COMPLAINT AFFIDAVIT

I, Police Major LOVELY ALYSSA TAGUPA BONIFACIO, of legal

age, single, Filipino, presently designated as Chief of Police,
Tuguegarao City Police Station with mailing address at #143 Maharlika
Highway Barangay Caggay, Tuguegarao City, Cagayan. After having
duly sworn to in accordance with the law hereby dispose and state that:

I am formally filing a complaint against Patrolman MARLON

ONGCOY SOBERANO, of legal age, married, Filipino, a resident of
Barangay Cataggaman, Tuguegarao City, Cagayan and a member of
the Philippine National Police for Grave Neglect of Duty for being absent
from office without having filed necessary application for leave or
secured approval of the authorized official for a period of more than
fifteen (15) days prior to the enjoyment of the leave as stated in
NAPOLCOM Memorandum Circular 2016-02 Rule 21, Sec 1 para-C sub-
para 1j.

On September 1, 2021, pursuant to Cagayan Police Provincial

Office Special Order No. 22039 signed by Police Brigadier General
Manuelito De Guzman, Acting Provincial Director, Respondent Corporal
Soberano was relieved from Provincial Headquarters, Cagayan Police
Provincial Office and reassigned to Tuguegarao City Police Station.

On September 15, 2021, at around 1:00 o’clock in the afternoon,

Respondent Police Corporal Soberano was directed by Police
Lieutenant Catriona Aquino, Head of the Administrative and Resource
Management Section, through phone call to report for duty to
Tuguegarao City Police Station as his new unit of assignment and to
avoid him from being marked Absent Without Official Leave (AWOL).

On September 20, 2021, through Provincial Administrative and

Resource Management Unit (PARMU), Cagayan Police Provincial
Office,
a memorandum was sent to the address of Police Corporal Soberano
through LBC Express directing him to report for duty. On the same date,
a memorandum was sent to me as the Chief of Police, Tuguegarao City
Police Station through LBC Express requesting me to facilitate the
delivery of the same memorandum to the residence of Respondent
Police Corporal Soberano.

On October 10, 2021, Respondent Police Corporal Soberano still

failed to report for duty without informing me as his immediate superior
and Tuguegarao City Police Station about his whereabouts. Police
Lieutenant Aquino and I went to their house but only his wife was there.
She provided no details about him.

Respondent Police Corporal Soberano has no approved

application for leave of absence since August 30, 2021. He was absent
for a total of forty (40) days from September 1, 2021 to October 10,
2021.

That, I execute this affidavit to attest to the truthfulness of the

foregoing facts and for the purpose of filing an Administrative complaint
against Police Corporal Marlon Ongcoy Soberano for GRAVE NEGLECT
OF DUTY as stated in NMC-2016-02 Rule 21, Sec 1 para-C sub-para 1j
“absent from office without having filed necessary application for leave or
secured approval of the authorized official for a period of more than
fifteen (15) days prior to the enjoyment of the leave”.

That, further I hereby declare under oath that this complaint is not
a form of harassment or retaliation and the supporting
evidence/documents herein are authentic and from verifiable source and
fully aware of the consequence of being held liable for perjury in case of
false or misrepresentation in this affidavit.
