 Occupational safety and health (OSH)
means providing a working environment
which is conducive to safety and health.

 Reasonable precautionary steps are taken


to ensure that workers are safe and
prevented from any health hazards due to
work activities.

 OSH at work is an issue that affects all
industries, mainly due to the fear of
prosecution.
 With better legislation enforcement and
commitment from employers and employees,
safety and health at workplace has received
greater attention.
 Safety workplaces will help to improve
productivity, accompanied by reduced
costs, better time performance and
increased profitability.

complicated. In fact, working safely
and efficiently will often save money,
and most importantly, save lives.

• The Occupational Safety and Health Act
(OSHA) 1994 was legislated on 25th Feb
1994. Also known act 514.

• This act have self regulation concept:


with the primary responsibility of ensuring
safety and health at the workplace lying
with those who create the risk and work
with the risk.
OSH LEGISLATION
• OSHA 1994 provides general duties for
the employer, a self employed person,
the designer, the manufacturer and the
supplier.

FACTORY AND
MACHINERY ACT 1967

(FMA 1967 –Regulations)


• The objective of the Factories and Machinery
Act (FMA) 1967 is to :
• provide for the control of factories on matters
relating to the safety, health and welfare of
persons, and the registration and inspection of
machinery.
• Some high risk machinery such as boilers,
unfired pressure vessels, passenger lifts and
other lifting equipment such as mobile cranes,
tower cranes, passenger hoists, overhead
traveling cranes and gondolas, must be
certified and inspected by DOSH.
DOSH enforces 16 regulations under FMA 1967. They
are:

Objective of environment and quality act
1974 legislation and enforcement (Act 127)
• An Act relating to the prevention, abatement,
control of pollution and enhancement of the
environment, and for purposes connected
therewith.
• It also deals with the administration of the
environment and towards the achievement of the
national environmental policy.
• The Act provides specific provisions with respect to
licences, prohibition and control of pollution,
appeal, delegation of powers and to make
regulations for with respect to any matters to the
environment.

• The regulations are to provide a clearer picture and
smooth implementation of the main Act.
• It helps the enforcement mechanism of the Act in
terms of its rules, regulations and orders are
subjected to interpretation, the capabilities of
enforcement officers, their expertise and human
factors.
• Therefore, the awareness and fully understanding of
the existing subsidiary legislation as provided by the
Act is crucial for implementation and enforcement
purposes
Summary
1) Occupational safety & Health (OSH) means providing a
working environment which is conducive to safety and
health
2) Safety culture in the workplace is the best safety
performance indicator that can demonstrate the
effectiveness of hazard control to prevent accident
3) Duty to care is a legal obligation to ensure the safety,
health and wellbeing of others
4) ‘So far as is practicable’ | means that something less
than physically possible or whatever is technically
possible.
5) ‘So far as is reasonably practicable’ | qualifies almost all
the general duties imposed on employers by the OSH
6) DOSH, NIOSH and SOCSO are among the most important
national competent bodies in promoting occupational
safety and health in Malaysia.
