AFFIDAVIT

We, PETER R. SERAGON and GUALBERTO C. BONABON II, both of legal age,
Filipino citizens, and residents of Purok 5, Brgy. Dalakit Catarman, Northern Samar
and Brgy. Cabacungan, Allen, Northern Samar, respectively, after having been duly
sworn to in accordance with the law, do hereby depose and state that:

1. We are employees of the Provincial Government of Northern Samar under

the Provincial Engineer’s Office (PEO);

2. We are the Project Engineers of the proposed construction of the Tourism

Billboard/Scaffolding which was awarded to AREX BUILDERS AND
CONSTRUCTION SUPPLY with the following location, original and revised
costs:

a. Lapinig – ₱ 219,798.46 / ₱ 212,349.63

b. Palapag – ₱ 219,081.15 / ₱ 211,643.38
c. Lao-ang – ₱ 219,081.15 / ₱ 211,643.38
d. Lope De Vega – ₱ 219,084.21 / ₱ 211,646.44

3. The said project was revised due to the change of item – 712 / Structural
Metal, it was approved on March 14, 2019;

4. The contractor was given time to find the material within the locality
depending on its availability. Two locations had already made progress
accomplishment of about 25% namely; Lope de Vega and Lao-ang,
Northern Samar;

5. They were given enough time to find the necessary materials and we
issued a Resume Order on October 1, 2019. However, upon our
monitoring of the abovenamed project, no further movement or
accomplishment were made;

6. Sometime on February 2020, we invited the contractor to the PEO Office

for a meeting with the agenda of updating us with their current plan on
the said project;

7. On March 9, 2020 the contractor AREX BUILDER’S AND CONSTRUCTION

sent us a letter requesting for another time extension and appealed for the
non-termination of the contract. They then committed to complete the
project by April 8, 2020;

 8. On April 27, 2020, the said contractor wrote another letter informing the
PEO Office to terminate the contract. Attached to this affidavit is their
letter-request for termination;

9. That with or without the letter-request of said contractor, we recommend

for the termination of the contract due to abandonment and non-
completion;

10.We are executing this affidavit for the purpose of terminating the
construction contract with AREX BUILDERS AND CONSTRUCTION SUPPLY
and for whatever legal intents and purposes this affidavit may serve.
