JUDICIAL AFFIDAVIT OF HILARIO M. BACTONG

The taking of this Judicial Affidavit was conducted under the

supervision of and the questions were propounded by xxxx with postal
address at c/o KHO, ROA & PARTNERS, 2 nd Floor, Arseluz Building, No. 34,
18th Street, Nazareth, 9000 Cagayan de Oro City.

The affiant is xxxx, 60 years old, married, Filipino, a resident Zone 9,

Poblacion, Upper Jasaan, Misamis Oriental, high school graduate and habal-
habal driver by occupation.

The testimony of the witness is offered to prove and corroborate the

following:

1. That he was together with the accused, xxxx on the morning of

January 05, 2021 at around 8:00 o’clock in the morning at the carwash
located at Zone 1, Luz Banzon Jasaan, Misamis Oriental.

2. That in the said same place, date and time when he saw that only
the accused and the complainant where the only ones who were
conversing at the carwash located at Zone 1, Luz Banzon, Jasaan, Misamis
Oriental. The complainant’s brothers, namely: xxxx and xxxx were not
around.

3. That the accused did not, as maliciously imputed against her,

utter the defamatory words in public that was allegedly as follows: “NAA
PAY IGSOON SI ARIEL KAPAYASON MAAYO IPAPATAY MANGINGILAD” (“You
also have a brother Ariel very boastful, good to be killed, a swindler.")
while allegedly talking to the private complainant’s brother xxxx at the
carwash located in Zone 1, Luz Banzon, Jasaan, Misamis Oriental.

This Judicial Affidavit shall serve as the direct testimony of the

witness consistent with A.M. No. 12-8-8-SC or the Judicial Affidavit Rule.
The taking of this Judicial Affidavit is in Cebuano and its corresponding
English translation is in Italics and in parenthesis.

particular carwash a few days before the events of January 05, 2021,
