AFFIDAVIT OF WITNESS

I, POLICE CAPTAIN JEYVEE BANDIOLA QUIBRAL, 22 years of

age, single, Filipino, resides at Brgy. 143, Tondo, Manila, currently
assigned as the Chief of Investigation Section, Manila Police District.
After having duly sworn to in accordance with the law hereby dispose
and state that:

1. I was present and personally saw that respondent, PO2

Benigno C Baleta failed to attend in his court duty hearing last August
14, 2021, as witness in the shooting incident that happened in front of
the PNP-HSS building on July 20, 2021.

2. That I am one of the colleagues of the respondent in

Investigation Section of Manila Police District. On August 4, 2021, I was
at the house of the respondent and I personally saw PCPT PRECOIUS
SHARMAINE LEE, Chief of Investigation and Detective Management
Branch, personally visited PO2 Baleta in his home at 18-D Road 5, Brgy.
2nd West Crame, San Juan City and handed to the respondent the
subpoena issued by the court; informing him to appear in court after ten
(10) days of receipt to testify on the afore-mentioned incident.

3. That on August 14, 2021, the I saw the said at the

Investigation Section of Manila Police District from 8 am to 5 pm.

That, I execute this affidavit to attest to the truthfulness of the

foregoing facts and for the purpose of filing Administrative complaint of
“Grave Neglect of Duty against PO2 Benigno C Baleta of Investigation
Section, Manila Police District for violation of NAPOLCOM memorandum
Circular No. 2016-002 under Rule 21, Section 2 (C) of paragraph 1
“failure to appear and testify, without justifiable excuses, in court,
prosecutor’s office, the PNP disciplinary authorities appellate bodies, the
IAS or any other quasi-judicial body when duly notified or subpoenaed
as witness. If his non-appearance resulted in the dismissal of the case or
acquittal of the accused; or when he is the principal witness or the
arresting officer, the penalty of dismissal from the service shall be
imposed.
 That, further I hereby declare under oath that this complaint is not
a form of harassment or retaliation and the supporting
evidence/documents herein are authentic and from verification source
and fully aware of the consequence of being held liable for perjury in
case of false or misrepresentation in the affidavit.
