STATUS QUO :
When you get married, every couple want to have a child. They already wait it
from a long time. It’s a matter if the mother can’t have a child because of
pathology condition such as biological circumstances (infertility). The data in
indonesia there are 40 milion couple have infertility problem. Technological
developments in the field of medicine, has found a new method that artificial
insemination, known as in vitro fertilization (IVF). In line with in Virto fertilization
(IVF) is rapidly increasing, the idea of a surrogate mother that women who are
willing to rent her womb, with an agreement to pregnancy, childbirth, and
handed back the baby in exchange for some material to couples who can not have
children because the wife could not conceive.

DEFINITION :
Commercial surrogacy is a process to have a baby by entrust pregnancy. They
have a deal that surrogate mother will get money after carying the baby in her
womb. They already deal everything so that it enforced. We mean surrogacy here
gestational surrogacy that the sperm and ovum are from the couple that want to
have baby but they can’t because of her womb was remove as a treatment for
other disease process by IVF (in vitro fertilization). The surrogate mother is
already trough many examination and criteria is that mother should healhty and
have qualify that she can do surrogacy. She must be older than 25, and younger
than the age of natural menopause (52 years of age) and have married. This may
be increased slightly to 55 in the unique situation of a gestational surrogate who
is the mother or mother-in-law of the intended parent, Must have already given
birth to a child of her own and Have no history of pregnancy-related illnesses or
complications.

GOAL :
We as the government want to help couple that can’t give birth and protect the
children from wrong adoption.
Argument :
A1 : There is no disadvantages in both parties.
R1 : Humanity point of view. Surrogacy benetifical to both parties. They already
have a deal to this. So what happen after that, its not the couple responsibilty. We
stated that surrogate mother have no risk to do surrogacy because they have
tested before doing this. Surrogate mother get money from couple while the
couple have their baby from surrogate mother. It can help poor people that do
surrogacy for their better life. Many couple that rent women’s womb always take
time to look surrogate mother in 9 months. They usually provide what surrogate
mother want, it like they take care surrogate mother that carrying her baby soon.
So in this case there are no parties get disadvantaged.
E1 : We see the data that IVF success rate up to 40%, it is a high number and it
also supports with surrogate mother condition who have tested before. We see in
India, they are provide surrogate mother in clinic of surrogacy. The clinic
examintae them routinely to make sure they are healthy and eat good nutrition.
L1 : So we don’t have to worry about risk of this cases.

A2: Adoption solve nothing.

R2: Adoption is not easy. Every married couple wanted to have a baby in their life.
Happiness of having a child can’t buy with everything. When they can’t give birth,
it is one of a big concern of couple. So most people are advised to adopt. But you
know adoption is not easy to do because KPAI already provide the procedures
clearly. Based on Yayasan Sayap Ibu Jakarta, For couple that want to adopt child
should minimal 30y.o and max 55y.o and have married certificate, the couple
should report development of children until 18 years old and the couple should
get permission from Head of the Provincial Social Agencie. Before that, Head of
the Provincial Social Agencie should check that the parent is worthy to adopt the
child. If not executed, it is not a legal adoption. The goals is to avoid children
abuse.

mother. You know that her adoption is not accordance with procedure
established by the government. Her adoption process only through ealry stages
