1.0 Introduction to EU Use of Work Equipment Directive

An EU Directive is a form of legislation that is "directed" at the Member States. It will set out
the objective or policy which needs to be attained. The Member States must then pass the
relevant domestic legislation to give effect to the terms of the Directive within a time frame set
in the directive, usually two years.
Directives are often used to help enforce the free trade, free movement and competition rules
across the EU. They can also be used to establish common social policies, and thus can
affect employment issues, labour law, working conditions, and health and safety. They can
therefore significantly affect businesses.
Directives can be used to set minimum EU standards to be applied at national level, but also
leave member states free to apply more stringent national measures, provided these do not
conflict with free movement and free market rules.
This is the case with the Use of Work Equipment Directive (UWED). The Use of Work
Equipment Directive 2009/104/EC contains the minimum specifications for safety and health
protection with the use of work equipment.
It applies to the operating company (employer) and it requires the employer to take every
measure to ensure the safety of the work equipment made available to workers. During the
selection of the work equipment the employer shall pay attention to the specific working
conditions which exist at the workplace, especially in relation of safety and health of the
workers. If risks cannot be fully eliminated during the operation of the work equipment, the
employer shall take appropriate measures to minimise them. Furthermore, the work
equipment should comply with relevant Community directives and/or the minimum
requirements laid down in Annex I of UWED.
Throughout its working life, the employer shall keep the work equipment compliant by means
of adequate maintenance. The employer shall ensure that the work equipment is installed
correctly and is operating properly by inspection/testing of the work equipment (initial, after
assembly, periodic and special) by competent persons. The results of inspections shall be
recorded and kept.
If the use of work equipment is likely to involve a specific risk the employer shall ensure
restricted access to its use and allowance of any modification by expert personnel only.
Ergonomics and occupational health aspects shall be taken fully into account by the employer.
The employer shall provide workers with adequate, comprehensible information (e.g. written
instructions) on the work equipment, detailing: the conditions of use, foreseeable abnormal
situations, any additional conclusion drawn from experience. Workers shall be made aware of
dangers relevant to them. The employer shall ensure that workers receive adequate training,
including risks and specific training on specific-risk equipment’s.
All of these form the minimum requirements that each member state must adhere to, however,
many member states build on these and implement their own regulations that add additional
requirements to the minimum. The purpose of this guidance is to identify each of the national
regulations and offer advice to the member organisation to ensure that when they operate in
these countries, they are compliant.
The document is intended to be a live document and we expect members to assist in its
development, operate as a trade association and share knowledge gained as they work
throughout Europe.
