BAIL BOND

WHEREAS, an Information for the above-entitled case has been filed and charging the
accused namely: __________________________, and has admitted to bail the total sum of
FORTY THOUSAND (P40,000.00) PESOS for each accused for the above-stated case.

NOW THEREFORE, I, _____________________, of legal age, Filipino, married and

resident of Poblacion, Malita, Davao Occidental, hereby jointly and severally undertake that the
above-named accused will appear and answer the charges above-mentioned in whatever it may
be tried and will at all times hold myself amenable to the order and processes of the court and if
convicted, will appear for judgment and render myself to the execution thereof, that if they fail to
perform any of these conditions, I will pay to the Republic of the Philippines, the total sum of
FORTY THOUSAND (P40,000.00) PESOS, Philippine Currency, per accused, for the payment
whereof, I encumber and constitute as first lien in favor of the said Republic of the Philippines
upon the estate absolute owned by the late TAGI BALCO and which property hereinafter
described, to wit:

in which the late TAGI BALCO, the declared and registered owner of the said property;
attached herewith is the Extrajudicial Settlement of Estate and Special Power of Attorney
executed by the heirs of the land owner.

I further declared under that the property first here-described have not heretofore been
encumbered, mortgage or pledged as security for the provisional release of any accused person
or the performance of any obligation of any kind (except herein-indicated).

I hereby further bind myself by these presents to give the Court at lease ten (10) days
notice of any transfer or other disposition to be made of the properties above-described in order
that the court may take such action as may be necessary to protect the interest on the Republic of
the Philippines and for us to avoid liability under Article 316(6) of the Revised Penal Code.

It is further stipulated that pursuant to Section 19, the Article IV of the Constitution and
Letter of Instruction No.40 of the President, dated November 10,1972, I the undersigned surety,
with the express conformity of the accused, hereby agree that in case said accused jumps bail or
fails to appear for that trial without any justification despite due notice to me as surety, her/his
absence will It is further stipulated that pursuant to section 19, the article 1V of the constitution
and the letter of instruction No.40 of the President, dated November 10,1972 the undersigned
surety, with the express conformity of the accused, hereby agree that in case said accused
jumped bail or fails to appear for that trail with out any justification despite due notice to me as
surety, her/
be deemed an express waiver of his/her rights to be present which will warrant the court to
proceed wi th the case as if the accused were presents.
