ACCREDITATION OF PROCESSORS, TRADERS, DEALERS

AND RETAILERS IN THE TRADING OF MINERALS/MINERAL


PRODUCTS AND BY-PRODUCTS

Scope
1. Covers all minerals and ores including construction materials such as:
a. Raw sand, gravel, wash out pebbles and filling materials
b. Semi-processed mineral products such as, but not limited to:
i. Rock, concrete aggregates, unpolished decorative stone (such as marble, granite, or
limestone), tiles and slabs
ii. Metallic ore concentrates/tailings
iii. Smelter slags, cathodes, ingots, billets, blooms
iv. Unrefined precious metals/bars/ bullion and
v. Agricultural/industrial lime
2. Exempted are finished/manufactured minerals and metal products such as:
a. Cement, transit mixed concrete,
b. Ceramics, polished decorative stone tiles
c. Refined or alloyed metal sheets, wires, bars, beams, plates
d. Refined precious metal bars
e. Jewelry or ornaments and
f. Other mineral products in their final form or stage ready for consumption by end-users

General Provisions
1. No person shall engage in the trading of minerals/mineral products and by-products either locally or
internationally, unless:
a. Registered with DTI and
b. Accredited by the Department
c. Copy of said registration and accreditation submitted to MGB
2. The traders, dealers, and retailers of minerals/mineral products/by-products who are not
Contractors/Permit Holders/mining right holders are henceforth required to be accredited by the
Department.
3. Contractors/Permit Holders are registered and accredited for the purpose of:
a. Trading minerals/mineral products and by-products
b. During the effectivity of their Permits or mining rights

Mandatory Requirements for Accreditation

1. Application Form
2. Copy of the Permit/Contract of the Suppliers/sources of minerals/mineral products/by-products or
copy of Certificate of Accreditation in case the source of materials is a trader, dealer, or retailer

3. DTI Registration

4. Proof of legal source or supply as supported by any of the following documents:

a. Supply Contract/Agreement with a Permit Holder/Contractor/accredited dealer producing the


specified minerals/mineral products/by-products
b. Affidavit executed by a Permit Holder/ Contractor/accredited dealer to the effect that it is willing
or currently selling and will continue to sell or supply the applicant with the minerals/mineral
products/by-products specified in the application

c. Delivery or Purchase Receipts issued by a Permit Holder, Contractor, or previously accredited


dealer/trader; and

d. Ore Transport Permit (OTP) or Bill of Lading which clearly indicates that the applicant is the
consignee of a Permittee or a duly accredited dealer/trader/shipper

5. Proof of payment of Filing & Processing Fee

6. Other supporting papers as the Regional Office concerned may require or the applicant may submit

Filing of Application:
1. Regional Office

Procedure for Accreditation


1. Regional Director who exercises territorial jurisdiction over applicant's business operation shall
issue the Certificate of Accreditation
a. Upon receipt of the application and its supporting documents
b. Regional Director concerned evaluate and validate them; and
c. Within fifteen (15) working days upon receipt thereof, he/she shall
i. issue the Certificate of Accreditation or
ii. Reject the application based on merits or demerits
2. The Regional Director shall regularly provide the Director with a list of accredited processors,
traders, dealers and retailers of minerals/mineral products and by-products filed in its jurisdiction

Fees
1. Application Fee and
2. Filing fee
3. Payable to the Regional Office

Term of the Certificate of Accreditation


2 years from its issuance, renewable for another 2 years

Confiscation, Apprehension and Disposition of Seized Mineral Products


1. Shipments of minerals/mineral products and by-products
2. By non-accredited traders and other illegal sources
