MOTION FOR RE-RAFFLE

PETITIONER Rizza Jane S. Alib-Payne, through the

undersigned counsel, respectfully states that:

1. On July 30, 2019, the Honorable Court issued an Order

for the Publication of Notice by way of raffle pursuant to
Presidential Decree No. 1097, in relation to the Petition for Judicial
Recognition of Foreign Divorce and Declaration to Remarry under
Article 36 of the Family Code;

2. On August 1, 2019, as a result of the Raffle, the

Publication of Notice was awarded to Phil. Weekly Publication.

3. However, despite due notice to Phil. Weekly Publication

and their subsequent failure to appear, the subject Publication of
Notice remains unpublished;

4. Consequently, Petitioner respectfully submits that this

case ought to be immediately referred to the Office of the Clerk of
Court for re-raffling to another newspaper of general circulation.
 WHEREFORE, it is respectfully prayed that this case
immediately be referred to the Office of the Clerk of Court for re-
raffling.

Other just and equitable remedies are likewise prayed

for.
