EB-3 VISA
(Green Card for Over-the-Road and Year-Round Jobs)
The EB-3 visa provides a direct path to a
Green Card, which is valid for 10 years, and
can lead to US Citizenship after 5 years.
This program is intended for year-round
and/or over-the-road needs.
The application consists of 5 phases, including
applications to the Department of Labor,
USCIS, and Department of State
Phase 1: You (the Petitioning Company), ask the Department of Labor to
determine the minimum Prevailing Wage to pay both US and foreign workers
based on your location headquarters.

Phase 2: Through a series of online and newspaper ads, over a 60-day period,
you will run a campaign to recruit willing and able US workers.

Phase 3: If you were unable to hire any workers from the campaign, you will file
a Labor Certification Application with the Department of Labor on behalf of
each individual driver you want to sponsor.

Phase 4: If approved, you will then file a petition (Form I-140) with USCIS for
each worker you want to sponsor. Filing fees are $700 for the I-140, and $2,500
for Premium Processing per person. With Premium Processing, responses are
provided within 15 business days.

Phase 5: The candidate will schedule and attend an interview at the consulate
in his or her home country.

Once the candidate obtains a visa, he or she can enter the US with a Green Card
and work permit. Then, once they have their CDL license, drivers are able to begin
working! The driver must reside in the US for 6 months per year to maintain his or
her Green Card. Drivers can also bring their family members with them.

Time to process: 1 to 1.5 years or more, depending on processing times.

H-2B VISA
(Temporary Visa for Seasonal and Local Jobs)

The H-2B visa is used to bring foreign


workers for a seasonal, peak, intermittent, or
one-time-need for a period beginning April 1
or October 1 each year. There is a cap of
33,000 visas per period (66,000 per year).
Note that there is an annual lottery for the
more in-demand April to September period.

This visa is only recommended for local routes within a 50-mile radius, and not
for over-the-road jobs.
This application consists of several phases, and we begin preparing your
application at least 4 months before the intended start date.

Phase 1: File a Labor Condition Application with the Department of Labor to


advise it of your intent to hire foreign workers.

Phase 2: Conduct recruitment of U.S. workers. Submit a recruitment report to


the Department of Labor if you are unable to hire any wiling, able, and
qualified US workers for the position.

Phase 3: File an I-129 Petition with USCIS for the requested number of
workers (One $460 I-129 fee, plus $2,500 Premium Processing Fee per
company).

Phase 4: Drivers schedule and attend a consular interview in their home


country.

Phase 5: It’s time to travel to the US! If approved, the drivers will travel to the
US for the visa period.

The company is responsible for the costs of bringing drivers to and from their
home country. Drivers must return home at the end of the visa period. They can
stay a maximum of 1 year (limited exceptions apply).
