Note on Single Window Clearance system

1. Background –

On 27th March, 2011, The Rajasthan Enterprises Single Window Enabling and
Clearance Act was passed. As per the mandate of the act and to provide a
hassle-free experience to its investors and encourage growth of industry an
Online Single Window System was implemented in the State to facilitate
investors. The system was made mandatory for projects involving investment of
Rs. 1 Crore and above. To assist the investors in filling the forms and guide
them through the entire process, the following Nodal agencies have been
defined u/s clause 5 of this Act:

 Bureau of Investment Promotion (BIP) – For investment proposals above


Rs. 10 Cr.
 District Industries Centre (DIC) - For investment proposals from Rs. 1 Cr.
To Rs. 10 Cr.

2. New Single Window Clearance System –

In the year 2016, according to the guidelines of DPIIT (formerly DIPP), Govt.
of India, a new Advanced Single Window Clearance System (SWCS) was
developed and launched on 1st June, 2016. The System has been made fully
online (http://swcs.rajasthan.gov.in) which provides a single point (online)
interface and a time-bound clearance system, facilitating applications,
payments, status tracking, approvals and issuance of certificates. It also
provides updated information relating to relevant rules, regulations, Govt.
orders and policy initiatives and schemes for guidance of investors.

The ‘Single Window (Amendment) Rules 2016’ to this effect, were Gazetted
on 24th May, 2016. As many as 14 Departments/Corporations have been
included so far under the new SWCS. These Departments are presently
providing 98 services for online clearances (List of the Departments and
Services is enclosed). An investor can generate single sign-on ID and
password on its own. After signing on, he/she can file the relevant
application and can check status of the online applications. After the
submission of the application an investor can also pay the statutory fee
through the online payment Gateway System. The Competent Authority,
after receipt of the application for Permission/Clearance, shall consider and
take decision on the application/s within the time limit specified in these
rules. If the application/s is/are incomplete and/or any additional
information is prescribed in rules for taking a decision on the
Permission/Clearance, the Competent Authority may obtain such additional
information from the applicant.

3. Nodal Officer Review Meeting –


Review meetings with Nodal Officers of Single Window Clearance System
under the Chairmanship of Commissioner (Inv. & NRIs) are organized to
review and ensure timely disposal of applications within the prescribed time
limits.

4. Monitoring of Applications –
Status report of processing of the application for permissions, are placed
before the District Empowered Committee and the State Empowered
Committee, as the case may be by the following Nodal Agencies:

 The District Empowered Committee – to consider and dispose of the


application for permissions for investment proposals from Rs. 1 crore
to Rs. 10.00 crores.

 The State Empowered Committee – to consider and dispose of the


application for permission for investment proposals above Rs.10.00
crores.

5. Grievance Redressal Mechanism –


Any aggrieved person or applicant or investor can register his grievance on
the Portal. All grievances registered on portal are received and processed by
the Grievance Redressal Cell constituted in Commissioner of Industries and
take appropriate measures for addressing the grievances within 45 days of
registration of grievance.

6. Query Management System –

As per one of the requirements of EoDB – 2017, a Query Management


System was constituted through which an investor is enabled to ask any
query online from the concerned department of SWCS. These queries are
addressed online by the concerned departments.
