.

9. CONFIDENTIALITY
During the course of employment, the Newborn Care Specialist may legitimately see, hear or otherwise
become privy to information about the Client. It is understood and agreed that all information relating
to the Clients, including but not limited to financial, household or career, is confidential information
which may not be disclosed to anyone without the written consent of the undersigned Clients or a court
order. It is also understood that a failure to abide by this agreement may, at the Client's discretion,
result in immediate termination and legal recourse. The Newborn Care Specialist will at all times
maintain confidentiality regarding the affairs and concerns of the household and its members and
respect the Client's right to privacy.

10. GENERAL ISSUES


a. The Newborn Care Specialist will use a Daily Child Care Log when administering medication to the
children and when doing general child care. When administering medications, a medical consent must
be signed by the client. Form will be provided by NCS.
b. Newborn Care Specialist in no way indicates that Katie Morin is a R.N. or L.P.N. This is only a
terminology that has been adapted to experienced, qualified women who come in and assist a mother
and her newborn. The term Baby Nurse is not a legal term for a Newborn Care Provider and refers to a
R.N or an L.P.N..
c. It is agreed that when the Newborn Care Specialist is required to be on the premises, she shall be
considered to be on duty and active. As this is a night position, when the Newborn Care Specialist is not
attending to the baby she will be sleeping. The Newborn Care Specialist is a very light sleeper and may
have the baby monitor in her room. Client's initial upon agreement ____.

shift.

Client agrees that the compensated hourly rate for awake duty will be $65 per hour.
d. The Newborn Care Specialist will give the Client as much notice as possible for a night off, not to be
less than 2 weeks unless she is sick or it is an emergency. The Newborn Care Specialist will be given all
the following holidays off or be paid double time if required to work New Years Eve, Valentine's Day,
Easter Day, Mother's Day, Memorial Day, 4th of July, Labor Day, Her Birthday (June 30), Thanksgiving
and Christmas Eve/Day. Holidays are unpaid unless NCS is required to work.
e. The Newborn Care Specialist shall be reimbursed by the Client for all reasonable expenses incurred by
her in the performance of her duties under this contract, provided expenses are incurred with the
approval of the Client and provided the Newborn Care Specialist produces such evidence of expenditure
as the Client may reasonably require. Newborn Care Specialist will give receipts for reimbursement no
later than the Wednesday before Friday's payday.
f. If there are animals in the house that the Newborn Care Specialist ‘feels’ are jeopardizing the safety or
welfare of the newborn or herself, the Newborn Care Specialist has the right to ask those animals be
kept outside, in a pen, or closed off area of the house while she is in the house with the baby/babies.
Failure on the Client’s part to cooperate will be considered a breach of this contract. The Newborn Care
Specialist will never take a chance with the life or safety of the newborn, no matter how much you love
and trust your animal.
g. The Newborn Care Specialist is responsible for her own taxes.
h. The Newborn Care Specialist will not travel with the Client unless prior arrangements have been
made. Should the Client go out of town during the Newborn Care Specialist contract and take the baby
with them, the Newborn Care Specialist is not required to go with them, however, her salary will be paid
for the time they are out of town on the days she is scheduled to work.

i If there is another child in the house who needs care during the night, it is the Client’s responsibility to
tend to that child. The Newborn Care Specialist does not tend to other children or animals.
j. The Newborn Care Specialist is not responsible for any household duties.
k. The Newborn Care Specialist will always pick up after herself, leaving the nursery in the same
condition it was on her arrival.

11. REQUIREMENTS FOR A TRAVELING JOB:


I am hiring the Newborn Care Specialist for this a job she must travel to. ______ (Client's initial)
a. Minimum of 2 weeks stay (12 hours shift)
b. Minimum of 72 hours per week
c. Use of a car during her stay. (Exception: she has driven her own car to the job site).
d. A private room, separate bedroom from the baby/babies with a private bath
e. A round trip airline ticket with an open end (Most Client's choose to utilize their "frequent flyer" miles
for this ticket) Exception would be the Newborn Care Specialist driving to job site. The Client would pay
for driving expenses including: gas, food and lodging. Any mechanical failure is the responsibility of the
Newborn Care Specialist.
f. Ability to get on-line or wireless computer assess and a TV in the bedroom while on the premises.
g. It is understood that the Client is providing room and board for the Newborn Care Specialist for the
duration of her employment. If the Client chooses to go out for a meal, they are not obligated to take
the Newborn Care Specialist with them, but should ensure that adequate food items are available for
the Newborn Care Specialist to prepare her own meal. If the Client chooses to ask the Newborn Care
Specialist to accompany them, the Client accepts financial responsibility for that meal out. If the
Newborn Care Specialist chooses to go out for a meal on her own or order take-out, the Newborn Care
Specialist understands that she is financially responsible for that meal.
h. All basic utilities are the financial responsibility of the Client.

12. REQUIREMENTS FOR A 24 HOUR JOB (if with travel see above):
I am hiring the Newborn Care Specialist for a round the clock job. ____________(initial)
a. Included in a 24/7 job the Client will provide the Newborn Care Specialist with:
Bed
Television
Bed and Bath Linens
Wireless Internet Access
b. Providing full-time care (24 hours) requires Newborn Care Specialist to have a 6 hour stretch of
uninterrupted rest per day, where no childcare duties of any kind will be required. This time is unpaid.
This break must be taken by the Newborn Care Specialist and does not accrue. It only accrues if the
Clients request the Newborn Care Specialist not take the time off. If the Client requests the Newborn
Care Specialist work the entire 24 hours without time off, the Newborn Care Specialist will be paid time
and a half x 6 hours. This is only applicable if the Newborn Care Specialist agrees, she is not obligated to
work those 6 hours, and her pay may not be deducted should she decide she does not want to work
those 6 hours. This clause takes affect for any 24 hour job over 2 days.
c. It is understood that the Client is providing room and board for the Newborn Care Specialist for the
duration of her employment. If the Client chooses to go out for a meal, they are not obligated to take
the Newborn Care Specialist with them, but should ensure that adequate food items are available for
the Newborn Care Specialist to prepare her own meal. If the Client chooses to ask the Newborn Care
Specialist to accompany them, the Client accepts financial responsibility for that meal out. If the
Newborn Care Specialist chooses to go out for a meal on her own or order take-out, the Newborn Care
Specialist understands that she is financially responsible for that meal.
d. All basic utilities are the financial responsibility of the Client.
e. The Newborn Care Specialist is happy to do errands for the Client during her stay and unless she takes
your car, the charge for her to take her car to run these errands is 56¢ per mile to be to be paid weekly.
These errands are paid at the regular hourly rate.
f. The hours for this contract are not to be extended past the agreed upon ending date. The total hours
for this job are to be fulfilled during the agreed upon days.

13. REFERENCE LETTER


Upon successful completion of the job the Client agrees to provide a letter of recommendation to the
Newborn Care Specialist. The Client will provide this letter on or prior to the last day of
employment. Please understand that although writing a recommendation is a small inconvenience it is
enormously important to your Newborn Care Specialist's career. It is crucial that you sign the letter and
print it out on official letterhead, if possible.

14. JURISDICTION:
The terms of this agreement will be construed according to the laws of the state of CA.
The undersigned Newborn Care Specialist and Clients agree to all terms described herein. This
agreement was reached with the mutual consent of both parties.
