On October 24 1974, Icelandic women observed what was called

Kvennafrídagurinn, (The Women's Day Off), known outside
Iceland as the Icelandic Women's Strike. It was estimated that
at least 90% of Icelandic women participated by not going to
work and by doing no housework. An estimated 25,000 women
gathered for mass a demonstration in downtown Reykjavík. As
result a law was passed in 1976 banning wage discrimination
on the basis of gender. The gender pay gap stood at more than
40% at the time:

By the time you read this article April Fool's Day (April 1)
will have ended and you will probably feel frustrated
because you didn't get a chance to fool anyone.

LoL! Just stop here and pause your thoughts. Maybe you
don't know that someone has already made a big fool of you
and that too to such a level that you cannot feel that
someone has made a fool of you.

Let me explain it, and then maybe you will understand it.
But even after that, if you do not understand it then it
means that you are a permanent fool and April 1 (April Fool)
has no importance in your life. Because a fool cannot be
fooled again because he is already a fool.

Let’s start!

As a man, our system and society fool you from the time you
were born in the land of this country. You must have heard
the words "A Lakshmi is born in your house" on the birth of
a female child. It is generally believed that the birth of a
female child brings happiness to the family. But you might
not have heard such things on the birth of a male child.

Have you ever wondered why this is so?

Isn't the birth of a male child as good for the family as the
birth of a female child?

The answer to the above questions lies in the way our legal
and political system works. There are many government
schemes to support a woman on every aspect of life from
birth to death. For example, the famous Sukanya Samriddhi
Yojana is a welfare scheme for girl child. On the other hand,
there is no such scheme for the welfare of the male child.

Throughout the year, we see the posts of feminist, politicians

and others about gender equality on social media citing the
equality clause of the Constitution of India.

Is it logical to give all the benefits to one gender in the name

of equality by creating prejudice for the other gender?

But this is happening in India but we are not understanding

it or we have blinded ourselves to these issues. Similarly, at
the time of admission in school, a girl gets preference and
reservation over a boy child. Apart from this, there are many
other schemes such as free bicycle, free laptop and etc. for a
girl. But there is not a single scheme to help a boy in his
education. We are well aware that a boy faces a lot of
partiality in school, but we never raise our voice against it.
When a male child becomes an adult, he faces another
challenge to get a job as there are no schemes for male
empowerment and male employment. But on the other
hand, there are a lot of schemes for women empowerment

and women employment in our country.

Also, if as a man you are in a relationship with a girl, then

the whole system makes you a money-making machine for
the girl and you are forced to pay for all her expenses.

If it is called women empowerment then what is the use of

"BetiBachaoBetiPadhao"?

After all these women-welfare schemes, when it comes to

earning money, the system assumes that women are not
equal to men. And so, the government offers a lot of free
schemes for women to get their votes. In India, a woman has
no accountability towards the nation but she can enjoy all
the free benefit schemes from birth to death. A woman can
get free education, free travel and etc. without contributing
a single thing to the nation.

What is free for men?

As a taxpayer, men have to bear the burden of these free

schemes in the name of women empowerment.

Is it rational to empower one gender at the cost of the other

gender?

Furthermore, if a man cannot meet the demands of his girl /

wife, then our system has given women the unconstitutional
power to extort money from men by filing fake dowry,

The tough nut of RTI and how a common man can crack it

In October 2005, along with available legal remedies for any

individual, our country’s legislature promoted an excellent tool
of RTI Act for common people around the country. RTI
revolutionized the civil accountability of big fishes. Just a
simple internet search will lead you to so many success stories
of RTI in India - like Adarsh Society Scam (which eventually
lead resignation of a state chief minister), Public Distribution
Scam in Assam (lead to arrest of multiple high ranked govt
officials). RTI is of paramount importance for people who are
fighting false accusations, while talking about false accusation

recently (In 2021) in regards to getting departmental
details/residential address of an individual who was not
appearing as a witness as his address was not known. Now the
interesting part is he was denied by CPIO and First Appellate
Authority(FAA) - he did not give in, instead he fought calmly
and waited for his claim to be heard in Delhi’s Central
Information Commission(CIC). At CIC after presenting all the

facts the CPIO and FAA was reprimanded and given direction
to furnish the required information to Raghav. Now for a
newbie individual these terms like CPIO, FAA, CIC might not
be part of their daily life so let’s walk through how the process
of RTI unfolds for an individual. Once we file our initial RTI ,
CPIO will be the responsible person in furnishing the info, if it
gets denied the individual has to approach the FAA, in case
required information is not furnished by FAA as well, the
appellant has to approach the Central Information
Commission of India.

Like any other legislative process in India, the process of

“Filing RTI” → “CPIO Response” → “FAA Response” → “CIC”
does certainly take a great deal of time. One can always expect
a timeline of 2 years if the aggrieved appellant is approaching
the CIC. So although the path is laid out but still one might
think, why does one have to wait for 2 years just for getting a
simple departmental information or a simple railway chart
related data? Answer is not so simple.

Before we do a post mortem of the current RTI system lets talk

about a few use cases for men which they can leverage as
information in court of law through RTI.

1. In maintenance cases often the wife claims that she is

unable to maintain herself although she is well qualified and
in most cases earning money through some means or other.

The husband in this case can file an RTI to her department (if
she is a govt employee) or her university to get her educational
details. ** If the wife is an employee in a private organization
one can file RTI to EPFO by requiring details of Form 16.

2. In case there was an affair of the wife and she travelled with
her partner in some place, the husband can apply for RTI in
railways with a reservation chart of that date and use that in
the court of law.

3. Some government employee who is not appearing in court

matters but his address is not known to you for
summon/witness calling purposes.

4. If any mistreatment is done towards you by police, one can

go ahead and file RTI to police to get information
hierarchically to find the person who was in duty at that point
of time.

5. One can file RTI to the National Commission for Women

(NCW) - find out the true statistics of atrocities towards
women.

6. Certified copy of FIR on any case of your interest.

7. In case you want any state/nation specific ethical guidelines

as such a. Moral obligation of wife.

c. Rights of biological father and mother for a child

suffering because of parental separation or child
custody matter.

Now the question comes why an individual has to wait for so

long for just simple information which is already available
with the government officials?

The first reason - of course the inefficiency of the hierarchy.

Most of the times when we see a case is presented in front of
the CIC - the reason for it escalating to that level is - CPIO and
FAA has simply not followed the previously laid CIC orders.
Now this is really hard to understand - people who are
decorating such greatly important seats of public services -
how could they be so callous with their jobs. In India we often
see this attitude of government officials of saying “NO” to the
common man, instead of providing service to the general public
they do boss around. Simply Saying “NO” is easier for them
than enriching themselves with actual CIC guidelines or
searching through the archives. In this process with petty
matters they keep on burdening the CIC, which in turn gets
delayed to take up the real important issues of public interest.

Secondly following up in RTI matters does require some sort of

grit in individual level - for example one has to file the RTI 1st
appeal within 30 days of receiving the reply from the RTI. In
case one has to go for 2nd appeal, the time limit is bound

within 90 days. Additionally in this process one has to look

through the relevant citations which may help in his claim. So
one has to be vigilant and constantly monitor their RTI status
and in the last hurdle one has to be good with their oratory
skills to convince the commissioner to furnish the relevant
details. A common man with no or average knowledge of
English language may face multiple impediments in this. Our
“respected” CPIO and FAA being aware of that keep on
throwing up the cases with “NO” with a hope that people will
not really follow up with the process. That being partially true,
that is why we see so many valid RTI getting ended up in deaf
ears.

Last but not the least - they delay is often attributed by the
lack of liabilities among the officials. If information is denied
by the FAA or CPIO there is no way to penalise them by
calculating the monetary harm they have done to a society by
rejecting a valid claim.

This lack of burden - gives a free hand to some irresponsible

individuals of Indian officials workforce to avoid work. There
are instances where the information had it been made
available in the right time could have toppled the government.
But “kudos” to the people in chairs that information came to
light after half of a decade.

But still some silver linings are there - the common people are
becoming successful in their RTI. Also with increased
awareness to tackle the delay in disposal of RTI cases
Maharashtra RTI activists filed legal notice in the State
Information Commission ¹. Hopefully the government at state
level will soon take cognizance of the matter that they are no
way equipped with enough responsible work forces to dispose
of RTI matters in state level. The other states can take
example of a Bombay HC PIL - which was led by former Chief
Information Commissioner Shailesh Gandhi to enforce a
stipulated time period in disposing RTI cases ².

As a result today around 2.3 lakhs pending cases are there

with CIC, it is our responsibility as an individual to make our
state more functioning by serving legal notices in SIC similar
to MH activists. We may request the state legislature to add
some additional sections in penalizing the CPIO, FAA for
rejecting valid claims and making RTI disposal time bound.

Also if an individual appellant who is ravaged with

unnecessary delays may follow up with CIC/IC on public
authority implementation of RTI Act especially “Section 4 -
The ranking system of public offices and their performance” in
this way the public officials performance metrics can be
measured by their higher authorities and such misdemeanor
will reflect in official data ³. India is one of the 70 countries in

the whole world to implement the freedom of information,

however there are imperfections to overcome but irrespective
of those limitations certainly we are moving towards the right
direction.
